内容摘要 内容摘要 1 9 9 4 年，世贸组织各成员国达成一致，决定于2 0 0 5 年初在全球范围内取 消纺织品配额。这一目标的达成有利于发展中国家扩大出口，促进发展中国家 人民摆脱贫困。 但是，值得一提的是纺织品配额取消后，我国纺织品出口之路并不平坦。 中国作为一个纺织品生产大国，由于长期受到配额体制的限制，其纺织品的生 产和贸易都遭受了巨大影响。配额的消除将大大有利于中国充分发挥其在纺织 品工业上的优势。然而，其他国家将不遗余力的保护其国内市场和纺织品工业， 因此他们千方百计地限制源自中国的纺织品的进口。2 0 0 5 年初，纺织品配额取 消后，这些国家无法再依靠纺织品配额对其国内贸易进行庇护。但是这些国家 又寻求到新的保护途径，也就是中国加入世界贸易组织工作组报告书中的第 2 4 2 段，即2 4 2 条款。这一条款是专门针对中国纺织品制定的，该条款的有效 期至2 0 0 8 年1 2 月3 1 曰。 根据该条款，如果世界贸易组织成员国认为原产于中国的服装及纺织品扰 乱市场，威胁或阻碍了同类产品贸易的有序发展，受害国有权向中国提出磋商 请求以消除市场扰乱。一旦接受磋商请求，中国必须对出口到该国的这类产品 加以限制。如果磋商未达成，则世界贸易组织成员国可以继续对原产于中国的 该种纺织品加以限制。因而，仔细研究一下这一专门针对中国纺织品出口的2 4 2 条款很有必要。
