房屋标准租赁合同SHANGHAI TENANCY AGREEMENT (合同编号: )(CONTRACT NUMBER: )出租方(甲方): Land Lord(Part A): 承租方(乙方):Tenant(Part B): 居住人: Resident: 根据中华人民共和国合同法、上海市房屋租赁条例(以下简称):条例的规定,甲、乙双方在平等、自愿、公平和诚实信用的基础上,经协商一致,就乙方承租甲方可依法出租的商品房事宜,订立本合同。In compliance with (The Contract Law of the Peoples Republic of China) and ( Shanghai Tenancy Agreement) (herein as Agreement), this Agreement is made, through consultation on the basis of equality, voluntaries and mutual benefit, by and between Party A and Party B, whereby Party A agrees to let the legally possessed real estate to Party B and Party B agrees to take the same from Party A on the following terms and conditions.一、 出租或预租房屋情况The Situation of Leasing or pre-leasing Premises.11. 甲方 出租 (出租/预租)给乙方的房屋坐落在 (以下简称该房屋)。该房屋用途为 住宅 ,房屋类型为 公寓 、结构为 钢混 。甲方已向乙方出示:Party A shall let to Party B: , which is the legal possession of Party A (hereinafter referred to as the Premises). The Premises use is Residence, the type of the Premises is Apartment, and the structure is Reinforced Concrete. Party A shall show to Party B the following item:1) 【出租】房地产权证证书编号: 。The certificate of real estate ownership, the registered number is 12. 甲方作为该房屋的 房地产权利人 (房地产权利人/代管人/法律规定的其他权利人)与乙方建立租赁关系。签订本合同前,甲方已告知乙方该房屋 未 设定抵押。Party A shall set up Tenancy Agreement with Party B as the ownership rights to realty (1.ownership rights to realty 2.bailee 3. other rights to realty by the law of the Premises). Party A shall notify Party B the premise is not mortgaged before signing the Tenancy Agreement.13. 该房屋的公用或合用部位的使用范围、条件和要求;现有装修、附属设施、设备状况和甲方同意乙方自行装修和增设附属设施的内容、标准及需约定的有关事宜,由甲、乙双方分别在本合同 补充条款 中加以列明。甲、乙双方同意该附件作为甲方向乙方交付该房屋和本合同终止时乙方向甲方返还该房屋的验收依据。The usage area, condition, requirement of common space or share occupancy of the Premises, condition of facilities, the associated amenities required by Party B based on the agreement of Party A shall be specified in the Supplementary Provisions to this Agreement by the parties hereto. Such attachment shall serve as the basis upon which Party A shall hand over the Premises to Party B as described in this Agreement, and shall inspect and accept the Premises when Party B hands back such the Premises upon the expiration of the Agreement.二、 租赁用途Usage of the Premise21. 乙方向甲方承诺,租赁该房屋仅作为 住宅 使用,并遵守国家和本市有关房屋使用和物业管理的规定。Party B promises to Party A to use the Premises solely for the purpose of Residence, and shall be abided by the related principle of local and the Peoples Republic of China.22. 乙方保证,在租赁期内未征得甲方书面同意以及按规定须经有关部门审批而未核准前,不擅自改变上述约定的使用用途。Within the term of this Agreement, Party B shall not use the Premises for any other purpose without obtaining the prior written consent of Party A and the confirmation and approval of the department concerned.三、 交付日期和租赁期限Delivery date and leasing term甲乙双方约定,甲方于 2010 年 9 月 5 日向乙方交付该房屋。【出租】房屋租赁期自 2010 年 9 月 10日起至_2012年 9 月9 日止。Party A shall deliver to Party B the leased property in good condition on Sep 5th, 2010.The term of this Agreement is commencing on Sep 10th, 2010 and expiring on Sep 9th, 2012.3-1 甲方应将该房在清洁,良好,可出租的状态下交付给租客, 保证所有电器,管线,灯具,供暖,空调正常运转.Party A will handover the above premise to the Tenant in a good, clean and tenantable condition. All electrical appliances, wiring, drains, pipes, lights and heating and A/C will be in good functional condition.3-2 租期届满,甲方有权收回出租房屋及全部家具、电器(包括附件2所例之所有家具、设备),乙方亦应如期交还;乙方如要求续租,则享有优先续租权,但必须在本租约期满前_2_个月向甲方提出书面申请。On expiry of the lease, Party A has the right to take back the leased property(including all the furniture, fittings and equipment listed in Appendix II)in full, and Party B must deliver the leased property on the date of expiry. If Party B wishes to extend the lease, Party B shall have the priority to renew the lease with _2_ months advance written notice to Party A.四、 租金、支付方式和期限Rent, Payment Method and Term 4-1 租金每月为人民币 元整, 包括家具、电器(见附件2)、物业管理费、电话及宽带安装费、会所卡入会及使用费。The rent is RMB per month, including furniture, electrical appliances (See Appendix II),management fee, telephone and internet broadband installation fee, club house membership fee.4-2 乙方应于每月 1 日前向甲方支付租金。Party B shall pay monthly rent to Party A in advance of the 1st day of each calendar month. 4-3 乙方支付租金的方式如下: 银行转账, 甲方账户信息如下 。The method of payment of the rent for the Premises is as follows: Bank Transfer. Party As bank account information is as following.账户名称Name of account: 银行账号Account Number: 银行名称Name of Bank: 4-4租金款以人民币支付,在本租约有效期内,租金不予调整。租期届满,租金双方另行协商.The rent shall be paid in RMB. The rent cannot be adjusted during the term of this Tenancy Agreement. On expiry of this lease, the revised rental shall be negotiated between the two parties.5 保证金和其他费用Security Deposit and other Fees租期开始前,乙方应向甲方缴付相当于_2_个月租金额的租赁押金计人民币 元。租约期满,乙方如不再续租,甲方应在租赁期结束后_7_日内(在乙方将全部水,电,煤气费和应由乙方支付的杂费及电话费等付清后)将押金退还(不计利息)。如因帐单延期等原因,乙方承担的全部水,电,煤气费和中央空调费等杂费及电话费无法在租赁期结束后_7_日内付清,甲方有权保留部分押金并在上述项目付清后3日内返回给乙方,但保留的押金部分不因超过上一帐期应付额的二倍。如保留的部分押金不够支付实际的帐单,乙方应在接到甲方通知后7天内向甲方补足差额,若有剩余,甲方应将剩余的押金连同已支付的帐单交还给乙方。Before the lease, Party B shall pay to Party A _2_ months rent as deposit, which is equivalent to RMB in total. On completion of the tenancy period, if Party B will not continue to rent the leased property, Party A must return the deposit in full to Party B (without interest) within _7_days after the termination of the Lease Agreement under the condition that Party B has paid all the outstanding utilities fee such as water, electricity, gas, central air-conditioning fee and telephone bill. If such outstanding utilities fee could not be settled because of limitation of the account due date, Party A has the right to keep part of the deposit and pay back this part to Party B after the outstanding utilities fee settled. However the kept part of deposit should be limited to as much as twice of the previous account period. If the part of the deposit is not sufficient to cover the actual utility bills, Party B shall pay the different to Party A within 7 days after being informed by Party A, while Party A shall return the leftover of the deposit back to party A together with the paid utility bills if there is any money left.5-1 甲方因乙方违反本合同的规定而受的损失,可在押金中扣抵合理数目,在甲方做出该种扣抵前,需书面通知乙方将被扣抵的金额和理由,乙方有权拒绝不合理或不公正的抵扣,不足部分乙方必须在接到甲方付款通知后_7_天内补足。Party A may deduct a reasonable amount from the security deposit towards payment of any actual damages Party A may have incurred or suffered as a result of Party Bs breach of this Agreement. Prior to making such deductions, Party A shall inform Party B with written notice of the amount which it intends to deduct and the reason for making such deductions. Party B shall be entitled to object to such deductions if Party B believes that such deductions are unreasonable or unjustified. If the security deposit is not sufficient to cover such amounts, Party B must pay the deficiency within _7_days of the receipt of a demand from Party A.5-2 押金以人民币支付,甲方收到押金后,向乙方开具收据。The deposit shall be paid in RMB. Party A shall issue an official receipt on the receipt of deposit. 6 房屋使用要求和维修责任The responsibilities on Repair of the Premises.6-1 租赁期间,乙方发现该房屋及其附属设施有损坏或故障时,应及时通知甲方修复;甲方应在接到乙方通知后的 3 日内进行维修。逾期不维修的,乙方可代为维修,费用由甲方承担。Within the term of the Agreement, Party B shall notify Party A to take charge of the repairs in time if any losses or damages of the Premises occurred. Party A shall be responsible for the maintenance within 3 days after receiving the notice from Party B. Party B might take responsibility of the repairs if it is overdue; but Party A shall be liable to take charge of the repairs.6-2 租赁期间,乙方应合理使用并爱护该房屋及其附属设施。因乙方使用不当或不合理使用,致使该房屋及其附属设施损坏或发生故障的,乙方应负责维修,乙方拒不维修,甲方可代为维修,费用由乙方承担。Within the term of the Agreement, Party B shall take good care of, and make proper use of, the Premises, all the installations and property therein. Party B shall be responsible, once and for all, for the loss and damage to the Premises or to the installations therein, as a result of the improper use on the part of Party B. Party B shall be liable either to take charge of the repairs there of or to indemnify Party A for such losses or damages. Party A might take responsibility of the repairs instead of the refusing repairs by Party B. Party B shall liable to take charge of the repairs.6-3 租赁期间,甲方保证房屋及其附属设施处于正常的可使用和安全的状态。甲方对该房屋进行检查、养护,应提前 叁 日通知乙方。检查养护时,乙方应予以配合。甲方应减少对乙方使用该房屋的影响。Within the term of the Agreement, Party A shall guarantee the use and safety of the Premises. Party A shall inform Party B at 3 days in advance in order to do maintenance and Party B shall thereby offer to help and cooperate. Party A shall lower the influence over Party B to use the Premises.6-4 除本合同附件(二)外,乙方另需装修或增设附属设施和设备的,应事先征得甲方的书面同意,按规定须向有关部门审批的,则还应由甲方(甲方/甲方委托乙方)报请有关部门批准后,方可进行。乙方增设的附属设施和设备归属及其维修责任由甲、乙双方另行书面约定。Party B shall accept furnishings and all installations stated in attachment (二), and only after obtaining the written consent of Party A, shall refurnish or alter any or all of the furnishings and installations therein. And in compliance with the pertinent regulations. Party B shall present a report or the aforesaid refurnishing and alterations to the department concerned. Only after all the reporting and approval procedures have been completed, shall the work of such refurnishing and alterations be affected. The belongings and maintenance of additional facilities of the Premises are based on the mutual negotiation between Party A and Party B.7 房屋交还时的状态The state of the returned Premises7-1.除甲方同意乙方续租外,乙方应在本合同的租期届满后的 一 日内应返还该房屋,未经甲方同意逾期返还房屋的,每逾期一日,乙方应按 双倍日租金 向甲方支付该房屋占用使用费。Except for obtaining Party As prior consent for renewal, Party B shall return the Premises to Party A within 1 days after expiration. If Party B fails to return the Premises on schedule, Party B shall pay liquidated damages to Party A in the amount of double rental for each delayed day.7-2. 乙方返还该房屋应当符合正常使用后的状态。返还时,应经甲方验收方可,并相互结清各自应当承担的费用。Party B shall return the Premises to Party A with useful condition. When Party A takes over the Premises, both Party A and Party B shall square the payment with each other. 8 转租、转让和交换Subletting, transfer and exchange8-1 除甲方已在本合同补充付款中同意乙方转租外,乙方在租赁期内,需事先征得甲方的书面同意,方可将该房屋部分或全部转租给他人。但同一间居住房屋,不得分割侵害转租。Unless otherwise stipulated by Party A hereto in the provisions and supplementary provisions under this Agreement, Party B shall not sublet the whole or part of the Premises without obtaining the written consent of Party A. But Party B shall not sublet part of a room, or the room by berths.8-2 乙方转租该房屋,应按规定与接受转租方订立书面的转租合同。并按规定向该房屋所在区、县房地产交易中心或农场系统受理处办理登记备案。Party B shall sublet the Premises in accordance with the sublease Agreement signed with Party A, which shall submit to local real estate department on file.8-3 在租赁期内,乙方将该房屋转让给他人承租或与他人承租的房屋进行交换,必须事先征得甲方书面同意。转让或交换后,该房屋承租权的受让人或交换人应与甲方签订租赁主体变更合同并继续履行本合同。Within the term of the Agreement, Party B must obtain Party As prior written consent before if may sublet its leased Premises to another party or exchange its leased Premises with another party within the term of the lease. Party A shall continue to perform the obligations stipulated in this Agreement during the term of the sublease, in addition to enjoying the rights and bearing the obligations stipulated in the sublease contract.8-4 在租赁期内,甲方如需出售该房屋,应提前1个月通知乙方并征得乙方同意。乙方在同等条件下有优先购买权。Within the term of the Agreement, Party A shall notify Party B 1 months in Advance with Party Bs permission when Party A wants to sell the leased Premises. Party B herein has the privilege to buy the leased Premises under same condition. Party A shall ensure that the contract is still valid between the new owner, creditor, or the third party and Party B, and Party A shall take responsibility for any damage to the interest of Party B therefrom9 解除本合同的条件Conditions to terminate the Contract9-1 甲、乙双方同意在租赁期内,有下列情况之一的,本合同终止,双方互不承担责任:This Agreement can be terminated during the term of the Agreement in any of the following circumstance. Neither Party A nor Party B shall bear the obligation if the following circumstance occurred.(一) 该房屋占用范围内的土地使用权依法提前收回的;The Premises rights are taken back according to law or other circumstances occurred attributable to prohibitions by law.(二) 该房屋因社会公共利益被依法征用的;Social & public Affairs use the Premises.(三) 该房屋因城市建设需要被依法列入房屋拆迁许可范围的;The Premises is removed during the duration of the Agreement following approved by the relevant department of the municipal or district (county) government.(四) 该房屋毁损、灭失或者被鉴定为危险房屋的;或因不可抗力原因导致本合同无法继续履行的, 不可抗力指“合同双方不能预见,不能避免且不能克服的客观情况”,包括但不限于以下情形:地震、火灾、水灾、台风、风暴、沙尘暴、地面降沉、战争、暴动、蚁灾、鼠灾、瘟疫等导致该房屋或其任何部分不再适宜居住的情形。This Agreement cannot be performed due to impair and damage, or it is unable to perform for force majeure The “force majeure” of this article refers to the circumstances which cannot be predicted, avoided, and overcame by the parties, including but not limited to the following circumstances: earthquake, fire, flood, typhoon, storm, dust-storm, downthrown, war, rebellion, ant, rat, plague etc. which destroys the habitability of the house or the parts of the house.(五) 甲方已告知乙方该房屋出租前已设定抵押,现被处分的。Party A has notified Party B in respect of mortgage. Now the Premises are in trouble of payment.9-2 甲、乙双方同意,有下列情形之一的,一方可书面通知另一方解除本合同。违反合同的一方,应向另一方按月租金的 双 倍支付违约金;给对方造成损失的,支付的违约金不足抵付一方损失的,还应赔偿造成的损失与违约金的差额部分:Under mutual agreement between Party A and Party B, either Party shall notify each other to terminate the Agreement with written notice if one of the following circumstances occurred. Either party is treated as in breach of this Agreement shall pay liquidated damages at the rate of 2 times of monthly rental. The balance between liquidated damages and losses shall be compensated if the liquidated damages thus paid are not sufficient to make up other partys losses.(一) 甲方未按时交付该房屋,经乙方催告后七 日内仍未交付的;Party A fails to deliver on schedule and fails to do so within Party B after 7 days with the time agreed upon in this Agreement.(二) 甲方交付的该房屋不符合本合同的约定,致使不能实现租赁目的的;或甲方交付的房屋存在缺陷,危及乙方安全的。The condition of the Premises delivered by Party A is hereto not in accordance with the Agreement, or the delivered Premises with the defection or damage, which could not leased to Party B.(三) 乙方未征得甲方书面同意改变房屋用途,致使房屋损坏的Party B uses the leased property other than for the purpose stated herein.(四) 因乙方原因造成房屋主体结构损坏的;Party B alters the structure of the Premises without authorization.(五) 乙方擅自转租该房屋、转让该房屋承租权或与他人交换各自承租的房屋的;Party B sublets, transfers or swaps the Premises without obtaining the prior written consent of Party A.(六) 乙方逾期不支付租金超过 15 日的;Party B fails to pay rent for more than 15 day after the due day.10 违约责任Liabilities for Breach of contract10-1 该房屋交付时存在缺陷的,甲方应自交付之日起的 叁 日内进行修复,逾期不修复的,甲方同意减少租金并变更有关租金条款。Party A shall carry out repairs on the Premises after 3 days of delivery. Party A shall agree to lower the rental and notify the related supplemental clauses if Party A shall not repair the Premises within the due date.10-2 甲方保证乙方在此租赁合同规定的租期内享有使用该房屋的完整的权利。若该房屋的全部或部份的所有权改变可能严重影响乙方在此租期间的权利,甲方应在此情况发生后5日内通知乙方,并保证新的房产所有人、债权人、第三方使租赁合同保持效力。若因上述情况导致乙方的权利受到损害,甲方应承担责任;因甲方未告知乙方,该房屋出租前已抵押或产权转移已受到限制,造成乙方损失的,甲方应负责赔偿。Party A shall ensure that Party B enjoys the complete right of utilization of the house in the contract term. In case any change of the ownership of the house or the parts thereof may severely affect the right of Party B, Party A shall notice Party B in writing within 5 days as of the occurrence date of such change, and ensure that the contract is still valid between the new owner, creditor, or the third party and Party B, and Party A shall take responsibility for any damage to the interest of Party B therefrom; If Party A fails to represent Party B about mortgage statues and the restriction of transferring the rights of the Premises in this Agreement. Party A shall be liable for Party Bs losses.10-3 租赁期间,甲方不及时履行本合同约定的维修,养护责任,致使房屋损坏,造成乙方财产损失或人身伤害的,甲方应承担赔偿责任。If Party A fails to fulfill the maintenance responsibility according to this agreement and which has caused the damage of the Premises and the lose of Party Bs property or person, Party A shall be liable for Party Bs losses.10-4 租赁期间,非本合同规定的情况,甲方擅自解除本合同,提前收回该房屋的,甲方应向乙方支付相当于两个月租金 的违约金。若违约金不足抵付乙方损失的,甲方还应负责赔偿。If Party A arbitrarily rescinds this Agreement within the lease term for reasons not attributable to this Agreement herein and take back the Premises ahead of time, Party A shall pay liquidated damages to Party B in the amount of 2 times the monthly rental; if the liquidated damages thus paid are not sufficient to make up Party Bs losses, Party A shall also be responsible for paying compensation.10-5 乙方未征得甲方书面同意或者超出甲方书面同意的范围和要求装修房屋或者增设附属设施的,甲方可以要求乙方 赔偿损失 (恢复房屋原状/赔偿损失)。Restore or refurnish the Premises without obtaining the prior written consent of Party A, or exceeding the area stated in this Agreement. Party A shall require Party B to pay the liquidated damages (a. return to the original condition / b. pay the liquidated damages)10-6 租赁期间,非本合同规定的情况,乙方中途擅自退租的,乙方应向甲方支付相当于两个月租金 的违约金。若违约金不足抵付甲方损失的,乙方还应负责赔偿。甲方可从租赁保证金中抵扣。保证金不足抵扣的,不足部分则由乙方另行交付。If Party B terminates this Agreement within the lease term for reasons not attributable to this Agreement herein, Party B shall pay liquidated damages to Party A in the amount of 2 times the monthly rental. If the liquidated damages thus paid are not sufficient to make up Party As losses, Party B shall also be responsible for paying compensation. Party A has the rights to redeem the losses from security deposit. If security deposit thus is not sufficient to be redeemed, Party B shall also be responsible for paying the remedial fee.11 其他条款Other terms11-1 租赁期间
