英汉法律术语翻译过程中的对等与不对等现象 摘要 法律英语作为一种特殊用途英语，同时具有英语和法律语言的特点。法律英 语和其他法律语言一样，拥有一系列专用术语。这些专用术语不仅体现了英语法 律体系的特征，而且使法律英语更具有正式性及庄严性。法律术语翻译的好坏、 准确与否常常关系到法律文件翻译质量的好坏。因此，法律术语的翻译是法律翻 译研究中一个非常重要的部分。但法律翻译的研究在我国起步较晚，是一个比较 新的课题，对法律术语翻译的研究更是少之又少。法律术语的翻译还缺乏系统的 理论指导，翻译的质量不如人意。 本文借鉴了法律语言学家和翻译家的理论观点，结合法律术语翻译的实例， 尝试提出法律术语翻译过程中的对等在特定程度和意义上是可以实现的，并结合 当前法律术语翻译的研究成果，尝试提出法律术语翻译过程中出现不等时的补救 措施。同时，还简单论述了寻求补救措施过程中译者的创造性。 全文共分为五章。 第一章引言，分析了法律翻译的重要性，说明法律术语翻译在法律翻译中的 重要地位，从而揭示了本文的课题研究目的。 第二章，简单介绍了法律术语背景知识，包括定义、词源、演变及特点等， 使读者对其有一个基本的了解。此外，简要概括了学者们在法律术语翻译领域的 研究成果。 第三章，是理论概述部分，介绍了本文所运用的主要理论。尝试提出法律术 语翻译过程中的对等在特定程度和意义上不是梦想。 第四章，是本文的重点部分。简单介绍了法律术语翻译过程中出现的不对等 现象及其原因。根据当前法律术语翻译的研究成果，作者提出了法律术语翻译过 程中没有对等体或相似对等体时的补救措施：( 1 ) 字面翻译加注释( 2 ) 释义( 3 ) 寻找功能对等体( 4 ) 音译( 5 ) 创造新词( 6 ) 用非法律专业的中性词。同时简 单论述了寻求补救措施过程中译者的创造性。 第五章，总结。 关键词：法律术语；对等；不对等；补救措施；创造性 e q u i v a l e n c ea n dn o n -
