Employment AgreementParty A: The legal representative of: Party B: During Party A employs Party B as (post),Part B has outstanding performance, well achievements. Whereas Party B excellent business capability and management ability, Party A decided to engage Party B as (post) of (company name). On the basis of equality and willingness both parties sign this agreement.Article I Position of EmploymentParty B accepted Party As employment, act as (post) of (company name), fully in charge of the company business.Article II Term of EmploymentThe period of this contract is years, from , 20xx to , 20xx. Article III Labor RemunerationParty Bs income combines by two-parts salaries and bonuses. The annual salary is RMB, monthly salary payment is RMB, remaining annual salary will be paid at the end of year in one-time. The annual salary can be adjusted along with the companys benefit and individual performance. Above salary and bonus are after tax, relevant tax and fees are withholding by Party A.Article IV Welfare and Social Insurance1. According to the national policy and local government policy, Party A structures the basic social insurance for Party B.2. Party B will enjoy welfares specified treatment by the countrys employees public holiday, marriage leave, maternity leave, bereavement leave, family leave, vacation, will all be implemented according to national policy and Party As relevant rules.Article V Responsibilities, Rights and obligations of Party A1.Party A explicitly stipulates the scope and responsibility of operating management for Party B, and provide convenience to Party B ensure the management process to succeed.2. If Party B showed illegal operation, Party A has right to terminate the agreement in advance; if Party B causes serious consequences to Party A, Party A has right to pursue Party Bs responsibility and legal liability.3. According to the relevant national regulations and this agreement terms, Party A shall pay Party B compensation on time.Article VI Responsibilities, Rights and obligations of Party B1. Party B shall strictly abide the relevant rules and regulations of the company, managing the companys business activities, Party B shall not have any violation of national laws and regulations and damage the interests of the company.2. Party B has the right to get paid in full and on time.3. Party B has the right to enjoy welfare and social insurance in accordance with the law regulation of nation.4. Party B shall have the obligation to perform responsibilities of the position, to complete the specified working tasks set by the company. Article VII Relief and Continuing of the Employment Contract1.Either party from both parties when required to change the contract, shall make a written application and send to other party and who shall return by written reply after receiving within 15 days, then can change the contract by mutual agreement; if failed to reach a consensus, both parties shall continue to be executed this contract2.During the contracting period, Party B was unable to perform the responsibilities as specified by this agreement, failed inspection or have illegal and undisciplined activities, Party A shall have the right to dismiss, terminate this contract.3.After this contract expired as the term stated, whether renewal or relief, shall negotiate additionally by both parties, can be renewed the continuing contract by mutual consent.Article VIII Others1.If this agreement has uncompleted matters herein, shall negotiate between two parties, to issue the supplementary specification.
