1、 / 10 / 10兼职用工协议甲方（用人单位）：乙方（劳务人员）：名称姓名：法定代表人（主要负责人）：身份证号码:通讯地址： 通讯地址： 联系电话：联系电话：鉴于乙方现在属于兼职用工人员，乙方不具备劳动法律关系的主体资格，无法与甲方建立劳动（合同）关系。甲乙双方经平等协商， 共同决定建立劳务关系。因此，本计月服务协议属于劳务协议，不在中华人民共和国劳动法调整范围内，而在中华人民共和国民法 通则的调整之中。甲乙双方在充分明确这一法律关系的基础上，根 据民法通则和其他相关法律、法规，自愿签订本协议，共同遵守 协议所列条款。、协议期限本协议期限自 年月日起，至 年月日止，其中前90天为试工期（注：

2、本试工期与劳动法中的试用期不是 同一概念）。试工期内，甲乙双方均可无条件随时通知对方解除本协 议。二、工作条件甲方应根据国家有关规定，为乙方提供符合职业安全卫生条件的工作环境。三、工作（生产）任务乙方同意服从甲方的工作（生产）需要，在 岗位, 承担 工作（生产）任务。四、工作要求.乙方的工作岗位由甲方根据工作需要进行安排和调整。乙方必 须按照甲方的工作要求，尽职尽责做好工作。.乙方应严格遵守国家各项法律规定。遵守甲方的工作规范、操 作规程、劳动安全卫生制度等各项规章制度，包括员工手册中写 明的各项规定和要求。.爱护甲方财物，保守甲方机密，维护甲方利益，服从甲方的领 导、管理和教育。.对于因乙方

3、过失给甲方造成经济损失的，甲方有权要求乙方承 担赔偿责任。五、劳动报酬甲乙双方约定，乙方的工资为 元/月，在履行本协议 期间如有薪资调整或变化，则调整后按新标准执行。乙方作为劳务人员，在甲方工作期间，只享受本协议中约定的福 利和待遇，甲方内部文件中涉及的员工其他福利或待遇均不适用于乙 方。六、协议的解除与终止.在本协议期限内，任何一方均有权提前十五个工作日通知对方 解除本协议。解除本协议不需支付经济补偿金。.甲方因乙方违纪，可随时与乙方解除本协议。此时，不需按上 款规定提前通知乙方。.甲方不按本协议约定提供必要的劳动条件或劳动报酬时，乙方 可以随时解除本协议，不受提前通知的限制。.本协议到期或

4、过期，如双方未续签，自行终止本协议，不需提 前通知。.甲乙双方无论因何原因解除或终止本协议，乙方均应立即办理 工作交接、归还甲方财、物等离职手续。具体程序如下： / 10乙方离职时应按规定交接相关的工作，直到离职手续完成为止，公司才发放当月工资 , 如离职时没有完成归还甲方财、物等离职手续 而离开， 甲方有权在不违反公布及可公开获悉的法律、 法规的原则下，扣除乙方的部分工资、 其他报酬及报销费用， 以抵充乙方欠负甲方的任何数额及/或以支付法律、 法规规定的其他税项、 费用等及 / 或以作为其他合法用途。七、其他1 乙方的人事档案仍由原单位管理，甲方不负责处理与乙方人事档案有关的任何事宜。2因甲
