7月EHS法律法规看点：Views for laws and regulations of EHS in July 1、 大气污染：有机挥发物（VOC）开始试点收费Air Pollutions: the pilot collection of the pollutants discharge fees for Volatile Organic Compounds (VOC) begins.挥发性有机物排污收费试点办法（下称办法）由国家财政部、发改委和环保部联合发布，将于2015年10月1日开始执行。（下载： /law/102494.html ）The Pilot Measures for the Collection of the Pollutants Discharge Fees for Volatile Organic Compounds (hereinafter referred to as the Pilot Measures) is jointly issued by the Ministry of Finance of the Peoples Republic of China, the National Development and Reform Commission and the Ministry of Environmental Protection of the Peoples Republic of China, and comes into force on October 1st, 2015. (The Pilot Measures can be downloaded at /law/102494.html)本次试行的范围是：The scope of the application of the Pilot Measures is as follows.石油化工行业和包装印刷行业，具体包括石油化工业中的：原油加工及石油制品制造、有机化学原料制造、初级形态塑料及合成树脂制造、合成橡胶制造、合成纤维单（聚合）体制造、仓储业，以及包装装潢印刷业。同时各地区可以根据本地区实际情况增加VOCs排污收费试点行业，并制定增加试点行业VOCs排污收费办法。（第2条）It applies to the industry of oil and chemical and the industry of packing, decoration and printing. Specifically speaking, the former includes the processing of crude oil, the producing of petroleum products, the manufacturing of the material of organic chemistry, the manufacturing of the elementary form of plastic and synthetic resin, the manufacturing of synthetic rubber, the manufacturing of synthetic single (polymeric) fibre and the industry of warehousing and storage. The pilot industry of collecting the pollutant discharge fees for VOCs can be added according to the local and real situation, and the corresponding collection measures for that can be made. 征收的污染物类别：Categories of the pollutantsVOCs是指特定条件下具有挥发性的有机化合物的统称。具有挥发性的有机化合物主要包括非甲烷总烃(烷烃、烯烃、炔烃、芳香烃)、含氧有机化合物(醛、酮、醇、醚等)、卤代烃、含氮化合物、含硫化合物等。（第3条）VOC is a general designation of volatile organic compounds under certain conditions. VOCs mainly include non-methane hydrocarbon (NMHC) (alkane, olefin, alkyne, aromatic), oVOCs (aldehyde, ketone, ethanol, ether and etc.), halogenerated hydrocarbon, nitrogenous compounds, sulfocompound and etc. (Article 3)具体征求的办法：Specific Methods of the Collection 每一排放口排放的VOCs均征收VOCs排污费，不受对前3项污染物征收排污费限制. （第5条） The pollutants discharge fees for VOCs that are discharged from each discharging point should be collected, which is unrestricted to the collection of the pollutants discharge fees for the former three pollutants. VOCs排污费按VOCs排放量折合的污染当量数计征。（第6条）计算公式如下： The pollutants discharge fees for VOCs shall be calculated according to the number of the pollutant equivalent of VOCs. (Article 6) The computational formula is as follow:VOCs污染当量数=VOCs排放量(千克)/VOCs污染当量值(千克) the number of the pollutants equivalent of VOCs = the quantity of the VOCs emission (kilo)/ the value of the pollutant equivalent of VOCsVOCs污染当量值暂定为0.95千克。The value of the pollutant equivalent of VOCs is temporarily set as 0.95 kilo.行政征收流程与核算：The administrative collection procedures and accounting办法要求：排污者应在规定期限内向地方环境保护主管部门报送试点行业VOCs排放申报登记表，申报VOCs排放量。（第9条） 办法同时规定：Pursuant to the Pilot Measures, the pollution discharger shall report the Declaration and Registration Form of VOCs Discharging from Pilot Industries to local competent environmental protection departments in prescribed time limit and declare the discharging quantity of VOCs. (Article 9) Meanwhile, the Pilot Measures puts forward the following requirements. 石油化工行业排污者在报送试点行业VOCs排放申报登记表时，应一并填报各污染源项情况表，详细列明各污染源项生产装置、工作流程、处理设施等信息。（编者注：附2 中给出了石化行业VOCs排放量计算办法） When reporting the Declaration and Registration Form of VOCs Discharging from Pilot Industries, pollutants dischargers from the industry of oil and chemical shall fill in the Information Form of Pollutants Source, offering the detailed list including the producing equipment of all pollutant sources, the producing processes and the treatment facilities etc. (Editors note: the calculating method of the discharging quantity of VOCs for the industry of oil and chemical is given in the Attachment 2). 包装印刷行业排污者在报送试点行业VOCs排放申报登记表时，应一并提供购买、使用原辅料和有机溶剂的发票、结算或领料凭证;原料供货商提供的VOCs含量说明;危险废物处理发票等材料。（编者注：附3 包装印刷行业VOCs排放量计算办法） When reporting the Declaration and Registration Form of VOCs Discharging from Pilot Industries, pollutants dischargers from the industry of packing and printing shall offer the invoices, the voucher of clearing and claim checks of purchasing and using the raw and accessory materials and organic solvent, the contents statement of VOCs provided by raw materials suppliers and the treatment invoices of hazardous wastes. (Editors Note: he calculating method of the discharging quantity of VOCs for the industry of packing and printing is given in the Attachment 3).编者点评：Editors Comments 2013年9月10日颁布的大气污染防治行动计划中明确要求将对有机挥发物（VOCS）实施许可管理及总量控制管理。办法将从石油化工行业和包装印刷行业开始，然后将在12年内延伸到一般行业。我们留意到企业必须关注以下要点：The Air Pollution Prevention and Control Action Plan issued on September 10, 2013, requires that the license administration and the total quantity control shall apply to VOCs. The Pilot Measures starts from the industry of oil and chemical and the industry of packing and printing, and then will extend to other general industries in one or two years. We notice that enterprises shall pay attention to the following issues. 部分相关行业企业未拿到许可证，或者许可证上没有注明相关的总量要求。 Some enterprises of relevant industries have not obtained the license, or there are no requirements for the total quantity on the licenses. 请仔细阅读办法的附件4，石油行业共在表1至表10，.其中涉及大量排放源、装置、设备、废气处理、有组织及无组织排放、甚至事故排放等诸多细节。 Please read carefully the Attachment 4 of the Pilot Measures, for the industry of oil is listed in from table 1 to table 10, involving many details such as the discharge source, devices, equipments, the treatment of exhaust gas, organized discharging and non-organized discharging and even the accident discharging .因此，我们提醒石油行业及包装行业的朋友们，留意该办法的同时，积极与地方环保部门沟通，以确认申报的时机及具体信息的要求。同时、提醒各位企业的环保负责人环境税已在路上，这将是环境税中的一个方面，因此留意如何核算、如何减排是非常关键性的问题。Therefore, we hereby remind our friends from the industry of oil and chemical and the industry of packing and printing that you shall pay attention to the Pilot Measures and actively communicate with local competent environmental protection departments so as to make sure the declaring time and specific information requirements. Meanwhile, we friendly remind you that the promulgation of the Environmental Protection Tax Law of the Peoples Republic of China is on the way, which will be one aspect of environmental protection taxes; therefore, it is a critical issue to pay attention to the appraisal and calculation and how to reduce the emission. 2 事故案例及专业机构的风险：2 Cases of Accidents and Risks of Professional Agencies广东省安全生产监管管理局于6月4日专门发布了广东省安全生产监督管理局关于进一步加强安全生产专业服务机构监管的通知（下称通知），要求进一步加强对安全评价等专业机构的管理。这与近期重大事故的调查报告中反应出的安全机构存在问题是一致的。On June 4, the Administration of Work Safety of Guangdong Province issued the Notice on Further Strengthening the Supervision of the Professional Service Agencies of Work Safety (hereinafter referred to as the Notice), putting forward to further strengthen the supervision of the professional agencies such as the safety evaluation institution. This is consistent with the problems of safety agencies presented in the investigation report of recent major accidents.近期事故案例：Recent Cases2015年3月11日上午9时许，位于广东佛山顺德区杏坛镇科技4路12号的利尔德印染有限公司，发生一起61名员工吸入有毒气体导致身体不适的中毒事故（具体事故情况不在此论述，详情请看：/article-18445-1.html）。About 9:00 am on March 11, 2015, a poisoning accident happened in the Lierde Printing and Dyeing Co. Ltd., locating at NO. 12 the Science 4th Road, Xintan Town, Shunde District, Foshan, Guangdong, and there were 61 employees suffering poisoning gas inhalation (For more information, please refer to /article-18445-1.html).在5月29日发出的事故调查报告中称：“安全评价机构及安全生产标准化中介帮扶机构在利尔德公司创建安全生产标准化三级企业过程中未尽职尽责。”，并点名广东华鉴安全评价有限公司、广东顺德安评技术咨询有限公司两家从事安全专业服务机构提出了明确的责任认定，建议撤消其资质、移送公安机关依法处理。The investigation report issued on May 29 stated that “ safety evaluation agencies and the intermediary assistance agencies of work safety standards acted without due diligence during the Lierde Companys establishment of the third level enterprise of work safety standards”, pointed out that the safety professional service agencies, including the Huajian Safety Evaluation Co. Ltd., Guangdong and the Technique and Consulting Co. Ltd. of Safety Evaluation, Shunde, Guangdong, should be responsible for the consequence of the accident, and suggested that these two companies should be disqualified from the qualification of safety evaluation and should be turned over to the public security departments and dealt with in accordance with the law.该案例在专业服务机构及相关人群中引起很大反响，进而引发了通知的出台。通知对安全服务的专业机构、专业机构的审批机构（相关协会）及主管政府（安监局）提出了要求，包括：The said case has caused great repercussions among the professional service agencies and relevant people, and further led to the promulgation of the Notice. The Notice has put forward the requirements for the professional service agencies of work safety, the approval agencies for the professional agencies (relevant associations) and the competent governmental departments (the Administration of Work Safety), the detail is as follows. 对安评机构：各安全生产专业服务机构要确保专业技术服务和报告质量，保证技术服务客观真实，保证检测数据和评价结论客观公正，对出具的报告真实性负责。 For the safety evaluation agencies: all professional service agencies of work safety shall guarantee the quality of the professional and technical service and the report, ensure that the technical service is objective and authentic, ensure the inspection and testing data and the evaluating conclusion are objective and fair, and be responsible for the authenticity of the report issued. 对安监局：建立“黑名单”制度。在日常监管工作中要及时掌握辖区内安全生产专业服务机构的评价质量和业务水平，建立执业信誉档案，将缺乏诚信、违法乱纪的机构列入“黑名单”管理，及时向社会公布。 For the Administration of Work Safety: establish the system of blacklist. During the daily supervision, the Administration of Work Safety shall clearly obtain the evaluation quality and the professional ability of the professional service agencies of work safety within the jurisdiction in a timely manner, set up the files for agencies credibility, put the agencies lack of integrity or violating the law and discipline into the blacklist, and announce it to the public in a timely manner.编者点评：Comments from the Editor这一通知并非新的规定。核心的问题在于事故案例暴露出来的问题会引发怎样的连锁效应？而2014年8月2号“ 8.2特别重大爆炸事故调查报告”中也同样指出“江苏省淮安市建筑设计研究院、南京工业大学、江苏莱博环境检测技术有限公司和昆山菱正机电环保设备有限公司等单位，违法违规进行建筑设计、安全评价、粉尘检测、除尘系统改造，对事故发生负有重要责任。”但尚未提及公安和刑责。The said Notice is not a new rule.
