摘要 法律英语是英语的一个特殊语域，具有区别于文学语言和其他实用文体 的显著特点。作为英语的功能变体，法律英语的文体特点取决于法律的特殊社会 功能。法律在社会活动中的特殊作用要求法律英语正式、准确、保守，尽量避免 模糊和歧义。但对于正式和准确的极至追求，使得法律英语显得过于复杂、累赘， 甚至是枯燥乏味。所有这些特点在法律英语的词法和句法中都有所体现，因此通 过对法律英语的研究，能够对这一特殊语域有更深的认识。本文遵循文体学的研 究理论和方法，对法律英语的词法和句法进行全面而系统的归纳和探讨，进而对 法律英语文体特征的原因进行分析并得出结论。 本文首先介绍了国内外对法律英语这一特殊语域的研究现状，法律的 作用及其对法律语言的影响，即法律的功能性决定了法律语言的特殊性。法律英 语的特点在其词法和句法中有明显的反映，对法律英语词法和句法的研究，可以 加深对这一文体的深层认识。然后以文体学的相关理论为理论基础，研究法律英 语的功能变体。最后对法律英语的特点进行了比较分析、归纳和总结。 文章从六个方面对法律英语的词汇特点进行分析。法律英语一般使用的 场合比较严肃，所以用词一般也比较正式，往往使用拉丁词和拉丁词源的词。法 律英语还广泛地采用法语借词，使法律英语变得高贵典雅。由于术语词义的单一 性和准确性，法律英语普遍地使用法律术语以达到准确无误的效果，因而，有 些法律术语只用于法律语言中，而不用于其它语境。出于法律工作中存在大量的 相互对立的人物、事件、行为等，法律术语也就存在大量的成对的反义词。法律 英语中行话的频繁使用反映了法律的职业特征和法律英语的语言风格。英语中的 古词在普通英语中罕见，而在法律英语中，尤其是合同、协议中，古词被广泛使 用。通过这些论述得出法律英语具有严肃、保守、僵硬、权威等文体风格。 本文主要以具体的法律条款或合同条款为实例，详尽地论述了法律英语 的句法特点。法律语言中的句子都比较长，而且错综复杂。这也与法律英语的功 能相联系，法律语言中的句子要完整地把每一种可能、每一点可能引发争议的地 方表述清楚，因此句子就难免会不断加长，往往使用一般现在时，并以从句、副 词短语、不定式短语等方式复合而成。法律语言要求准确，不能用带有疑问或者 v l i 感情色彩的句式束表现，给人产生模棱历町的感觉，多用情态动i 司来胤范双力的 责任和义务，具有强制和普遍的语气，显示其权威性。另外，法律语占多以主动 语气为主表现其社会功能。 法律英语作为一种功能变体，其文体特征主要是由其所要实现的社会功 能决定的。法律的严肃性、权威性和准确性决定了法律英语文体具有正式性、传
