1、论循环经济法律制度的构建 论循环经济法律制度的构建 【中文摘要】 论文首先对循环经济理论、发展循环经济和构建循环经济法律制度的必要性、重要性、可行性进行了详细的论证,指出传统经济是一种由“资源消费污染排放”所构成的物质单向流动的线性经济,经济增长建立在高投入、高消耗、高浪费和高污染的基础上,必将导致自然资源的短缺与枯竭,并酿成灾难性的环境污染后果。循环经济倡导的是一种建立在物质生产和消费过程中不断被循环利用的基础上的新的经济发展模式,经济活动运行模式为“资源产品消费再生资源”,使得整个经济系统以及生产和消费过程基本上不产生或只产生少量的废弃物。循环经济创立了“3r”准则,即在经济活动全过程中必

2、须执行“减量化(reduce)、再利用(reuse)、再循环(recycle)或资源化”准则。发展循环经济是实现可持续发展战略的必由之路。循环经济三个层次物质循环如下:企业内部的物质循环(小循环);企业与企业之间的循环(中循环):社会层次的大循环(大循环)。循环经济法是指有关调整因循环经济活动所形成的社会关系的各种法律法规和法律渊源的总称,是建立在经济发展模式生态化基础上的“源头治理之法”。论文对循环经济法律制度构建的理论基础进行了详细剖析,主要有经济学基础、政治学和社会学基础、法理学基础。国外发达国家在循环经济立法方面已取得的很多经验和成果,值得我们借鉴学习。日本、德国、美国和欧盟等立足于解

3、决经济高速增长与生态环境日益恶化这一矛盾,通过对循环经济立法来保护环境与资源,实现了绿色gdp增长。目前,我国已经制定了循环经济法(草案)和一些与循环经济相关的鼓励清洁生产和资源综合利用的法律法规,如清洁生产促进法,节约能源法和固体废弃物污染环境防治法等。论文对我国的循环经济法(草案)进行了深入的解读。我国循环经济法(草案)属于循环经济法律体系中的基本法,从国家发展战略、规划和决策层次系统地规范了循环经济发展的法律原则,在循环经济基本法指导下,还应制定完善的专项法律法规群,并以循环经济法(草案)为统率,创制完整的循环经济法律制度创新体系,以充实经济法体系。【英文摘要】 in the first
