残疾人论文:残疾人劳动就业权的行政法保护【中文摘要】我国有各类残疾人8300多万,占总人口的6.34%,涉及2.6亿家庭人口。建国以来,保护残疾人等弱势群体的思想一直受到党和国家的关注,我国残疾人的事业取得了全面的进步。我国在残疾人权利保护方面经历了从政策向法制转变的过程,并逐步构建起了残疾人权利的法律保护体系,其中包含了残疾人享有的一项重要权利劳动就业权。在残疾人等弱势群体权利保障领域,行政法主张控制权力、限制权力,政府由包揽一切的“全能政府”转化为有所为有所不为的“有限政府”。随着政府权力的退却,社会组织的自治权逐渐填补了政府退却后留下的真空,的弱势群体权利保障事务交由社会组织来承担。然而,社会组织的介入并不能抵消政府保障弱势群体权利的职责。在该领域,并非完全依赖国家及政府行政力量,但也并非因社会力量的介入而使政府怠于行政。保护残疾人群体,既是现代国家文明化的一个标志,也是现代政府必须承担的公共责任。因此,对政府公权力的研究在弱势群体保障领域更有特殊的意义。基于此,保护残疾人的劳动就业权成为行政法的重要任务。虽然我国在立法和政策上已经认识到保障残疾人劳动就业权的重要性,但是,现实中残疾人劳动就业权的实现却远不如法律刻画的这般美好,仍存在着一些法律问题和现实困境。本文正是在这样的背景下,立足我国现行立法,借鉴国外有益经验,选取江苏省苏州市为例进行实际调查,以实证的方法归纳、分析我国目前的残疾人劳动就业权利的行政法保护。在此基础上,以“应然”的法律理念为起点,探讨残疾人劳动就业权行政立法制度的完善、行政执法措施的健全以及司法救济保护的强化。【英文摘要】China has all kinds of the handicapped person more than 8300 million, accounting for 6.34% of the population, involving 260 million household. Since the founding of the protection of the handicapped person and other disadvantaged groups and the state ideology has been the concern of the party, the cause of the disabled in China has made overall progress. Protection of the rights of the handicapped person experienced a shift from policy to legal process, and gradually built up a system of legal protection of the rights of the handicapped person, which contains an important right for persons with disabilities - employment rights.People with disabilities and other vulnerable groups in the field of protection of the rights, claims control of the power of administrative law limit the power of the government taking everything from the “government power” into some things “limited government.” With the retreat of government power, the autonomy of social organizations, gradually filled the vacuum left by the government to retreat, more protection of the rights of vulnerable groups by community organizations to take services. However, the involvement of social organizations, and can not offset the Government to protect the rights of vulnerable groups responsibility. In this area, is not entirely dependent on the state and the executive power, but it is not leaving because of the involvement of social forces, the government delayed in administration. Protection of disabled groups, both the modern state a sign of civilization, but also modern government must take public responsibility. Therefore, the public authority of the government in the field of protection of vulnerable groups more special significance. Based on this, protect the employment rights of persons with disabilities to become an important task of administrative law. Although our country has been recognized on the legislation and policies to protect the importance of the right employment of disabled persons, but, in reality, the realization of the right to employment of disabled persons Queyuanburu portrait of this good law, there are still some legal issues and practical difficulties .In this context, this article is based on our current legislation, drawing on useful experience of foreign countries, select the Case of Suzhou City, Jiangsu Province, the actual investigation, the empirical method of induction, analysis of the existing employment rights of persons with disabilities Administrative Law.
