UzbekSoumUZS862,900,792UzbekSoumUZS862,900,792(eighthundredandsixtytwomillion,ninehundredthousand,sevenhundredandninetytwoUzbekSoum);UnitedStatesDollarUSD2,552,539(twomillion,fivehundredandfiftytwothousand,fivehundredandthirtynineUnitedStatesdollars).theContractorhasfurnishedthePerformanceSecurityandwillfurnishtheAdvancePaymentGuaranteeinaformandmannersatisfactorytotheEmployer;theContractorhasconfirmedthattheinputsfortheforeignandlocalcun*encyrequirementsareasstatedintheAppendixtoBid(Section5ofthisdocument);theContractorhasconfirmedthattheformulaandcoefficientsfortheforeigncurrencypricesareasstatedinAppendixtoBid(Section5ofthisdocument);theContractPriceisasshownin(i)aboveandshallbesubjecttochangesinrespectofChangesinCostandLegislationinaccordancewithClause70oftheConditionsofContract,PartILINWITNESSwhereofthepartiesheretohavecausedthisAgreementtobeexecutedthedayandyearfirstbeforewritten.TheCommonSealoftheEmployerwashereuntoaffixedinthepresenceof:Name:PositionTheCommonSealoftheContractorwashereuntoaffixedinthepresenceof:Name:PositionSignedforandbehalfoftheEmployerShKhamraevDeputyMinister,MinistryofAgricultureandWaterResourcesShKhamraevDeputyMinister,MinistryofAgricultureandWaterResourcesYanXiuchunAuthorisedRepresentativeSinohydroCorporationTitleofSignatorySignedforandbehalfoftheContractorNameofSignatoryTitleofSignatory技术规范1.03DrawingsTheDrawingsissuedatthetimeoftenderingarelistedinSectionXoftheBiddingDocument.Drawingsarepreparedbilingual,beingin“English"and"Russian”.Incaseofdiscrepancybetweenthem,thetextin“English“shallprevail.DuringthecourseoftheContract,informationmaybegivenbytheEngineerinrespectofindividualstructurestobeconstructedinaccordancewithissuedDrawingswhichshowtypicalstructuresofthesameform.ItshallbetheContractor'sownresponsibilitytopreparefromthisinformationsuchWorkingDrawings,includinginteralia,reinforcementdrawings,ashemayrequireforthepropersettingoutandconstructionofsuchstructures.WorkshallnotcommenceonanindividualstructureuntiltherelevantWorkingDrawingshavebeenapprovedbytheEngineer.TheContractorshallensurethatthearrangementsshownonallDrawingsusedforthesettingoutandconstructionoftheworksfullyaccommodateallPlantprovidedundertheContract.WherethePlantprovidedisincompatiblewiththearrangementsshownintheDrawingsissuedbytheEngineer,byvirtueofsize,weight,accessrequirementsforoperationormaintenance,orwhateverothercause,theContractorshalladvisetheEngineeraccordinglyandpriortosubmissionofWorkingDrawingsfortheEngineer'sapproval.TheContractorshallprepare“AsBuilt“DrawingsinEnglishandRussianwhichshallbeprovidedtotheEngineerasonefullsizenegativeand3copiespluselectronicversionfullycompatiblewiththelatestversionofAutoCad.1.04DatumofLevelsThelevelsshownonDrawingsrefertoasystemofbenchmarkspreviouslyestablishedintheareainconnectionwiththeProject.ForthepurposesofthisContractthedatumtobeusedshallbeabenchmarkforwhichtheEngineerwillascribeavaluepriortocommencementoftheWorks.1.05SurveyFromthebench-markspecifiedinClause1.04hereoftheContractorshallcheckthelevelsofanyexistingtemporarybench-marksheproposestouseinsettingouttheWorksandshallestablishadditionalbench-markssuchthatnolevelistransferredmorethan1kmwithoutbeingtransferredtoabench-mark.Bench-marksshallbenumberedandtheirconstructionshallbetotheapprovaloftheEngineer.TheContractorshallsupplytotheEngineer,induplicate,mapsandrecordsinanapprovedformgivingdetailsofthelocation(includingco-ordinates)andlevelofeachbench-markusedorestablishedbytheContractor.Levelsshallbetransferredandascribedtobench-markswithinanaccuracyof5Vkmmwherekisthelengthinkilometresofthelevellingcircuit.Bench-markco-ordinatesshallbedeterminedtowithinanaccuracyof1in4000ofthelengthofthelevellingcircuit.TheContractorshallberesponsibleforsettingouttheWorksfromabaselinegiventohimbytheEngineer.Whererequired,theContractorshallsubmittotheEngineerlistsoforiginalgroundsurfacelevelsforthepurposesofmeasurementofearthworks.Unlessotherwiseapproved,suchlistsshallbesubmitted28daysinadvanceofthesubmissionoftheplanofearthworksoperationsrefen'edtoinClause4.13.ThemethodofsurveyingshallbetotheapprovaloftheEngineer.FieldbooksandtabulateddatashallbewellmaintainedandmadeavailableforinspectionandcheckingbytheEngineerwhenordered.AllsurveyshallbecarriedoutinaccordancewiththerequirementsoftheGovernmentofUzbekistan.1.06ProgrammeBeforecommencingtheWorkstheContractorshallsubmittotheEngineerforhisapprovalaprogrammeshowingtheorderinwhichheproposestocarryouttheWorks.TheContractorshallrevisethisprogrammeasnecessarytoensurecompletionoftheWorkswithinthetimeperiodsstatedintheContract.Theprogrammeshallincludethefollowingdetails:astatementgivingthenumbersandcategoriesofsupervisoryandtechnicalstaffandskilledandunskilledlabourtobeemployedontheWorks;alistandtypedetailsofmajorConstructionalPlant(includingvehicles)whichtheContractorproposestoemployontheWorks;detailsoftheContractorsmethodsofworkingforalloperations;astatementgivingtheproposalsforlocationorlocationsandsizesofbasecamps,accommodation,offices,workshopsandstores;detailsoftheprogrammefortheWorksfromthedateofreceiptoftheEngineer'sordertocommencetheWorks,includingacompleteresourceallocationshowingthenumberofunitsandallottedtimesforeachunitofConstructionalPlant,materialsandlabourallocatedtoeachpartoftheWorks;detailsofthePlantwhichtheContractorproposestosupplyinaccordancewithChapters-12and.13hereto;WatersupplyandenvironmentalmanagementworksinBadaiTugaiandLakeAyazkalashallbeshownseparatelyassub-groupsofwork.TheContractorshallprepareandsubmitsuchmethodstatementsforapprovalbytheEngineerpriortostartinganynewactivityorsectionoftheWorks,oratsuchothertimethattheEngineermayreasonablyrequire.1.07NoticeofOperationsTheContractorshallgivefullandcompletewrittennoticeofallimportantoperationstotheEngineersufficientlyinadvancetoenabletheEngineertomakesuchaiTangementsastheEngineermayconsidernecessaryforinspectionandforanyotherpurpose.TheContractorshallnotstartanyimportantoperationwithoutthewrittenapprovaloftheEngineer.1.08WaterSupplyTheContractorshallmakehisownarrangementsforthesupplyofwaterforthepurposesoftheContract.ThequalityofthewatershallbetotheapprovaloftheEngineerandsuitableforthepurposeforwhichitisintended.WastewatershallbedisposedofclearoftheSitetothesatisfactionoftheEngineersoastocausenodamageorcomplaint.1.09LatrinesTheContractorshallprovidethroughouttheperiodofconstructionoftheWorksandshallmaintainandcleansesuitableandsufficientlatrinesforusebyhisemployees.HeshallensurethathisemployeesdonotfoultheSitebutmakeproperuseofthelatrines.TheContractorshallensurethatsuchlatrinescomplywiththerequirementsofClause1.11oftheSpecification.1.10Contractor'sPowerSupplyTheContractorshallmakehisownarrangementsforthesupplyofelectricpowerforthepurposesoftheContract.1.11CampsandAccommodationTheContractorshallconstructandmaintainacamp/campstoprovidelivingaccommodationforhisstaffandoperatives.TheContractorshallberesponsibleforandprovideallservicestothelivingquartersandshallpayallchargesinconnectiontherewithandshallseetoitthatallsanitarylawsandotherlawsandregulationsinforceintheareaarecompliedwith.TheContractorshallberesponsibleforandprovideallnecessaryfencingandsecuritytotheseareas.uppliersofMaterialsBeforeorderingamaterialofanydescriptionintendedforthePermanentWorks,theContractorshallsubmitfortheapprovaloftheEngineerthenameofthemakerorsupplierproposedanddetailsoftheplaceoforiginandspecificationofthematerial.IfrequestedbytheEngineer,theContractorshallsupplytotheEngineerforhisretentionacopyofanysuchorderplaced.NaturalMaterialsTheContractorshallmakeallarrangementsforlocating,selectingandprocessingnaturalmaterialstocomplywiththeSpecificationsandshallsubmittotheEngineerforapprovalfullinformationregardingtheproposedlocationwellinadvanceofcommencementofworkingofthematerial.Approvalofasourcedoesnotimplythatallmaterialfromthatsourceisapproved.DisruptionofLocalCommunitiesandMaintenanceofExistingIrrigationFlowsTheContractorshalltakeallmeasuresnecessarytoavoidnuisanceanddisruptiontolocalcommunities.InparticulartheContractorshallensurenodamageisdonetocrops,pastureorwoodlandoutsidetheareaforwhichtheEngineer'sapprovalforbushclearancehasbeengiven,thatallirrigationsuppliestosuchareasaremaintainedandthattheContractor'soperationsdonotcauseflooding,impaireddrainageorpollutionhazards.InthecourseofconstructionoftheWorkstheContractorshallnotinterruptthewatersupplytoanexistingirrigationconsumerorreduceitbelowtheflownormalforthegrowingcrops,takingintoaccountthetimeofyear,withouttherecordedandwitnessedconsentoftheconsumer.BeforecommencinganyworkwhichcouldcauseinterruptiontotheexistingirrigationsuppliesordrainagetheContractorshallsubmit,inaccordancewithClause1.06hereof,fulldetailsofhisproposedmethodsofmaintainingsuchsupplies.ArchaeologicalFindingsTheContractor,agreesthatshouldheoranyofhisemployeesandsub-contractors,intheperformanceofthisContract,discoverevidenceofpossiblescientific,pre-historical,historicalorarchaeologicalmaterials,hewillnotifytheEngineerimmediatelyinwriting,givingthelocationandpresumednatureofthefindings.Whereappropriate,byreasonofadiscovery,theEngineermayorderdelaysinthetimeofperformanceand/orchangesintheworks.GraveyardsidentifiedatthetimeofpreparationoftheDrawingsareshownthereon.TheContractorshallnottrespass,excavateinorotherwisedisturbgraveyards,whethershownontheDrawingsornot.Inthecaseofunidentifiedgraveyardsorburialsites,theContractorshallnotifytheEngineerinwriting,andtheEngineershallmakesuchdesignchangesasareneeded.LandscapePreservationTheContractorshallexercisecaretopreservethenaturallandscapeandshallconducthisconstructionoperationssoastopreventanyunnecessarydestruction,scarringordefacingofthenaturalsurroundingsinthevicinityofthework.Exceptwhereclearingisrequiredforpermanentworks,forapprovedconstructionroadsandforexcavationoperations,alltrees,nativeshrubbery,vegetation,fencesandwallsshallbepreservedandprotectedfromdamagewhichmaybecausedbytheContractorsconstructionandrestorationoperationsandequipment.Movementofcrewsandequipmentwithintherights-of-wayandoverroutesprovidedforaccesstotheworkshallbeperformedinamannertominimisedamagetograzingland,cropsorproperty.WaterPollutionTheContractorshallcomplywithapplicableregulationsconcerningthecontrolandabatementofwaterpollutionasfollows:TheContractorsconstructionactivitiesshallbeperformedbymethodsthatwillprevententranceoraccidentalspillage,ofsolidmatter,contaminants,debrisandotherobjectionablepollutantsandwastesintoflowingstreams,flowingordrywatercourses,lakesandundergroundwatersources.Sanitarywastesshallbedisposedofinthesoilbyburialatapprovedsitesorbyotherapprovedmethods.TheContractorwillprovidesuitablesanitaryfacilitiesfbrtheuseofhispersonnel.DisposalofWasteThedisposalofwastematerialsshallbeasfollows:Wastematerials,includingbutnotrestrictedtorefuse,garbage,sanitarywastes,industrialwastesandoilandotherpetroleumproducts,shallbedisposedofbytheContractor.Disposalofwastematerialshallbebyburying,whereburialofsuchmaterialsisapprovedbytheEngineer,byburning,whereburningofsuchmaterialsispermittedinaccordancewithUzbekistanlaws,orbyremovalfromtheconstructionarea.Allwastematerialtobedisposedofbyburningshallbepiledindesignatedburningareasinsuchamanneraswillcausetheleastfirehazard.Burningshallbethoroughandcompleteandallcharredpiecesremainingafterburning,exceptforscatteredsmallpieces,shallberemovedfromtheconstructionareaanddisposedofasotherwiseprovidedinthisClause.TheContractorshallatalltimestakespecialprecautionstopreventfirefromspreadingbeyondthepilesbeingburnedandshallbeliableforanydamagecausedbyhisburningoperations.ThewastematerialstobedisposedofbyremovalfromtheconstructionareashallbedisposedofpriortothecompletionoftheworkundertheseSpecifications.Allwastematerialsremovedexcepttrees,shallbecomethepropertyoftheContractor.Wastematerialstobedisposedofbydumpingshallbehauledtoanapproveddumpsite.ItshallbetheresponsibilityoftheContractortomakeanynecessaryaiTangements.SafetyAllworkexecutedbytheContractorintheperformanceofthisContractshallbeinaccordancewithanagreedHealthandSafetyPlan,thecontentsofwhichshallincludethetopicssetoutinAppendixD.TheContractorshallobservehighstandardsofsafetyformenandmachinesatalltimesandwithregardtosafety,theContractorshallcomplywithUzbekistanlawsandwillensurestrictadherencetothefollowing:TheContractorshallprotectmenworkingintrenchesfromcave-insbythepropershoringorslopingoftrenches,andshalltakespecialcareofpersonsworkinginthetrenches,andprohibitindividualemployeesfromworkingaloneintrenches.TheContractorshallprotectpersonnelfromthemovingpartsofthemachinesbyinstallingandmaintainingproperguards.TheContractorshallnotpermitcasualobserversclosetoexcavatingoperations.TheContractorshallprovideadequatefencingaroundtemporaryopenexcavations.GrazingofLivestockTheContractorshallprovidereasonablecarebyhiringwatchmentoensurethatlivestockarenotallowedwithintheconstructionrights-of-wayduringtheoperations.WildlifeTheContractorshalltakeallnecessaryprecautionstopreventdangertowildlife.TheContractorshallfullycooperateandassistasnecessarywithanyprotectionplansdevelopedbystateauthoritiestoavoiddamagetoordisturbanceofwildlife.UtilitiesUtilitiesalongSKMD,interalia,include:pipecrossings(drinkingwaterline,gasline)powerlinecrossings,communicationlinecrossings,ItshallbetheContractor'sresponsibilitytolocateonthesiteallutilitieswhetherornotindicatedontheDrawingsandtomakethenecessaryarrangementswiththeutilitiesauthoritiesforanyworkinthevicinityoftheutilitiesandordiversionsoftheutilities.AllsuchworkshallbeatthecostoftheContractor.Theforegoingnotwithstanding,thediversionormodificationofmajorutilitycrossingsoftheSKMDasshownintheDrawingsshallbeundertakeninaccordancewiththisSpecificationandshallbepaidforundertheContractassetoutintheBillofQuantities.AlldiversionsandmodificationstosuchservicesshallbetotheapprovaloftheEngineer,whoshalltakeintoaccounttherequirementsoftheownersoftheserviceinfrastructure.TheContractorshallprovidetemporaryarrangementsforutilities,suchaspowerlines,toavoiddisruptingutilityserviceprovision.IndicativearrangementsareillustratedintheDrawings,buttheContractorisatlibertytosuggestalternatives.TheEngineer'sapprovalofsuchalternativeswillnotbereasonablywithheld,buttheapprovalwillonlybegivenwheretheutilityinfrastructure^ownerconsentstothearrangement.1.23SiteEnvironmentalManagementPlanAllworkexecutedbytheContractorintheperformanceofthisContractshallbeinaccordancewithaSiteEnvironmentalManagementPlan(SEMP).TheContractorshallprovideadraftcopyoftheSEMPfortheapprovaloftheEngineerpriortothecommencementofworksonsite.TheSEMPshalladdresstheproject-specificissuescontainedinAppendixC,andanyothercontract-specificissuesdescribedinVolume2SectionTechnicalSpecifications.TheContractorshallensurethattheworkofallSub-ContractorsissubjecttotherequirementoftheSEMP.TheSupervisionoftheSEMPshallbesubjecttoauditsundertakenbytheEmployerandtheEngineerortheirnominatedrepresentatives.SuchauditswillincludeareviewoftheContractor'sinternalauditrecordsincludingidentifiednon-conformitiesandtheeffectivenessofthecorrectiveaction.TheContractorshallbeprovidedwithtenworkingdays'noticepriortoanauditbeingcarriedout.Onaday-to-daybasis,theContractorshallaffordreasonableavailabilityofstaffanddocumentationfortheEngineertoassessimplementationoftheSEMP.1.24CorrespondenceAllcorrespondencetotheEmployerandtotheEngineeroriginatingfromtheContractor,shallbeaccompaniedbyaRussiantranslation.1.25UseofExplosivesTheContractorshallnotuseexplosivesforanypurposewithoutobtainingtheEngineer'spriorapprovalinwriting.Theuseofexplosiveswillnotbepermittedunderanycircumstancewithin2km(asmeasuredinastraightline)ofanyhistoricalmonumenthavingfreestandingwallsorotherconstructionsthatintheEngineer'sopinionmightpotentiallybedamagedbyanyexplosion.Ifpermittedtouseexplosives,theContractorshalltakeallreasonableprecautionstoensurethatthestorage,transportationanduseofsuchexplosivesdonotriskharmtopeople,theirbelongingsortheenvironmentandshallmoreovercomplyfullywithalllegislationandcodesofpracticeprevailinginUzbekistan.1.1StandardSpecificationsExceptwhereotherwisespecifiedallmaterialsandworkmanshipshallconformwiththerequirementsoftherelevantISOStandards,BritishStandardsandBritishStandardCodesofPractice(hereinafterreferredtoasBSorCP)issuedbytheInternationalStandardsOrganisationandtheBritishStandardsInstitutioncurrenton28dayspriortothedatefortheSubmissionofBids.OtherequivalentNationalorInternationalStandardSpecificationsmaybesubstitutedatthesolediscretionoftheEngineerorasmayhavebeenagreedintheContract.WhereontheDrawings,areferencetolocalstandardsorproductsisshown,itshallbefortheguidanceoftheContractoronlyanditshallnotrelievetheContractorofhisobligationsasdefinedintheSpecifications.Notwithstandingthis,whenever,constructionofapartoftheworkorprocurementofmaterialsoritems,suchasprecastunits,isrequiredbytheDrawingsororderedbytheEngineer,tobeinaccordancewithlocalstandards,theContractorshallprovidealldocumentation(e.g.certificatesetc)fortheworktodemonstratefullcompliancewiththerelevantlocalstandards.ItshallbetheContractor^responsibilitytofindoutwhetherthereisanydiscrepancybetweentheprovisionsoftheSpecificationandthereferredLocalStandardsandincaseofsuchdiscrepancy,theContractorshallnotifytheEngineerinwriting.Forthispurposes,alternatively,theContractormayproposehisownsubstitutedesignwhichshallconformtothisSpecificationandinwhichcasehewillalsoconformtotheclassesofconcreteetc,indicatedontheDrawingsandandshallsubmittotheEngineerfulldetailsofthealternative.3.02SamplingandTesting-GeneralWherespecifiedororderedbytheEngineertheContractorshallarrangefortestsasdetailedinClause3.03hereoftobecarriedoutattheapprovedlaboratory.TheContractorshallsubmittotheEngineerforhisapprovaldetailso
