1、药品专利权论文：药品专利权公共健康权利益平衡TRIPS协议【中文摘要】从SARS到禽流感，无数鲜活的生命逝去，在拷问我国政府突发事件应对能力的同时，也在拷问着我国现行的药品管理制度。在面临类似的危机时，我国法律如何为迅速处理该事件保驾护航是个问题。适度保护药品专利对于维护公共健康至关重要，但是,药品专利权的保护不是没有界限的。专利保护并非我们追求的终极目标，只是促进社会公益的一种手段。药品专利权和健康权有各自的功能和范围,在不同的作用条件下，对人类社会利益增进都各有裨益，但是由于存在不同的利益主体，这两者之间存在着利益冲突。从国际条约的不断发展过程中也可以看出专利权与公共健康权、发达国家与发展

2、中国家、最不发达国家之间的博弈。随着国际经济形势的发展，人们对人权和知识产权的内涵和边界的理解也发生了变化。人们希望通过对药品专利权的限制来达到专利权人利益与全球公共健康权的协调和平衡。但是，由于人们对各自利益的不同期待，使得这种平衡和协调都是暂时的，都是符合当下环境的，是随着时代的变化而不断发生变化的。在分析了国内的药品专利权侵权案例的类型以及国内法和判例对药品专利权保护的态度后，笔者提出了几点建议以期达到药品专利权和公共健康权的良好平衡。一是国内部门在制定政策时应审慎对待药品专利权的保护；二是完善现行许可制度；三是引入默示许可制度；四是合理的利用仿制药解决当前危机；五是审判实践中法官应充分

3、认识到药品专利权的特殊性；六是对“不侵权诉讼制度”的合理解释。【英文摘要】NumerousfreshlivesdiefromSARSobirdflu,whichnotonlyquestionsourgovernmentcontingencyability,butalsoquestionsthecurrentdrugadministrationsystem.Inthefaceofsimilarcrisis,howourlawcanproviderapidprocessingisaproblem.Appropriateprotectionofdrugpatentsisquiteimportantt

4、omaintainthepublichealth,butdrugpatentprotectionisnotlimitless.Patentprotectionisnottheultimategoalwearepursuing,whichisjustawaytopromotesocialwelfare.Drugpatentsandhealthrightsowndifferentfunctionandrange.Theybothcanincreasehumanbenefitsindifferentconditions,butsineetherearedifferentinterestbodies,

5、conflictinginterestsexistbetweenthem.Wecanseethedicegamebetweenpatentrightsandpublichealthright,thedevelopedcountriesandthedevelopingcountries,andtheleastdevelopedcountriesfromtheinternationaltreatysdevelopmentprocess.Alongwiththedevelopmentofinternationaleconomicsituation,peoplesunderstandingaboutt

6、heconnotationandboundaryofhumanrightsandintellectualpropertyrightshaschanged.Peoplewishtoachievethebalaneebetweenpatenteebenefitsandglobalpublichealthbenefitsthroughtherestrictionondrugpatent.However,becauseofpeoplesdifferentexpectationsoftheirrespectiveinterests,thiskindofbalaneeandcoordinationiste

7、mporaryandconformstotheimmediateenvironment,whichconstantlyehangeswiththetimeschange.Ontheanalysisofthetypeofdomesticpharmaceuticalpatentinfringementcasesandtheattitudeofdomesticlawandcasestopharmaceuticalpatentprotection,theauthorputsforwardsomesuggestionsinordertoachievegoodbalaneebetweendrugpaten
