Employee:Name:Gender:maleAddress:Nationality:P.R.China?IDCardNo.:ThisContractissignedonamutualityvoluntarybasisbyandbetweenthefollowingEmployerandEmployeeinaordancewiththeLabourLawofPeoplesRepublicofChina.1.TermoftheContract:Thetermofthiscontractisforoneyearandshallmenceon_,_,andshallcontinueuntil_,_,unlessearlierterminatedpursuanttothisContract.TheEmployeeshallundergoaprobationaryperiodofthreemonths.2.JobDescription:TheEmployeragreestoemployMr./Ms._(name)as_(jobtitle)in_Department,locatedin_(officelocationandcity).3.RemunerationofLaboura.ThesalaryoftheEmployeeshallbemonthlypaidbytheEmployerinaordancewithapplicablelawsandregulationsofP.R.C.ItshallbepaidbylegaltenderandnotlessthanthestandardminimumsalaryinTianjin.b.ThesalaryoftheEmployeeisRMB$_permonthintheprobationaryperiodandRMB$_aftertheprobationaryperiod.c.Ifthedelayordefaultofsalarytakesplace,theEmployershallpaytheeconomicpensationexceptthesalaryitselfinaordancewiththerelevantlawsandregulations.4.WorkingHours&Rest&Vocationa.ThenormalworkinghoursoftheEmployeeshallbeeighthourseachday,excludingmealsandrestforanaverageoffivedaysperweek,foranaverageoffortyhoursperweek.b.TheEmployeeisentitledtoalllegalholidaysandotherpaidleavesofabsenceinaordancewiththelawsandregulationsofthePRCandthepanysworkrules.c.TheEmployermayextendworkinghoursduetotherequirementsofitsproductionorbusinessafterconsultationwiththetradeunionandtheEmployee,buttheextendedworkinghourforadayshallgenerallynotexceedonehour;Ifsuchextensioniscalledforduetospecialreasons,theextendedhoursshallnotexceedthreehoursaday.However,thetotalextensioninamonthshallnotexceedthirty-sixhours.5.SocialSecurity&Welfarea.TheEmployerwillpayforallmandatorysocialsecurityprogramssuchpensioninsurance,unemploymentinsurance,medicalinsuranceoftheEmployeeaordingtotherelevantgovernmentandcityregulations.b.DuringtheperiodoftheContract,theEmployeeswelfareshallbeimplementedaordancewiththelaws?andrelevantregulationsofP.R.C.6.WorkingProtection&WorkingConditionsa.TheEmployershouldprovidetheEmployeewithoupationalsafetyandhealthconditionsconformingtotheprovisionsoftheStateandnecessaryarticlesoflaborprotectiontoguaranteethesafetyandhealthduringtheworkingprocess.b.TheEmployershouldprovidetheEmployeewithsafetyeducationandtechniquetraining;TheEmployeetobeengagedinspecializedoperationsshouldreceivespecializedtrainingandacquirequalificationsforsuchspecialoperations.c.TheEmployeeshouldstrictlyabidebytherulesofsafeoperationintheprocessoftheirwork.7.LabourDisciplinea.TheEmployermaydraftbylawsandlabourdisciplinesoftheCompany,Aordingtowhich,theEmployershallhavetherighttogiverewardsortakedisciplinaryactionstotheEmployee;b.TheEmployeeshallplywiththemanagementdirectionsoftheEmployerandobeythebylawsandlabourdisciplinesoftheEmployer.c.TheEmployeeshallundertaketheobligationtokeepandnottodisclosethetradesecretfortheEmployerduringtheperiodofthisContract;ThisobligationofconfidentialityshallsurvivetheterminationofthisContractforaperiodoftwo(2)years.8.Termination,Modification,RenewandDischargeoftheContracta.TherelevantclausesoftheContractmaybemodifiedbytheparties:i.Thespecificclauseisrequiredtobemodifiedbythepartiesthroughconsultation;ii.Duetotheforcemajeure,theContractcannotbeexecuted;iii.TherelevantlawsandregulationshavebeenmodifiedorabolishedbythetimeofsigningtheContract.b.TheContractmaybeautomaticallyterminated:i)ThisContractisnotrenewedattheexpirationofthisContract;ii)TheEmployerislegallyannouncedtobebankruptcy,dismissed,orcanceled;iii)ThedeathoftheEmployeeours;iv)Theforcemajeuretakesplace;v)TheconditionsofterminationagreedintheContractbythepartiesarise.c.TheContractmayberenewedattheexpirationthroughconsultationbythepartieswiththefulfillmentoftheprocedurewithin15daystotheexpiration;d.TheContractmaybedischargedthroughconsultationbytheparties;e.TheContractmaybedischargedbytheEmployerwithimmediateeffectandtheEmployeewillnotbepensated:i.TheEmployeedoesnotmeetthejobrequirementsduringtheprobationaryperiod;ii.TheEmployeeseriouslyviolatesdisciplinesorbylawsoftheEmployer;iii.TheEmployeeseriouslyneglectshisduty,engagesinmalpracticeforselfishendsandbringssignificantlosstotheEmployer;iv.TheEmployeeisbeingpunishedbyphysicallabourforitsmisfeasancev.TheEmployeeisbeingchargedwithcriminaloffences:f.TheContractmaybeterminatedbytheEmployerbygivingnoticeinwrittenform30(thirty)daysinadvance:i.TheEmployeefailsillorisinjuredto(otherthanduetowork)andafterpletionofmedicaltreatment,isnotabletoperformhispreviousfunctionoranyotherfunctiontheEmployerassignstohim;ii.TheEmployeedoesnotshowsatisfactoryperformanceandaftertrainingandadjustingmeasuresisstillnotabletoperformsatisfactorily;iii.ThecircumstanceshavemateriallychangedfromthedatethisContractwassignedtotheextentthatitisimpossibletoexecutetheContractprovided,however,thatthepartiescannotreachanagreementtoamendthecontracttoreflectthechangedcircumstances.iv.TheEmployerisbeingconsolidatedinthelegalconsolidationperiodonthebrinkofbankruptcyorthesituationofbusinessisseriouslyintrouble,undersuchcondition,itisrequiredtoreducetheemplouee.(inlegalprocedure)g.TheEmployeeshallnotbedismissed:i.TheContracthasneitherexpirednorconformedto8.d,8.e,8.f,8.g;ii.TheEmployeeisillwithoupationaldiseaseorinjuredduetoworkandhasbeenauthenticatedfullyorpartlydisabledbytheLabourAuthenticationCommissioninBaodiCounty,Tianjin.iii.TheEmployeeisillorinjured(otherthanduetowork)andiswithintheperiodofmedicalleaveprovidedforbyapplicablePRClawandregulationsandCompanypolicy;iv.TheEmployeeiswomanwhoispregnant,onmaternityleave,ornursingababyunderoneyearofage;oriii.TheapplicablePRClawsandregulationsotherwiseprohibittheterminationofthisContract.h.TheContractmaybedichargedbytheEmployeebygivingnoticeinwrittenform30(thirty)daysinadvance.However,theEmployeemayinformtheEmployertodischargetheContractatrandomunderthefollowingoasions:i.TheEmployeeisstillintheprobationaryperiod;ii.TheEmployerforcetheEmployeetoworkbyviolence,duressorillegalrestrictiontophysicalfreedom;iii.TheEmployerdoesnotpaytheremunerationoftheEmployeeaordancewiththerelevantclauseintheContract;iv.TheEmployerviolatestherelevantregulationsofStateorTianjinforitsterriblesafeandhealthcondition,whichisharmfultotheEmployeeshealth.I.TheContractcannotbeterminatedbytheEmployeebeforetheexpirationifnotconformingto8.d,8.h,j.TheEmployershallpaytheeconomicpensationtotheEmployeriftheContractisterminatedconformingto8.d,8.f,8.h.i-8.h.iv.AdditionalfeeformedicalallowanceshouldbepaidtotheEmployeeiftheContractisterminatedconformingto8.f.i.9.BreachLiabilitiesa.Duetoeitherpartysfault,ifbreachingtheContract,thatpartyshallundertakethebreachliabilityaordingtotheextenttotheperformanceoftheContract;ifthepartiesbothbreachtheContract,theyshallundertakeitsseparateliabilityaordingtotheconcretesituation.b.Duetoeitherpartysfault,ifbreachingtheContracttodamagetheotherparty.ThedamageshouldbepensatedbythefaultypartyaordancewiththerelevantlawsandregulationsofPRC.c.Duetotheforcemajeure,causingthenon-performanceorthedamagestoeitherparty,theotherpartymaynotundertakethebreachliability;c.TheEmployeewantstoresignandhasreceivedtrainingprovidedbytheEmployer,theEmployeeshallpensateforthetrainingcost.Themethodofpensationshouldbefixedaordingtotherelevantpanyregulationsasfollows:TheEmployeeshallpensateRMB_within_year(s)intheCompanyiftheContractisterminatedbytheEmployeeathiscause;TheEmployeeshallpensateRMB_within_year(s)intheCompanyiftheContractisterminatedbytheEmployeeathiscause;TheEmployeeshallpensateRMB_within_year(s)intheCompanyiftheContractisterminatedbytheEmployeeathiscause;10.LaborDisputesWherealabordisputebetweenthepartiestakesplaceduringtheperformanceofthisContract,thepartiescon
