Rental information 租赁信息The Party A hereby agrees to appoint the real estate agent (as mentioned above) to lease the following property to the Party B under the following terms and conditions: 甲方特此同意委托房地产经纪方(如上所述)在下列条款下向乙方租赁下述房地产:Address of the property: 房屋地址: Size of the property (as per attached floor plan, if available): 以房产证为准房屋面积(如可以,附平面图): 以房产证为准List of equipment, furniture and/or appliances as per attachment#家具或其他设备见附表:Monthly rent每月租金: RMB/month(No taxes including)5.Rental period 租赁时间5.1 The rental period starts on and ends on 5.1 租期为从 年 月 日到 年 月 日。5.2 The Party B agrees to return the property in the same condition, except normal wear and tear, if there is anything destroy by the Party B because he use it in the wrong way, the Party B should pay for the fix payment. To the Party A upon expiry of this agreement. If the Party A decides to continue renting out the property after the original term ends, the Party B shall have the first right to rent it ,providing that the Party B gives a written notice to the Party A at least 30 days prior to the expiry of this agreement. For any subsequent renewals of the lease, a new lease agreement must be signed between both parties.5.2 乙方同意在租赁期满之后,按照原样返还该房屋,但正常磨损除外。如有人为故意或使用不当损坏,应按市价赔偿。本合同终止后,如果甲方决定继续出租该房屋,乙方将享有优先承租权,但需要乙方在租赁期满前提前30天予以书面通知。续约时,双方应签署新的租赁合同。6. Rent 租金6.1 The rent shall be paid in RMB currency.6.1 租金以 人民币 币种支付。6.2 The Party B agrees to apply the payment for house rent and other fees before of each month after received the invoice from the Party A.乙方同意在每个月 之前在收到甲方提供的发票后申请支付房租和其他费用。6.3 The Party B shall pay the Party A a security deposit of (see 7) upon signing this agreement.6.3在签署本合同时,乙方应向甲方缴纳金额 作为租赁押金。6.4 The Party A shall give receipts for all amounts paid to the Party B.6.4 甲方在收悉款项之后应向乙方出具收据。6.5 If during the rental period the Party B fails to pay the rent on time the Party A shall give the Party B a written notice as a reminder to pay the rent immediately. If the Party B fails to pay the rent within ten days after receiving the written notification or the Party B is more than one month behind in paying management fees and/or utility bills the Party A has the right to immediately end this agreement. In such case the Party B is responsible for all legal consequences and will pay for all costs, including legal costs.6.5 租赁期间,如果乙方不能及时地给付租金,甲方有权采取书面形式通知乙方。如果在收到该书面通知10日内依然不能给付,或者拖欠管理费等费用达1个月,甲方有权立即终止合同。在这种情况下,乙方应该对此负全部责任,并且应赔付包括租金、管理费和其他费用、法律费用在内的所有费用。7.Security deposits and fees 押金和费用7.1 Upon expiry of this agreement, if not renewed, the Party A shall return the deposit(s), as mentioned under 6.3, in full and without interest provided that there is no damage to the property and/or no unpaid rent.7.1如果没有续约,在本合同期满时,甲方应退还6.3条所述的全部押金(不计利息),但是乙方应保证没有对房屋造成损坏并且付清全部费用。7.2 If the Party B breaches one or all of the clauses in this agreement and as a result of this the Party A is not able to collect the rent from the Party B or the property or any other items mentioned in this agreement are damaged beyond normal wear and tear, the Party A has the right to deduct any such costs from the deposits as mentioned under 6.3, providing the deduction reflects the actual costs. Should the deposits not be enough to cover these costs, the Party B hereby agrees to pay the Party A the difference within ten days of receiving a written demand from the Party A.7.2如果乙方违反合同中的若干条款造成了对合同的违约,导致甲方无法收取租金、费用,或遭受其他损失(房屋正常磨损除外),甲方有权从6.3条所述押金中扣除与其实际损失相同数额的款项。7.3 The Party B agrees to pay for the utilities, including but not limited to: telephone bills, gas, and water, electricity, When presented with the bill by the companies involved.乙方同意支付下述费用,包括但不限于电话费、煤气费、水电费,上述费用将由相关公司直接或间接收取并出具发票。7.4 If the Party B terminates the tenancy agreement within the lease term without any breach of this agreement by the owner, the owner is not obligated to return all the deposit, and the Party B want to give one month notices to the owner, but if the owner want to terminates the agreement within the lease term without any breach of this agreement by the Party B, be want to return all the deposit and pay more two months to the Party B. Also want to give one-month notices to the Party B.如果乙方并非因为甲方违背本租约而终止租约,押金不予退还,并应一个月前书面通知甲方。如果甲方也并非乙方违背本租约而终止租约,甲方应返还租赁押金并赔偿乙方两个月租赁押金,书面提前一个月通知乙方。8. Responsibilities and obligations 义务和责任8.1 If the Party B has caused any damage within the rental period to the property or to any one of the items listed in this agreement, the Party B hereby agrees to either repair the damage or pays for the replacement of the item.8.1 如果乙方在租赁期间造成了对房屋物品和电器或其他设备的损坏,甲方有权要求乙方对其进行修复或支付因修复所花费的费用。8.2 The Party B will not sub-lease the property without written permission from the Party A.8.2未经甲方书面许可,乙方不得将该房屋转租。8.3The Party B will not make any changes or modifications to the property without written permission from the Party A.8.3未经甲方书面许可,乙方不得擅自对房屋进行装修或更改。8.4The Party B will not change the use of the property.8.4乙方不得擅自更改该房屋的用途。8.5The Party B will not store or keep any illegal, explosive or inflammable goods within the property. No illegal activity.8.5乙方不得在该房屋内存储任何非法、或易燃易爆物品,并不得从事非法活动。8.6 The Party B agrees to fully observe and abide by the laws of the Peoples Republic of China and local rules and regulations.8.6乙方同意完全遵守中华人民共和国和当地的法律法规。8.7 If the agreement is ended by a breach of contract by the Party B, the Party B will immediately vacate the property and allow the Party A to enter the property unhindered. If the Party B does not vacate the property or does not allow the Party A to enter the property, the Party A has the right to enter the property with assistance of a representative of the management office or the police, to remove and store all belongings of the Party B and to immediately sell these belongings at an auction. Any money from such auction shall be used to pay for unpaid rent, damage, legal costs, or unpaid bill from the management office or any utility company. Any money left after these payments shall be given to the Party B.8.7 如果因乙方的过错导致合同提前终止,乙方应马上搬离房屋并且允许甲方进入。如果乙方拒绝搬离,甲方有权在物业管理人员或警察的协助下进入该房屋并且将原属于乙方的物品搬离并拍卖。拍卖所得的价款将用于偿付租金、对房屋所造成的损失、法律费用和其他费用,剩余的款项应退还给乙方。8.8正常情况下使用的家电如有任何损坏,甲方有责任尽快对此进行维修,如果在接到租客通知后合理的时间内未能修理,租客将在取得甲方的同意下自行修理并在下个月租金内扣除维修费用。8.8 If any damage is caused to the facilities on the apartment structure due to reasonable use, the Party A has the responsibility to repair the fitment as soon as possible, if not required in reasonable amount time within notice, the Party B will take the owners agreement and repair the damage and the costs will deducted from next month.9.
