ACMA form LP2BPage 1 of 5June 2009 Trigger event annual compliance report local presence levels Suggested format Under section 7(2) of the Broadcasting Services (Additional Regional Commercial Radio Licence Condition - Local Presence ) Notice 22 March 2007 (the local presence licence condition) licensees who have filed a report on the existing level of local presence, must by 30 September 2008, give ACMA a report in writing about the licensees compliance to 30 June 2008. Instructions for completion Print clearly. Illegible, unclear or incomplete forms may delay processing. A number of definitions are used in this form and are identified by the use of CAPITALS. For an explanation of these definitions and for help with completing this form, please refer to the Guidelines for preparing trigger event annual compliance reports (the Guidelines). When to use this form If you are the licensee of a regional commercial radio licence which was affected by a trigger event after 4 April 2007, you must report on your compliance with the local presence licence condition for the financial year ending on 30 June 2007 and the financial year ending on 30 June 2008. You may report on both financial years using this form. If you are the licensee for multiple regional commercial radio licences affected by a trigger event, you may use one form to report on compliance for up to 10 affected licences only if all of the criteria specified in “Conditions for using one form for multiple licences” below are met. Different Licensee companies within the same group company may also use one form to report on compliance in relation to up to 10 licences held by the companies in the group ONLY IF all of the criteria specified in “Conditions for using one form for multiple licences” below are met; and an authorised agent or authorised representative provides a declaration to ACMA regarding the accuracy of the report in the declaration form on the last page of the form. Conditions for using one form for multiple licences 1.The existing level of local presence is the same for all the licences; AND 2.During the reporting period: a.The staffing level was the same for all the licences; b.All the licences met the definition of staffing levels using the same criteria in section 4 of the local presence licence condition; c.The “broadcast hours” produced by the licensee using “studios and other production facilites” were the same for all the licences; and d.The addresses and description of “studios and other facilities” were the same for all the licences. Please note you should submit this form with the approved local content plan annual compliance report (form LCP2A or LCP2AS). How to submit this form Refer to the Guidelines for details of how to submit this form (and the approved local content plan annual compliance report) to ACMA.
