所以我大概也就花五分钟 十分钟的时间跟大家稍微说一下 从企业角度考虑 劳动合同法 第三稿 这个话题 不是今天讨论 讨论了若干次了 大家记得去年的时候 对于劳务派遣 我们 HRA 专门 做过调研 包括对国外的情况进行了解 分享 另外半个小时的时间大家看看我们互动 一下 看看有什么问题 其实都是探讨的问题 我觉得刚才宁老师讲得非常非常全面 而且是最主要的内容 我稍微讲一点 包括我个人的一些想法 对我们国家制订 劳动合同法 的基本的认识 跟大家分享一下两年前 也就是 2005 年的时候 2005 年的时候 那时候 劳动法 正好是十年 我们快速消费品曾经 有一个 HRCLLB 我们一个季度有一个会议 当时我们进行过一些研讨 当时好象 劳动 合同法 好象刚开始 那时候在讨论有一些非常内部的文件 拿到那些内部文件也不容 易 看了一下 当时我个人也做了一些研究 我当时跟我们所有的 HR 经理大概 50 人做 了一个简单的调研了 我说大家认为 劳动法 十年了 大家认为十年过程我们认为这 个 劳动法 主要是保护员工利益还是保护用人单位的利益 大概 50 人里面 49 人举手 说是保护员工的利益 有一个人没举手 我后来问他一下 你没举手是什么意思 他说 我没想好 大家会看出来 我们都认为 劳动法 是更倾向于保护劳动者的权益 我本 人的意见可能不太一样 所以我们对现在这个制订 劳动合同法 应该有一个换位的思 考 如果你站在中国的立法者的角度 劳动部门的角度考虑它 到底它是更多地想保护 劳动者还有用人单位的利益 最起码我不认为我们实行了十年的 劳动法 倾向保护劳 动者的利益 举个例子 所谓固定期限的劳动合同到期 现在的正是没有补偿金的 很容易 我 跟你签两年 两年的时候没有任何原因我不跟你签合同了 我不用给你经济补偿 这个 我们看所有国家的劳动立法 今天我们台湾的同事也坐在这儿 我们看看台湾的立法 恐怕没有这么大灵活性 你看欧洲国家你要裁员 要解除一个国家的劳动合同 像意大 利 法国 德国这些国家比登天还难 大家看看不同的公司 那些人签的合同是什么合 同 有固定期限的劳动合同吗 我只说为什么提出这个问题 为什么制订 劳动合同法 很多时候是从国家宏观角 度去看 但是你看文章 理论探讨 所谓双方的驳议 跟工会 用人单位 我觉得有一 点是引起我们思考的 原来我们从第一稿的时候我们会看到 我们当时仔细研读这个内容的时候可 能公司一般地管理权限都给了工会了 如果工会不同意你什么都做不了 现在看来从语言文字的描述来看 我个人理解 最后的决定权还是公司的管理层 但是要跟工会协商 要争取工会的同意 如果不同意怎么办 对于公司角度来讲 不同 意的话 有的时候可能会有一些冲突和矛盾 但是从第三稿的文字表达来讲 用人单位 还是有权利去制订实行它的规章制度 这是我的理解 但是对用人单位修改 制订新的 规章制度有新的要求 刚才宁老师讲了我不再重复了 关于劳动合同和期限 三种合同的形式 这个我们还是跟原来一样 但是有一点 关于固定期限的劳动合同 这个大家看到比原来更严格了 大家看到现在的舆论 包括 外国的舆论对中国的评价 几乎想限制固定期限的劳动合同 避免劳动合同的所谓的短 期化的景象 这点我想从用人电话 我是来自雀巢中国公司 所以我们也在想 如果要 是真是这么制订的 我个人认为还很有可能这么制订 签两次以后 双方再同意以后就 是签无定期限劳动合同 有的单位签字六个月 再签六个月就是无固定期限合同了 对我们来讲是很大的挑战 我们在思考怎么签订这个合同 第一年短一些 第二年 长一些 怎么样的签订方式 我个人觉得如果从 劳动法 学的理论来讲 我觉得是当 限制固定期限的劳动合同 同时避免劳动合同的这种短期化的行为 我觉得还是很有用 的 尽管我现在是人事经理 我是从用人单位来考虑 但是我仍然认为所谓劳动合同短 期化的行为还是应该受到一定的法规化的限制的 下一个问题关于试用期被证明不符合录用条件 这个跟 劳动法 的表述不同 尽 管文字表述都在那儿 但是完全不一样 他说除非你有证据证明他不符合条件 我从事 人力资源大概有 20 年 我们遇到了很多所谓的这种劳动争议 很多时候 其中之一就 是怎么证明他不符合录用条件 你录用的时候有没有 录用的时候我们都知道大家有一 个合同 但是我没有一个录用条件 最后告诉他你就是态度不好 你就是不符合条件 这个极其容易引起争议 很难证明 原来有一个公司就是因为这样的 经过法院 法院 最后派了一个工作组 法院委派的 调查了将近一个半月 证明他是不是符合录用条件 所以给我们从事人力资源的人员提出一个更高的要求 你说我是完全录用条件非常细的 有三页纸写的满满的 写的再满也有可能不在范围之内的
