摘要 刑法通常被界定为规定犯罪和刑罚的法律。关于犯罪和刑罚的规定，犹如密布在刑 法这棵大树上的枝叶，但是支撑刑法之树的主干就是刑事责任。那么，刑法从根本上说， 就是设定和追究刑事责任的法律。 在刑事立法过程中，一种行为应当不应当负刑事责任，始终是立法者决定是否将其 作为犯罪予以禁止性规定的基本因素；一种行为应负责任的程度，始终是立法者决定对 其规定何种刑罚的根据。在刑事司法过程中，刑事责任应当成为贯穿刑事司法的主线， 整个刑事司法活动，比如，对刑事责任的追究、确认刑事责任以及对刑事责任的实现都 是围绕刑事责任展开的。从刑事司法看，刑事责任是刑事司法活动所要解决的中心问题。 而刑事立法和刑事司法都要以刑事理论为基础，同时，刑事责任理论又是刑法理论中最 复杂的问题之一，对刑事责任的不同理解和不同态度，导致了不同的刑罚制度、不同的 刑法学派和不同的刑法理论，在刑事责任的研究领域，众说纷纭，学派林立，历久不衰。 而对刑事责任地位的不同理解，又关乎整个刑法体系构建，更关乎整个刑法学理论的构 建。 本文从大陆刑法中的责任主义到我国目前的刑事责任的理论演变入手，首先，对“责 任主义”中的责任与“刑事责任”中的责任进行厘清与区分，在我国刑事责任的语境下 分析刑事责任的实质，针对我国对刑事责任概念的不同学说进行讨论，通过比较研究并 通过对相关概念的界分，得出科学的刑事责任的概念，然后，以此为基础，对刑事责任 的地位在目前现有的各种理论的基础上进行深入探讨，通过对各种理论进行讨论和比 较，肯定了“罪一责”平行说的科学性和合理性。最后，在确立了“罪一责”平行说的 基础上，对刑事责任的理论地位、立法地位、司法地位分别进行界定。 除引言和结语外，本文包括以下三个部分： 第一部分：刑事责任概述。该部分分别论述了刑事责任的历史透视、刑事责任的实 质和研究刑事责任的意义三个层次的内容。 在对我国刑事责任的透视中，主要从我国刑事责任的表现形式和实质含义在历史上 的演变和沿革上进行分析。在法律发展史上，刑事责任与民事责任起源于同一，起初， 两者在表现形式上并无差别，我国的刑事责任也经历了与民事责任合一的阶段。随着社 会经济的发展，商品经济的发达，民事财产关系变得复杂起来，诸法合体、刑民不分的 法律结构已经不能适应社会发展的需要，立法上逐渐将损害赔偿的方法与维持社会秩序 的方法加以区分。民事责任和刑事责任初步分离，但是以刑事责任为主。随着民族资本 主义的兴起，1 9 1 0 年颁布的大清现行刑律和大清新刑律和1 9 1 1 年完成的大 清民律草案在形式上实现了刑事责任和民事责任在我国的分离。刑事责任逐渐趋向主 观化，民事责任逐渐趋向客观化。这种分化使得个人与社会的关系得到调和，无疑是人 类法律发展史上的一个进步。在实质含义上看，中国刑法学中的刑事责任是从大陆法系 刑法学中的责任主义演变而来，而这个演变的中介是苏俄刑法学。在大陆法系的刑法学 中，“责任”这个概念无可争议的是属于主观范畴。后来，弗朗克提出了期待可能性， 并以此作为责任的规范要素，从而开始了从心理责任论到规范责任论的转变。可见，责 任的含义渐渐地从形式转为实质、从结果负担转为责任负担、从客观转为主观。责任主 义相对于客观责任、结果责任而言是指主观责任，从客观责任到主观责任，这是一种历 史的进步，是随着道义责任论的确立而完成的。将责任主义和刑事责任进行一个对比性 考察，我们可以发现两者在责任的地位上，功能上和内容上都是完全不同的。 在对刑事责任实质的研究中，将社会责任论和道义责任论进行比较：道义责任论为 刑事古典学派所主张，它是从康德的道德义务论中引申出来的一种责任理论。以道义责 任为前提，认为道义的非难即在道义上进行谴责是刑事责任的实质所在，道义责任论之 所谓道义，就是指道德义务；社会责任论是刑事实证学派关于责任根据的理论，批判了 道义责任论绝对的自由意志论，从社会的角度来考虑责任的本质，使对犯罪的道义非难 改变为社会非难，认为刑事责任的本质是社会为了防卫自身的安全而对具有侵害社会的 危险性的人采取的措施，其实质是社会处置论。从对比中得出对我国刑事责任的研究需 要把握的要点。 刑事责任之争由来已久，学说上早就有古典学派的道义责任论和近代学派的社会责 任论的对立。刑事责任关系到刑法理论的全局，几乎所有的刑法问题都与刑事责任紧密 相联。刑事责任的概念问题实际上关系到刑事责任合理定位，因为对刑事责任概念的不 同理解，将导致对其的地位的不同认识。这也就是对刑事责任研究的意义。 第二部分：刑事责任的蕴涵。这部分包括四个层次：责任的概念、刑事责任概念之 争鸣、刑事责任与相关概念的界分最后对我国刑事责任的概念进行界定。责任是刑事责 任的上位概念，笔者从明确“责任”一词的汉语含义入手阐释中国刑法典中规定的“责 任”，最后论证我国的刑事责任。阐明“责任”一词在中国刑法中的四层含义：应当承 i l 担的法律后果、在行为的实施中所起的重要作用、负有的职责和主观上的过失。对我国 刑事责任各学说进行比较分析：法律责任说、刑事追究和刑罚处罚说、刑事义务说、心 理状态说、法律后果说、法律负担说、法律关系说、否定评价( 谴责、责难) 说。通过 对刑事责任与相关概念的界分，比如：刑事责任与刑罚、刑事制裁措施、法律后果、刑 事法律关系和法律义务等的分析研究最后对我国刑事责任进行概念上的界定。肯定了否 定评价( 谴责、责难) 说的科学性，认为刑事责任是指国家依据刑事法律对犯罪人及其 行为所作出的的否定性评价、责难或谴责。 第三部分是对刑事责任地位的研究。包括三大块的内容：刑事责任地位的诸学说、 对刑事责任地位诸学说的评价以及对刑事责任地位的合理定位。该部分对我国目前纷繁 复杂的关于刑事责任的地位几种主要学说，如：“罪一刑( 刑罚) ”平行说、“罪一责一 刑”平行说、“罪一责”平行说、基础理论说，进行陈述，表明各学说所支持的观点和 理由。关于我国刑事责任地位诸学说的评价：通过对“罪一刑( 刑罚) ”平行说、“罪一 责一刑”平行说、“罪一责”平行说和基础理论说之间的对比讨论，分析得出各个学说 的优缺点，肯定“罪一责”平行说的科学性。该部分在前面理论分析的基础上，通过研 究和探索，界定了我国刑事责任的理论地位、立法地位和司法地位，并进行了深入的分 析。最后强调，应当始终重视刑事责任的应有地位，这样才能更好地实现罪刑相适应，
