party a, on its own behalf and on behalf of its affiliates in the peoples republic of china (“china”), enters into this contract with party b. party a hereunder includes party a and the affiliates it represents except as otherwise provided herein. reference shall be made to appendix 1 with respect to the name list and invoicing information of party a and its affiliates. party a is willing to purchase from party b and party b is willing to provide to party a the transportation service and other related services (“transportation services”) in accordance with the terms and conditions of this contract. during the term of this contract, this contract shall automatically apply to any new additional affiliates of party a upon party as notifying party b of its representation of such new additional affiliates and providing party b with authorization letters issued by suchadditional new affiliates if such new additional affiliates need purchase the transportation services under this contract. if party a cancels any of the affiliates in appendix 1, party b shall immediately terminate providing transportation services to the affiliate upon party as notice to party b. to provide transportation services. following the execution of this contract,when party a and the affiliates party a represents hereunder need the transportation services of party b, party a and the affiliates party a represents hereunder will purchase from party b transportation services hereunder by delivery a shipment schedule to party b by the representative of party a, the delivery, cancellation and acceptance of shipment schedule can be effected by fax, telex, electronic data interchange, e-mail and other medium which concretely contain the content. the shipment schedule and consignment note (as defined in appendix ii of this contract) shall become effective and constitute an integral part of this contract. party b shall provide transportation services to the shipper indicated in the consignment note according to the terms and conditions of this contract and such consignment note. party b shall directly issue invoices to and settle transportation charges with the 业务范围：根据本合同和甲方书面确认的托运单，乙方为甲方在中国大陆境内提供货物运输业务。 business scope: party b shall provide transportation services of goods to party a within the territory of the mainland of china pursuant to the consignment note confirmed by party a in writing. 托运人、货物的名称、性质、数量、大小、包装、收货人的名称及地址、交货地点、交货时间、运输目的等事宜应记载于托运单上，托运单是本合同的组成部分，与本合同具有同等法律效力，双方均应严格遵照执行。托运单的规定不得与本合同的规定相抵触（除非由双方授权代表签字确认或得到乙方认可） information such as the highway, railway and marine semi-trailer (including container or reefer), and 1.5ton, 3ton, 5ton, 8ton, 10ton, 15ton, 18ton and 20ton or above sealed and open-top container trailers. for the detailed vehicle models and transportation prices, please be referred to the （quotation） signed by the authorized representatives of the parties. in the event that party a requests party b to arrange vehicles of other models for transportation, such arrangement shall be discussed separately by the parties and shall be specified in the abovementioned consignment note signed by the authorized representatives of the parties. party b could use truck without xx when authorized by party a. parity a in its shipment scheduleif party b provides non-standard vehicle models or vehicle models whichdifferent with the models specified in shipment schedule, party a shall have the right to refuse to use such vehicle and neither bear any liability nor payment. it is failure of booking when party b provides vehicle models which different with the models specified in shipment schedule .if party a agrees to use non-standard vehicle models, the freights shall be according to the quotation, or freights shall be calculated in the following methods when this is not relative quoted price for special (1) if party bs reason causes the vehicle is not fully loaded but has to depart, the actual freight shall be calculated(by the standard price of corresponding vehicle in quotation divided by corresponding cubic and multiplied by the actual cubic meters of goods, and besides, party b should deliver the vehicle as party a requires or else shall remain liable to compensate for the loss.
