Work, full play party, and branch, and members in five type Enterprise construction in the of core role, and fighting fortress role and pioneer model role; to continues to strengthening four good leadership construction, full play levels cadres in enterprise development in the金华市建筑工程安全防护、文明施工措施费用的计取及其使用管理规定第一条 为加强建筑工程安全生产管理，确保安全生产所需资金按标准足额、及时到位，保障施工作业人员的作业条件和生活环境，防止施工安全生产事故发生，根据建设部建筑工程安全防护、文明施工措施费用及使用管理规定、浙江省政府关于切实加强安全生产工作的决定等有关规定，结合我市实际，制定本规定。第二条 本规定适用本市行政区域范围内各类新建、扩建、改建的房屋建筑工程（包括配套的线路管道设备安装工程、装饰工程）、市政基础设施工程、城市园林绿化工程和拆除工程。第三条 本规定所称安全防护、文明施工措施费用包括浙江省建设工程施工取费定额（2003版）中的文明施工费、环境保护费、安全施工费、临时设施费。第四条 建设单位、设计单位在编制工程概算时，应当依据省造价管理机构测定的相关规定确定建筑工程安全防护、文明施工措施费用。第五条 依法进行建设工程招投标的项目，招标方或招投标代理机构编制招标文件时，应当按照有关规定单独列出安全防护、文明施工措施费用项目清单。投标方安全防护、文明施工措施费用的报价，不得低于浙江省建设工程施工取费定额（2003版）规定的下限值。并应当根据现行标准规范，结合工程特点、进度和作业环境列出安全防护、文明施工措施费及其使用项目、投入计划。第六条 建设单位与施工单位应当在施工合同中明确安全防护、文明施工措施费用总额、本规定明确的费用支付方式及使用要求、调整方式等条款。建设项目应实行工程施工总承包。实行工程施工总承包的，总承包单位应依法将工程分包给具有相应资质的单位，总承包单位与分包单位应当在分包合同中明确安全防护、文明施工措施费用由总承包单位统一管理。安全防护、文明施工措施由分包单位实施的，由分包单位提出专项安全防护措施及施工方案，总承包单位批准后应及时支付所需费用。对未实行工程施工总承包的，招标方或招投标代理机构在编制招标文书时，应明确发包范围。建设单位应将该项目后继发包内容报当地建设行政主管部门登记。第七条 建筑工程安全防护、文明施工措施费用实行专款专用，提取基数为工程造价（中标价或合同价），建筑工程费率不得低于1.5% ；市政园林工程费率不得低于1.0%。并由建设单位一次性全部存入市、县（市）指定的专门账户，所有权归施工单位。费用到位及使用投入情况接受市、县（市）建设行政主管部门的监督。第八条 建设单位在办理安全监督手续时，应当提交安全防护、文明施工措施费用到位的交款凭证、施工单位的安全防护文明施工措施费用的使用项目、投入计划等相关资料，作为保证工程安全的具体措施之一。未提交的，建设行政主管部门可视作保证工程安全的具体措施不健全而不予核发施工许可证。第九条 施工单位应按三阶段制定安全防护、文明施工措施费用的投入使用计划，确保安全防护、文明施工措施费用专款专用，在财务管理中单独列出安全防护、文明施工措施费用项目备查。第十条 市、县（市）建设工程安全监督部门根据每阶段的施工现场安全防护、文明施工措施落实情况，进行三阶段评分，并报建设行政主管部门审定，同时按下表规定确定该阶段的费用额度。得分值（S）S8070S80S70费用额度100%80%60%第十一条 施工总承包单位在开工前五天内按领取计划，经监理单位审核后，向市、县（市）建设行政主管部门申请安全防护、文明施工措施费用预付款，额度为全部安全防护、文明施工措施费用的60%。在阶段完工后，经监理单位审核，向当地建设行政主管部门申请该阶段的剩余费用。第十二条 市、县（市）建设工程安全监督部门自收到施工总包企业三阶段评分申请报告后5个工作日内完成评分工作，报市、县（市）建设行政主管部门审定，并将得分值告知施工、监理单位；市、县（市）建设行政主管部门自收到施工总包单位阶段剩余费用申请报告后3个工作日内完成相关支付手续。对于安全评定得分值小于80的，由市、县（市）建设工程安全监督部门督促其整改。如整改仍不到位的，将强制委托有关单位对其进行安全生产宣传教育或技术辅导，施工单位从未拨付费用中列支宣传教育或技术辅导费，同时按有关规定给予相应处罚。第十三条 监理单位应认真履行安全生产监督义务，对施工单位落实安全防护、文明施工措施情况进行现场监理。对施工单位已经落实的安全防护、文明施工措施，监理单位应当及时审查。如发现施工单位未落实施工组织设计及专项施工方案中规定的安全防护和文明施工措施的，要责令其立即整改；对拒不整改或未能按要求整改到位的，应及时向当地建设行政主管部门报告。第十四条 工程施工总承包单位对建筑工程安全防护、文明施工措施费用的使用负总责。总承包单位应当按照本规定及合同约定及时向分包单位支付安全防护、文明施工措施费用。总承包单位不按本规定和合同约定支付费用，使分包单位不能及时落实安全防护措施导致发生事故的，由总承包单位负主要责任。第十五条 建设单位或招标代理机构未按本规定在招标文件中将建筑工程安全防护、文明施工措施费用单列的，由县级以上建设行政主管部门依据浙江省招标投标条例的规定予以处罚。第十六条 建设单位未按规定支付安全防护、文明施工措施费用的，由县级以上建设行政主管部门依据建设工程安全生产管理条例第五十四条规定，责令限期整改；逾期未改正的，责令该建设工程停止施工。第十七条 施工单位将安全防护、文明施工费挪作它用的，由县级以上建设行政主管部门依据建设工程安全生产管理条例第六十三条规定，责令限期整改，处挪用费用20%以上50%以下的罚款；造成损失的，依法承担赔偿责任。第十八条 建设行政主管部门的工作人员有下列行为之一的，由其所在地单位或者上级主管机关给予行政处分；构成犯罪的，依照刑法有关规定追究刑事责任：（一）对没有提交安全防护、文明施工措施费用支付计划的工程颁发施工许可证的；（二）发现违法行为不予查处的；（三）不依法履行监督管理职责的其他行为。第十九条 建设单位后继发包工程的安全防护、文明施工措施费用的计取及使用管理依照本规定执行。第二十条 本规定由金华市建设局负责解释。第二十一条 本规定自2006年3月1日起施行。仿佛顷刻间，亚运就来到了我们身边。一个普通的人，很难想象它背后隐藏着多少人的心血，藏匿着多少人的汗水，背负着多少人的梦想，寄托了多少人的祝愿，在这个激动人心的时刻，在这个万众瞩目的地方of backbone backbone role; to full strengthening members youth work, full play youth employees in company development in the of force role; to improve independent Commission against corruption work level, strengthening on enterprise business key link of effectiveness monitored. , And maintain stability.
