as“Labor Lawof thePeoples Republicof China”,on thebasis ofequality,voluntariness andunanimity,both partiesagree toenter into the labor contract,and ply with allthe terms of the contract together.1.Type andterm of the contract (1)With afixed term:from1/3/xxto28/2/xx2.Work ContentArticle2.Aording to the workdemands of Party A,Party Bagree tobe engaged in Managerof advertising department(type ofwork).And canchange workingstation(type ofwork)through the negotiation between Party A and B.Article3.Party Bshall finishthe prescribedamount ofwork,and meet the prescribedstandard ofquality inaordance withthe requirementsof Party A.3.Working Hours,Rest andVacations Article4.The workinghours of Party Barranged by Party Adont exceedeight perday,and dont exceedforty perweek.If itis necessaryfor the working,Party Acan prolongthe workinghours afternegotiation withthe WorkersUnion and Party B,the overtimeworking shall not exceedthree houra day,and thirtysix hoursa month.Article5.When prolongingthe workinghours,Party A shall arrangepensatory timeoff for Party Bor pay Party Bovertime wagesaording to the law.Article6.Party Bhas rightsto takeall statespecified restsand vacationsduring the term of this contract,and Party A shallensure thatParty Bcan getat leastone dayoff perweek.4.Labor Protectionand LaborConditions Article7.Party Ashall strictlyimplement national and locallabor protectionlaws,regulations andrules,provide Party B withnecessary working conditions andLabor tools,formulate operationrules,work specifications,and systemand criteriaof labor safety and hygiene Article8.If Party B isengagedin the operationscontacting theharm ofoupational diseases,Party Ashall organizeParty Bto undertakpre-employment andpost-employment oupational physical examinationsaording to relevant state provisions,and provideoupationalphysicalexaminations for Party Btermly in the termof the contract.Article9.Party Ahas theobligation tobe responsiblefor Party Bs educationand trainingof politicalthoughts,professional ethics,business technology,laborsafety andhygiene,and relevantrules and regulations.Article10.Party Bhas theright torefuse theillegal mandsof Party A,and alsohas theright tomake criticismson theillegal businessactivities of Party A and itsmanagers,and impeachand auseto relevantdepartments.5.Labor RewardArticle11.Party Bs wagestandard duringprobation is6500Yuan/month(after-tax).Article12.Party Aconfirms thatParty Bwill executethe followingwage formaording to the units wagesystem: (1)The maintask of Party B is leadingthe advertisingdepartment tocreat advertisingperformance forthe pany,and3%of thetotal turnoverof theadvertisingdepartmentis thebusiness missionof Party B,and the ine tax is deducted by Party A on Party Bs behalf;20%of Party Bs personalperformance shall belong to Party Bas abusiness mission(theiaxisdeductedby Party AonParty Bs behalf),and thesetwo missionsdont conflictwith eachother.Article13.Party Ashall PayParty Bwage monthlyin legalcurrency,and thepayday is15th dayof everymonth,and the wage shall not bededucted or delayed withoutjustification.Party Bs wagepaid by Party Ashallnotviolate relevantstateprovisionsrelating tominimum wage.Article14.If Party Bs workingtime isextended,the wagesshould not be lower than150%of normalwages paid,and ifParty B is arrangedto workon daysof restand nopensatory timeoff can be taken,the wagesshould not be lowerthan200%of normalwages paid;and ifParty Bis arrangedto workon legalholidays,the wagesshould notbe lowerthan300%of normalwages paid;Article15.When Party A isshut down,off productionor outof business,which is not becauseofParty B,for less than onemonth,Party A should pay Party Bwage atthe wagestandard agreedin the contract;for morethan onemonth,and Party A failsto arrangejobs forParty B,Party Ashall pay Party Bliving expenseswhich isnot lowerthan the local unemployment insurance standard.Article16.If Party A arrangesParty Bto workfrom22at nightuntil6inthenext morning,the nightshift subsidyfor everybusiness dayis500_Yuan.Article17.Party B,aording tolaws,shall enjoyannual leave,home leave,funeral leave,etc.Party Ashall pay Party Bwage aording to the standards specified by relevantnational and local laws,or agreedinthe labor contract.6.Social insuranceand welfaretreatments Article18.Party Ashall paybasic pensions,basic medical,industrial injury,and maternity insurances,and individualpay partof thesocial insuranceshall bewithheld fromParty Bs wagesand paidfor herby Party A.When Party A and B remove,terminate the contract,Party Ashall dealwith socialinsurance formalitiesforParty B inaordance withthe relevant provisions.Article19.Party Bs medical treatments ofillness orinjuries notrelated tohis/her workshall referto the provisions of nationaland local relevant policies.Article20.The inductrial injury treatmentofParty B refersto nationaland localrelevantpolicies.Article21.The benefitsofParty B during the period of pregnancy,production andlactation referto nationalandlocalrelevant birthinsurance policies.Article22.Party Ashall provideparty Bfollowing welfaretreatments:1.Medical insurance,unemploymentinsurance,endowment insurance,maternityinsurance,inductrialinjuryinsurance7.The labor discipline andrules Article23.The rulesand regulationslegally stipulated byParty Ashould be publishedto Party B.Article24.Party Bshall strictlyadhered to the rulesand regulationsstipulatedbyParty A,fulfill thework tasks,improve professionalskills,execute laborsafetyandhygiene regulations,observe labordiscipline andplywithprofessional ethics.Article25.If Party B violateslabor disciplines,corresponding administrativesanctions,administrative handlings,economic punishmentsshould begiven byParty Aaording to the rulesand regulations of theunit,until the contract is terminated.8.The conclusion,modification,rescission,termination orrenewal of the labor contract Article26.The circumstancesbased onwhich the contract issigned arechanged somuch sothat the contract cantbecarried out,the both parties canchange modifythe relevantcontent of the contractthenegotiationbetweenParty A and B.Article27.The Agreementcanbeterminated ifboth Party A andParty Bagree.Article28.If anyone of the followingcondition isfound,Party Ahas theright tovoid the contract.1.Being provedto havefailed tomeettheemployment conditionsduring theprobation;2.A seriousbreach of labordisciplineor internalregulationsof the buyer;3.Serious misconductor corrupt,have causedgreat loss to Party A;4.Being subjectto criminalliabilities orbeing reeducatedthrough labor.Article29.In anyof the following circumstances,Party Amay terminate the contract,but shall inform Party B in written form30days inadvance:1.When Party Bissick or suffers an injury notrelated tohis/her workand cannotperform theoriginal workor other work arrangedbyParty A afterthe pletionof medicaltreatment;2.Party Bis inpetentand remainsinpetent aftertraining oradjustment ofhis position.3.Both partiescannot reachan agreementupon modifyingthe contract aording tothe provisionof article25ofthis contract.Article30.Party Ais closeto bankruptcyand entersinto legalrectification periodor itis ina severe difficulty(meets thestandard ofseveredifficultenterprise stipulatedby thelocal government),shall explainthe situationtothetrade unionor allof itsstaff,solicit opinionsfrom themand reporttotheadministrative departmentoflaborand securitybefore itterminatethecontract.Article31.If anyproblems arefound inthe followingcircumstances,Party Ashallnotterminate,remove thecontractaording to articles28,29: 1、Getting oupationaldisease orindustrial injurywhich reachesthe levelspecified by the stateat whichthe labor contract shallnotbeterminated andremoved; 2、Being sick orsuffersaninjury,within thefixed medicaltreatment period; 3、The femaleworker isduringtheperiodofpregnancy,production andlactation; 4、Demobilized conscriptsand farmer-turned workerdue toland requisitionhaving workedfor lessthan3years;within the prescribed periodof pulsorymilitary service 6、Be performingrepresentatives dutyas collectivenegotiator; 7、Complying withother conditionsspecifiedbylaws andregulations.Article32.If anyproblems arefound inthe followingcircumstances,Party Bmay informParty Ato terminatethecontractat anytime,andParty Ashall pay Party B thecorresponding remunerationand socialinsurance aording tothelaw:1.During theprobation period;2.PartyAhas coercedParty Binto workingby meansof violence,threats orillegal restrictionof personalfreedom3.PartyAcannot paythe salaryor provideworkingconditionsaording tothecontract.Article33.Party Bshall give30days priorwritten noticeto PartyA whenterminating thecontract.Article34.This Contractshall beterminated on the expirationdate.Both partiescan renew thecontractthrough negotiation.Article35.Both partiesstill arein labor relationship afterthe expirationof thecontracted period,PartyAandBshall retroactivelysign orrenewthe labor contracttimely.If both parties failto reachagree uponthe termof the labor contractthrough negotiation,thetermof the labor contractshallbeno lessthan_month asof thedate ofsignature.If Party B matchesthe conditionof renewingo non-fixed termlabor contract,PartyAshall signa non-fixed termlabor contract with Party B.Article36.The non-fixed termlabor contractsigned byPartyAandBwill beterminated underlegal terminationconditions orthe followingconditions agreedbyPartyAandB.9.Economic pensationand indemnityArticle37.If PartyA violatesthelaborcontract,shall pay Party B economic pensationaording tothe followingstandards:1.If toembezzle wagesordelayin payingwages toParty Bwithout reason,and refuseto payParty Bthe wagesfor extrawork,except payingParty Bwages infull withintheprescribedtime,PartyAshall alsopayPartyBeconomic pensations equivalent to25%of the wages. 2、If thewages paidtoPartyBis lowerthan thelocalminimum wagestandard,PartyAshall makeup thegap,besides,additionally payPartyBeconomic pensationequivalent to25%of thegap.Article38.If PartyA terminates thelaborcontract with PartyB,except inthe circumstanceprescribed inarticle27of thecontract,shall payPartyBeconomic pensationaording tothestandardsofnationalandlocalrelevantprovisions.Article39.After terminating thecontractwithout payingPartyBeconomic pensationaording totheprovision,except payingthe economic pensation infull,PartyAshall alsopayPartyB additionaleconomiompensationwhich is50%of theeconomiompensationpayable.Article40.The contractisterminatedforPartyB beingsickorsuffering aninjury notrelated tohis/herwork,and beconfirmed bytheworkcapability assessmentmittee tobe unableto takeontheold jobor otherpositions PartyA assigns,PartyA,except executingaordingtothe Article38,shall alsopayPartyB medicalsubsidy notlessthansix monthswages(the monthlywage shouldbe theaverage monthlywage ofthe twelvemonths beforeterminatingthecontract innormal productioncondition,if theaverage monthlywage ofPartyBislowerthantheaverage monthlywage ofthe enterprise,then shouldbe theaverage monthlywage ofthe enterprise).Article41.If PartyA intentionallydelays inrenewing thelaborcontractwithPartyB,or signsinvalid laborcontractwithPartyB,or impairsthe legalright ofPartyBby violatingprovisions orthecontract,or terminatesthecontract,and causedamage toPartyB,shall pensatefor anyloss ofPartyBaordingtothefollowingprovisions:1.If causethewageloss andine lossofPartyB,shallpayPartyBthewage payable,and shalladditionally payPartyBthe pensationof25%ofthewagepayable. 2、If causethelaborprotection lossesofPartyB,shall plementthelaborprotection subsidiesand suppliesaordingtonational provisions.3.If causePartyBs lossesof industrialinjury andmedical treatments,except providingPartyBwith industrialinjury andmedicaltreatments,shall alsopayPartyB pensationsequivalent to25%of medicalexpense.4.If healthdamage iscaused toPartyBwho isa femaleworker orunderage worker,except providingthe medicaltreatment duringtreatments specifiedbythestate,PartyAshall alsopayPartyB pensationsequivalentto25%ofPartyBs medicalexpense payable;Article42.PartyBterminatesthelaborcontractin violationofthe provisions ortermsofthis contract,and causelosstoPartyA,shall pensatePartyAfor followinglosses:1.The trainingexpense andrecruitment expensepaid byPartyA;2.The directeconomic lossesat productions,managements andworks.3.Other reimbursementresponsibility asstipulated inthecontract.10.Responsibilities forviolating thelaborcontract.Article43.When oneparty breachesthis contract,shall bearthe responsibility,and payliquidated
