山东大学博士学位论文 摘要 伴随着经济快速增长，中国的环境污染也日益严重。由于中国7 0 以上的污染来自 于工业，对污染企业的规制是环境规制的重点。可用于企业环境规制的政策主要有三类： 命令与控制政策、基于市场的环境规制政策、信息披露和参与机制。命令与控制政策是 世界各国环境规制中运用的主要政策，基于市场的环境政策、信息披露和参与机制从2 0 世纪8 0 年代开始在发达国家得到日益广泛的应用。环境规制政策的制定与实施过程是 相关利益集团的博弈过程，在不同的经济发展水平和环境规制制度下有不同的博弈结 果，在环境规制实践中这体现为各国不同的环境规制政策选择。在发达国家环境规制中 能取得良好效果的规制政策并不一定适用于发展中国家的环境规制。中国企业环境规制 需要根据中国的政治、经济、社会条件选择和设计适用的规制政策。本文试图以现有环 境规制理论研究成果为基础，运用规制理论和公共选择理论分析中国作为外向型发展中 经济在企业环境规制中面临的约束，及其在规制政策选择方面的含义，为我国企业环境 规制政策体系构建提供建议。 论文第一章在阐述环境规制理论依据和企业环境规制研究成果基础上，提出论文的 研究目标和研究思路。 第二章对现有的三类环境规制政策进行比较研究。与大多数文献仅对各类规制政策 的成本有效性和激励作用对比研究不同，本文从静态效率、动态效率、信息不对称、企 业与规制机构偏好等方面详细对比分析了各种环境规制政策的特点，并以此为基础构建 了环境规制政策选择矩阵作为后续章节研究的参照系。 第三章至第六章分别从四个方面研究了企业环境规制政策选择的影响因素及其政 策含义。其中第三章研究经济发展对企业环境规制的影响。环境库茨涅兹曲线的理论与 实证研究阐释了经济增长与环境污染之间的关系，建立在公共选择理论基础上的环境规 制政策选择模型阐释了政策选择的基本机制，但是现有理论都未能揭示经济发展水平如 何制约环境规制政策的选择，即为何不同经济发展水平的国家能够运用的环境规制政策 和政策实施效果都存在较大差异。本文以建立在公共选择理论基础上的政策选择模型为 基础，通过分析在经济发展不同阶段环境规制中各个利益集团偏好和相对影响力的变 化、规制制度特点的差异，提出了经济发展影响环境规制的基本机制，即经济发展首先 决定各利益集团的效用函数和相对影响力，以及政府或规制机构的目标函数与规制供给 山东大学博士学位论文 能力，然后通过各利益集团与政府或规制机构的博弈确定均衡时的环境规制政策。按照 这一机制，大多数发展中国家之所以选择“先发展后治理”主要不是由于政府观念落后 或经济发展比环境保护更迫切，而是由于经济发展水平低，环保利益集团相对影响力小， 无法为政府环境规制提供足够的压力或支持，政府环境规制供给能力的不足则进一步限 制了环境规制政策的制定与实施。与大多数文献倡导用基于市场的环境规制政策替代命 令与控制政策不同，本文认为在我国现有经济发展水平下，由于环境规制需求不足，环 境规制供给能力有限，命令与控制政策仍将是主要的环境规制政策，基于市场的环境规 制政策主要起补充作用，信息披露和参与机制的作用很有限。提高命令与控制政策的规 制效率，扩大基于市场的环境规制政策、信息披露和参与机制的应用范围，都有赖于随 着经济发展环保利益集团的壮大和包括环境诉讼制度在内的环境规制制度的进一步完 善。 第四章将研究领域拓展到对外关系方面。环境规制对国际贸易和外国直接投资的影 响得到了广泛研究，并形成了“污染天堂假说”、“竞相降低标准假说”、“污染产业转移 假说”等几种理论假说，但是对外关系如何影响一国的环境规制还缺少足够的研究。文 章通过研究国际贸易、外国直接投资和国际环境合作对环境规制的影响，阐释了对外关 系影响一国环境规制的基本机制，分析了随着对外关系的发展一国环境规制标准和规制 政策工具可能出现的变迁，为我国在全球化背景下改进环境规制政策提供了理论参考。 论文指出对外关系的发展并不一定会导致环境恶化和各国环境规制标准竞相降低，国际 贸易、外国直接投资和国际环境合作会使各国环境规制政策趋同，对于发展中国家这意 味着环境规制标准提高和更多地使用在发达国家运用的环境规制政策。 第五章研究大企业策略性行为对环境规制政策选择的影响。规制俘虏、信息不对称 和多重委托人是影响大企业环境规制的主要问题。现有文献侧重于研究存在上述问题时 环境规剖可能导致的企业策略性行为，以及对比分析数量型规制政策和价格型规制政策 下企业行为的差异，缺乏对各类政策在抑制企业策略性行为方面作用的全面分析。本文 通过分析存在上述问题时企业与规制机构的行为动机、面临的制约条件以及各类规制政 策的特点，全面分析了各类政策在抑制大企业策略性行为方面的作用，为抑制企业策略 性行为的制度设计和政策选择提出了建议。 第六章探讨e e , l , 企业治污能力约束下的环境规制政策选择。环境规制政策研究通常 不对中小企业和大企业加以区分，各国环境规制政策也往往同时运用于中小企业和大企 业，然而由于中小企业的治污能力受到经济、非经济因素制约，为大企业设计的环境规 2 山东大学博士学位论文 制政策并不适用于中小企业。这意味着不仅命令与控制政策可能由于缺乏激励、阻碍治 污能力提高而不适用于中小企业。就是基于市场的环境规制政策、信息披露和参与机制 也要针对中小企业的特点进行设计。有效的中小企业环境规制政策不但应提供足够的激 励，还应帮助中小企业克服制约治污能力的经济和非经济因素，这种环境规制政策包括 四类：一是经济补偿政策；二是支持性政策；三是增进监督能力的政策；四是消除政策 扭曲。 第七章总结论文的主要结论，结合中国的经济、社会、政治条件为企业环境规制提 出政策建议，并对有待研究的问题进行说明。 尽管论文试图对中国企业环境规制政策选择进行全面深入的研究，但是受论文篇 幅、文献资料和个人能力的局限本研究仍有一些有待完善之处。今后可能需要在以下方 面继续深入研究：一是深化和拓展理论研究。本文从经济发展、外向型经济、企业策略 性行为与治污能力约束四个方面对环境规制政策选择问题进行了研究，现实中企业环境 规制政策选择可能要考虑更多的影响因素，例如：企业环境污染与非点源污染、流域污 染的相互影响；各类环境规制政策用于治理不同污染物时的不同效果等。今后将结合这 些因素迸一步拓展研究领域。本文没有对政策设计的细节进行研究，这将留待后续研究 完成。二是进行实证研究。本文对中国企业环境规制政策选择问题进行了理论研究，限 于论文篇幅和掌握的资料实证研究不够充分，今后将以论文研究结果为基础进行系统的 实证研究，为具体环境规制政策的设计提供参考。
