第五章“我国票据无因性的法律规制与评析”。本章通过归纳并评析我国 票据法巾有关票据无冈性的规定，指出我国票据法关于票据无因性的立法态 度是模棱两可的，对票据无冈性的规定是既肯定又否定，自相矛盾。这将极 大地影响人们理解，适用票据法，也对涉及票据无因性的司法实践带来诸多 不利，最终影响票据的自由流通，阻碍我国社会经济的发展。 第六章“完善我国票据无因性法律规制之设想”。本章在前一章评析我国 当前票据洪对票据无因性规定之不足的基础上，进一步指出当前的任务是不 仅要存我同票据法中对票据无因性加以肯定性规定，撤销那些模棱两可的条 文，更露存票据泱中对票据无因性的例外情形加以明确规定，以正确合理地 适用票据币冈件原则，避免其不当适用而给票据当事人利益带来不必要的损 害，更好地维护票据双方当事人的权益，最大限度地发挥票据的流通功能， 然而存我国，不仅在票据无因性的理论研究方面还存有争议，而且在票 据无冈性制度规范方面也不甚明晰。造成这一现象的主要原因：一是对票据 无因性的理论研究不够，导致认识存有差异，而这种认识的差异使我国票据 无因件制席的建构缺乏扎实的理论基础；二是我国尚处于经济转型期，很多 制度展而的改革还不够彻底，仍趋于保守，造成了我国票据法对票据无因性 的规定模棱两可、自相矛盾。票据无因性制度的不完善给票据的自由流通带 来极尺障碍，限制了票据充分发挥其各项功能，从一定程度上阻碍了我国经 济的篾展。 i f 是存我困目前这种情况下，对于票据无因性制度的研究就显得尤为必 要。方而，通过对票据无因性理论的研究，重构票据无因性制度的理论基 础，以使理论界对票据无冈性形成统一的共识，为票据无因性制度建构提供
