1、基层司法所建设调研报告_0 基层司法所建设调研报告 司法所,在基层政法机构体系中是基层政法组织机构之一,它与公安派出所、法庭共同构成我国乡镇(街道)一级的政法体系,成为中国基层司法运行机制中不可缺少的重要组成部分。在基层社会管理综合治理机构体系中,司法所是司法行政系统参与基层综合治理工作的重要成员单位,处在化解人民内部矛盾、预防和减少犯罪的第一线。近年来,xxxx司法所紧紧围绕镇党委、政府的工作大局,认真履行职责,为维护基层社会稳定,促进基层民主法制建设,促进经济发展和社会全面进步作出了积极贡献,已成为社会管理综合治理工作中不可缺少的主要力量。在各级党委和政府的重视和关心下,我所建设得到了前所
2、未有的重视和加强,职能作用得到了进一步发挥。与此同时,如何进一步加强司法所的管理,切实发挥司法所在维护稳定、社会管理中的职能作用,是基层工作中面临的一个重大而现实的课题。为此,如何加强基层司法所建设提出几点思考。 xxxx司法所是江苏省优秀司法所,现有办公面积220平方米并统一设立了办公室、调解室、接待室,配备了电脑、打印机、扫描仪、复印机、办公桌椅、文件柜、档案柜等办公设施,司法所外观标识、门牌、工作人员桌牌胸牌、各项制度公示上墙、各类文书制式规格统一。 近年来,xxxx司法所积极争取各级党委、政府支持和帮助,全面提升司法所建设和管理水平,努力在加强管理、发挥职能上寻求突破,主要采取了如下办
3、法。 (一)理顺管理体制,加强日常监管力度。 xxxx司法所是南京市司法局在乡镇的派出机构,实行南京市司法局和xxxx镇人民政府双重管理,以司法局为主的管理体制。由于xxxx司法所远离市局,具体的日常管理由区司法局负责,再加上因建所时间相对较晚,职能发挥不充分,镇干部群众对xxxx司法所的认知度不高,司法所职能弱、位不高、权不重、经费缺,不能为镇提供强制力等原因,xxxx镇党委、政府对xxxx司法所管得少、支持力度不大,造成xxxx司法所人员“懒、软、散”现象比较突出,我们专门制定了镇xxxx司法所考勤制度。为了充分发挥司法所的职能,xxxx司法所积极争取当地党委、政府领导的支持,并主动参与到
4、xxxx镇党委、政府中心工作中。 (二)加强队伍建设,夯实基层基础。 按照省级优秀司法所的要求,司法所应具备5名人员,其中配备1名司法助理员,而现在xxxx司法所只有行政编制1人(兼任综治办主任),x年配备了一名专职社工,x年聘用一名专职调解员,当人员任达不到要求、力量薄弱,与当前社会发展新形势和“大调解”机制的构建不适应。为解决暂时编制不足的问题,强化司法所队伍建设,充分发挥司法所服务基层、维护社会和谐稳定的职能,加强队伍建设成为基层司法所的首要问题。 (三)强化经费保障,确保工作运行。 基层司法所在编工作人员的工资由xxxx区财政支付外,xxxx司法所的日常办公经费基本上靠xxxx镇财政解
5、决,这种局面使xxxx司法所“直不起腰”,因工作经费有求于人,造成实际从事的事务必然被镇其他部门牵制,不得不承担很多与司法行政工作无关的事务,xxxx所的工作在政府的安排下,本末倒置,司法行政本职工作倒成了“副业”。为扭转这种不利局面,必须解决好“有钱办事”的困难,确保司法所工作的正常运转。 (四)加大督查力度,严格目标考核。 为主动适应司法行政工作面临的新形势,以工作目标考评标准为牵引,加强对司法所业务工作的指导能力,加大督查力度,促进司法所各项工作扎实有序推进,在原有的检查考核标准的基础上,进一步细化和量化工作目标和考核标准,对司法所承担的人民调解、社区矫正、帮教安置、法制宣传、依法治理、
6、法律服务、档案管理等工作分别进行量化考核,根据半年和年终考核检查情况,对司法所业务工作进行表彰奖励或通报批评。以活跃业务开展发挥基层司法行政职能作用,强力提升司法所业务工作质量。 通过近些年的努力,xxxx所建设虽然取得了一些成绩,管理方法和措施得到了加强,但从司法所实际运行的效果和发挥的作用来看,整体情况较好,但仍然存在一些问题有待解决: (一)缺编缺员的情况有所缓解,但一岗多责的问题依然存在。 司法助理员属政法专项编制,按照司法部“司法所应当由3名以上人员组成”的要求,人员缺编缺员的问题相当突出,目前虽然选聘了1名专职司法助理员作为补充,但也只是权宜之计,并不能从根本解决问题。由于司法行政
7、职能不强、体制不顺、待遇不高等因素,加上同公、检、法等其他政法部门相比,在政治待遇的落实上,工作经费的保障上具有明显的反差,大大挫伤了司法助理员的工作积极性,司法助理员队伍中一岗多责的的问题依然存在,一旦有机会,就想离开司法助理员岗位,这使基层司法行政工作面临着很大的潜在人才危机。如果不从根本上去解决,基层司法行政队伍缺编缺员的问题将长期存在,从而就会制约和影响基层司法行政工作的顺利开展。 (二)缺钱缺物的情况暂有缓解,但经费保障的问题依然尖锐。 在领导重视和上级部门的大力支持下,司法所建设逐渐摆脱了“一张桌子两条腿”的尴尬局面,司法所行政运行经费始终得不到全额的保障,人民调解工作也实行了“个
8、案补贴”,但司法所开展工作必要经费却难以落实,司法所的各项经费保障与新形势发展要求存在一定差距,制约了司法所的整体发展。随着社区矫正、大调解、法制宣传等工作职能的强化,工作经费缺口将进一步增大。司法行政部门同公、检、法各部门一样,都是人民民主专政的工具,是国家的政法部门。然而同其他政法部门相比,司法局的经费却大打折扣,不可同日而语。由于司法局职能弱,没有什么收费职能,其工作压力之大,可想而知。 (三)缺位缺权的情况已有些缓解,但“弱势群体”的问题依然突出。 司法行政部门在政法系统中位不高,权不重、职能弱,近几年来,在社会转型、经济快速发展的背景下,社会矛盾纠纷日益突出,维稳任务压力倍增,在上级
9、领导的关注下,司法行政部门职能有所彰显,但“弱势群体”的问题依然存在。司法系统几乎没有什么决定权、审批权、强制力,而决定权、审批权、强制力代表着威信,威信则关系到该系统的社会地位。在镇,司法所在干群中的地位还不如国土所、兽医站等具有审批、决定权的部门,加上群众对司法所职能认知度、公信度不高,群众主动上门“找”司法所的时候少,致使工作缺乏一定威信,难以形成威慑力,影响法律的有效实施和工作开展,很大程度影响了司法所职能发挥。 镇司法助理员是基层司法行政队伍中的主要力量,是农村基层政权的中坚,他们有着“熟悉民情,懂得法律,身处基层”的特有优势,是农村通向法治的桥梁,是送法到群众的通道,是农村普法依法
10、治理的载体,是化解民间纠纷的调节器,是建设新农村构建和谐社会的润滑剂。因此加强基层司法所队伍建设,必须要引起各级党政领导的重视,从根本上解决司法职能不强、体制不顺、经费不足等问题。 (一)落实待遇,增强队伍凝聚力。 1、工作经费要进一步保障。确保司法所人员经费、办案经费、装备经费、教育培训经费和必要的基础设施经费等,确保办公经费要比上年有不同程度的增长,并随着经济的发展不断提高,逐步解决基层司法所的法制宣传、人民调解、安置帮教等专项活动开展所需的专项经费。有效解决司法所无钱办案的突出问题。 2、工作环境要进一步改善。进一步创造良好的工作条件,加大对基层司法行政工作的投入,力争司法所要达到规范化
11、司法所的达标要求,保证必要的办公条件和经费,给乡镇司法助理员一个良好的工作环境。力争实现乡镇司法所全部配齐车辆,每个所一辆(台)以上,使其能快速及时处理有关紧急情况和突发事件。 (二)加强综合业务素质教育,提高队伍战斗力。 提高司法行政队伍综合业务素质,是司法行政工作的永恒主题,司法助理员队伍建设不在一朝一夕,而在长抓不懈。要深入持久地开展学习型机关创建活动,全面开展社会主义法制理念教育、素质教育、法律知识教育、业务技能教育和知识更新教育,不断提高队伍的综合业务素质,努力建设一支“政治坚定、业务精通、作风优良、执法公正”的司法助理员队伍。在推进工作开展的进程中,引导司法助理员要认清形势,把握大
