摘要 自从中国加入w t o 以来，熟谙国际法和向国外介绍我国法律的任务变得越 来越紧迫。众所周知，法律语言有其特殊性，法律是通过特殊的语言形式来规 范人际关系，管理社会秩序。鉴于法律文书的文体特点，法律语言的翻译也自有 其特点。本文作者试图通过对比分析英汉合同法来阐释英汉立法语言的文体特点 及其对翻译的指导意义。 全文共分六章。第一章主要解释论文中涉及的基本概念，如立法语言，法规， 法律句子，可比性等，同时简要介绍了立法语言的特点，即正式庄重、准确清晰、 紧凑规范：第二章对英汉立法语言的文体特点进行对比，讨论实现立法语言特点 的语言形式；第三章主要讨论立法语言翻译的方法及翻译原则；第四章对英汉两 种浯言的句子结构进行了对比；第五章对英汉立法语言的特点进行对比分析，阐 明两种语言的差异，简要归纳为：形合与意合、显性与隐性、右分支与左分支、 名词词组显著与动词词组显著、被动语态与主动语态、主语显著与话题显著、尾 重与头重：第六章详尽论述英汉合同法的句子结构。 作者依据对比分析法，主要从语言学角度对英汉当代法律文件进行对比：在 可比性方面采用宏观对比的方法；在文体方面，采用从宏观对比到微观对比的 方法。作者认为，尽管英汉立法语言均属正式文体，但英语立法语言实现其文体 特点的语言形式较之汉语立法语言丰富；在翻译实践中，必须对两种立法语言的 特点加以重视，采取意译的方法，切不可逐字翻译。同时，作者认为，法律语言 的文体特点即为法律文件的翻译原则，在实际翻译中要切实做到“文随其体”， 即运用英汉立法语言的具体句子结构来体现其语体特点。 作者相信本文对英汉法律文件的对比分析可为英汉立法文件的互译打下扎 实的基础，同时希望引起更多的人对w t o 法规文件翻译的兴趣。 关键词：文体特点，立法文件，对比分析，翻译斡务法鬻、警：，+ r a b s t r a c t c o n s i d e r i n gt h a t t h e r ea r ef e wi n -
