第页共页2023年劳动合同书(18篇)劳动合同书篇一甲方(用人单位)伍单位地址:大方县星宿乡龙山村乙方(劳动者)姓名码:联络根据《劳动合同法》和国家有关规定,甲乙双方遵循平等自愿、协商一致的原那么订立本劳动合同。有固定期限:自年年月日止。(一)根据甲方工作需要和任职要求,乙方同意在岗位上工作。经甲乙双方协商同意,可以变更工作岗位。(二)乙方应按照甲方要求,按时完成规定的工作量,到达规定的质量标准。(三)乙方每日工作时间不超过过8小时,平均每周工作时间不超过40小时。甲方应当保证乙方每周至少休息一日。甲方因消费特点不能按照前款执行时,经劳动保障行政部门批准,可以实行综合计算工时或者定时工作制。(一)甲方根据本单位的工资制度,实行月工资制,乙方满勤月工资为元/月。甲方提供食宿条件或者等同于提供食宿条件的,不得折算为乙方工资。(二)甲方按月以货币形式支付乙方工资,每月日前支付工资,并由乙方签字确认。(三)用人单位应依法为职工缴纳工伤保险,并在本单位内公示。用人单位和职工应当预防工伤事故发生,防止和减少职业病危害。职工发生工伤时,用人单位应采取措施使职工得到及时救治。(一)甲方为乙方提供符合有关劳动法律的劳动平安和保护设施,劳动防护品和其他劳动条件。甲方必须按照国家有关规定和未成年工实行特殊劳动保护。(二)甲主在乙方上岗前对乙方进展平安消费教育。在工作场所,甲方必须按照国家平安消费的规定,采取必要的平安措施。(三)甲方为乙方提供宿舍、食堂、饮用水、洗浴、公厕等根本生活条件必须到达平安、卫生要求。(一)甲方依法制定的需要乙方遵守的劳动规章制度,应当与在乙方签订本合同时告知乙方。(二)乙方应自觉尊守有关劳动法律、法规和甲方依法制定的各项规章制度,严格遵守平安操作规程,服从管理,按时完成工作任务。乙方对甲方违章、强令冒险作业有权回绝;对危害生命平安和身体建康的劳动条件,有权提出批评、检举和控告。(一)甲乙双方单面解除本合同,应符合《劳动合同法》第37条、第38条、第39条、第40条和第41条的规定。乙方有《劳动合同法》第42条规定情形的,甲方不得按照《劳动合同法》第40条、41条的规定解除本合同。(二)劳动合同期满或者当事人约定的劳动合同终止条件出现,劳动合同即行终止。甲乙双方协商同意,可以续定劳动合同。(三)解除、终止劳动合同时,甲方应根据有关法律等规定等定出详细解除、终止劳动合同的证明书或者相关文件。(一)甲方依法解除乙方劳动合同,应当支付乙方经济补偿的,按照《劳动合同法》第46条的规定执行。(二)甲方支付乙方的工资报酬低于施工地行政区域内最低工资标准的,要在补足低于局部标准的同时,依法支付赔偿金。(一)甲乙双方在履行本合同时发生争议的,可先行协商解决;不愿协商或协商不成的,可在争议发生之日起一年内向(用人单位工商注册地或者施工地)劳动争议仲裁委员会申请仲裁。对仲裁裁决不服的,可以在15日内向当地人民法院提起诉讼。(二)本劳动合同与国家法律法规及有关规定相违犯的,按照家法律及有关规定执行。本劳动合同一式二份,甲乙双方各执一份。甲方(公章)法定代表人(委托代理人)(签章)乙方(签字)合同签订日期:年月日鉴证机关(盖章):鉴证人(签章)合同鉴证时间:年月日劳动合同书篇二未签劳动合同而主张双倍工资的最长期限是11个月。一般来讲,双倍工资的起算时间为用工之日起满1个月的次日,截止时间为补签劳动合同的前1日。用工之日起满1年仍未签订劳动合同的,自用工之日起满1个月的次日至满1年的前1日都应支付双倍工资。未签劳动合同满1年的,满1年的当日视为已签订无固定期限劳动合同。假如劳动者工作1年后仍无法与用人单位签订劳动合同,应该考虑是否及时主张权利,并与用人单位解除劳动关系。1、20xx年1月1日起正式施行的《劳动合同法》规定,劳动者与用人单位所签订的劳动合同到期,假如用人单位不愿与劳动者续签劳动合同,从而使原劳动合同终止,用人单位应按规定向劳动者支付在本单位工作每满一年一个月工资的经济补偿。而在《劳动合同法》未施行前,由于没有这样的规定,因此,劳动合同到期终止那么没有经济补偿。2、劳动合同到期终止与解除劳动合同不一样,没有劳动合同终止必须提早三十天通知对方的规定。3、根据《重庆市失业保险条例》规定,失业人员需具备以下条件方可领取失业保险金:按照规定参加失业保险,所在单位和本人已按照规定履行缴费义务满一年以上的;在法定劳动年龄内非因本人意愿中断就业的;已按规定办理失业和求职登记的。单位与职工终止、解除劳动关系后,应当及时为失业人员办理终止或解除劳动关系的证明,书面告知其按照有关规定办理失业登记和享受失业保险待遇的权利,并将失业人员的及档案自终止或者解除劳动关系之日起七个工作日内送失业人员户口所在区县(自治县)失业保险经办机构审查。失业人员自原单位签发有关证件之日起六十日内,到户口所在区县(自治县)失业保险经办机构办理失业登记和申领失业保险金手续。失业人员领取失业保险金的期限,根据其失业前所在单位和本人累计缴纳失业保险费的时间确定。其中累计缴费时间满两年缺乏三年的为六个月。《工伤保险条例》第2条规定:〝中华人民共和国境内的企业、事业单位、社会团体、民办非企业单位、基金会、律师事务所、会计师事务所等组织和有雇工的个体工商户(以下称用人单位)应当按照本条例规定参加工伤保险,为本单位全部职工或者雇工(以下称职工)缴纳工伤保险费。中华人民共和国境内的企业、事业单位、社会团体、民办非企业单位、基金会、律师事务所、会计师事务所等组织的职工和个体工商户的雇工,均有按照本条例的规定享受工伤保险待遇的权利〞。同时,根据《社会保险法》的规定,为员工缴纳社会保险是用人(工)单位的法定义务。就工伤保险来说,工伤保险应当由用人单位缴纳,职工个人不缴纳工伤保险费。当前,我国境内相当一局部用工单位和个人还没有树立为员工缴纳工伤保险费的法律意识,一旦发生工伤事故,又往往采取逃避或者推卸责任的方法,从而给企业开展造成不利影响,给社会和谐带来不安定因素。为此,凡用工单位都应当本着为员工利益、为企业开展、为社会和谐着想的原那么,严格执行《工伤保险条例》和《社会保险法》的规定,为员工缴纳工伤保险,在员工发生保险事故时,依法及时为员工申报办理工伤保险待遇,否那么,将承当有关费用的负担责任。那么,用工单位或员工个人该如何应对和处理工伤事故呢?一是要明确工伤认定的法定情形。根据《工伤保险条例》的规定,发生以下情形可以认定工伤:在工作时间和工作场所内,因工作原因受到事故伤害的;工作时间前后在工作场所内,从事与工作有关的预备性或者收尾性工作受到事故伤害的;在工作时间和工作场所内,因履行工作职责受到暴力等意外伤害的;患职业病的;因工外出期间,由于工作原因受到伤害或者发惹事故下落不明的;在上下班途中,受到非本人主要责任的交通事故或者城市轨道交通、客运轮渡、火车事故伤害的;法律、行政法规规定应当认定为工伤的其他情形。视同工伤情形的有:在工作时间和工作岗位,突发疾病死亡或者在48小时之内经抢救无效死亡的;在抢险救灾等维护国家利益、公共利益活动中受到伤害的;职工原在军队服役,因战、因公负伤致残,已获得____伤残军人证,到用人单位后旧伤复发的。有以下情形之一的,不得认定为工伤或者视同工伤:成心犯罪的;醉酒或者吸毒的;自残或者自杀的。二是要熟悉工伤申报、认定的相关程序。职工发惹事故伤害或者按照职业病防治法规定被诊断、鉴定为职业病,所在单位应当自事故伤害发生之日或者被诊断、鉴定为职业病之日起30日内,向统筹地区社会保险行政部门提出工伤认定申请。遇有特殊情况,经报社会保险行政部门同意,申请时限可以适当延长。用人单位未按规定提出工伤认定申请的,工伤职工或其近亲属、工会组织在事故伤害发生之日或者被诊断、鉴定为职业病之日起1年内,可以直接向用人单位所在地统筹地区社会保险行政部门提出工伤认定申请。职工发生工伤,经治疗伤情相对稳定后存在残疾、影响劳动才能的,应当进展劳动才能鉴定。劳动才能鉴定标准由国务院社会保险行政部门会同国务院卫生行政部门等部门制定。提出工伤认定申请应当提交工伤认定申请表、与用人单位存在劳动关系(包括事实劳动关系)的证明材料、医疗诊断证明或者职业病诊断证明书(或者职业病诊断鉴定书)等材料。社会保险行政部门受理工伤认定申请后,根据审核需要对事故伤害进展调查核实,用人单位、职工、工会组织、医疗机构以及有关部门应当予以协助。职业病诊断和诊断争议的鉴定,按照职业病防治法的有关规定执行。对依法获得职业病诊断证明书或者职业病诊断鉴定书的,社会保险行政部门不再进展调查核实。三是要清楚社保部门工伤认定流程。社会保险行政部门应当自受理工伤认定申请之日起60日内作出工伤认定的决定,并书面通知申请工伤认定的职工或者其近亲属和该职工所在单位。社保部门对受理的事实清楚、权利义务明确的工伤认定申请,应当在15日内作出工伤认定的决定。作出工伤认定决定需要以司法机关或者有关行政主管部门的结论为根据的,在司法机关或者有关行政主管部门尚未作出结论期间,作出工伤认定决定的时限中止。社保部门工作人员与工伤认定申请人有利害关系的,应当回避。工伤认定申请人提供材料不完好的,社会保险行政部门应当一次性书面告知工伤认定申请人需要补正的全部材料。申请人按照书面告知要求补正材料后,社会保险行政部门应当受理。职工发惹事故伤害或者按照职业病防治法规定被诊断、鉴定为职业病,所在单位应当自遇有特殊情况,经报社会保险行政部门同意,申请时限可以适当延长。用人单位未按前款规定提出工伤认定申请的,工伤职工或者其近亲属、工会组织在事故伤害发生之日或者被诊断、鉴定为职业病之日起1年内,可以直接向用人单位所在地统筹地区社会保险行政部门提出工伤认定申请。四是要理解职工工伤治疗费用的负担内容。职工住院治疗工伤的伙食补助费,以及经医疗机构出具证明,报经办机构同意,工伤职工到统筹地区以外就医所需的交通、食宿费用从工伤保险基金支付,基金支付的详细标准由统筹地区人民政府规定。工伤职工治疗非工伤引发的疾病,不享受工伤医疗待遇,按照根本医疗保险方法处理。工伤职工到签订效劳协议的医疗机构进展工伤康复的费用,符合规定的,从工伤保险基金支付。工伤职工因日常生活或者就业需要,经劳动才能鉴定委员会确认,可以安装假肢、矫形器、假眼、假牙和配置轮椅等辅助器具,所需费用按照国家规定的标准从工伤保险基金支付。职工因工作遭受事故伤害或者患职业病需要暂停工作承受工伤医疗的,在停工留薪期内(一般不超过12个月,伤情严重或者情况特殊,经设区的市级劳动才能鉴定委员会确认,可以适当延长,但延长不得超过12个月),原工资福利待遇不变,由所在单位按月支付。工伤职工评定伤残等级后,停发原待遇,按照规定享受伤残待遇。工伤职工在停工留薪期满后仍需治疗的,继续享受工伤医疗待遇。生活不能自理的工伤职工在停工留薪期需要护理的,由所在单位负责。工伤职工已经评定伤残等级并经劳动才能鉴定委员会确认需要生活护理的,从工伤保险基金按月支付生活护理费。生活护理费按照生活完全不能自理、生活大局部不能自理或者生活局部不能自理3个不同等级支付,其标准分别为统筹地区上年度职工月平均工资的50%、40%或者30%。五是必须承当工伤保险相关责任。用人单位未在事故伤害发生之日或者被诊断、鉴定为职业病之日起30日内,向统筹地区社会保险行政部门提出工伤认定申请,在此期间发生符合工伤保险条例规定的工伤待遇等有关费用由该用人单位负担。职工或其近亲属认为是工伤,用人单位不认为是工伤的,由用人单位承当举证责任。假如员工发生工伤,根据《工伤保险条例》的规定,相关费用由工伤保险基金和用人单位分别承当;而用人单位未为员工缴纳工伤保险的,员工应享受的工伤保险待遇全部由用人单位承当;同时,社会保险行政部门有权责令用人单位限期参加工伤保险,并且补交应当缴纳的工伤保险费。所以,假如用人单位未为员工办理工伤保险,那么,《工伤保险条例》中规定的员工应享受的工伤保险待遇的相关费用将全部由用人单位承当,对于员工来说,不存在实际上的损失。劳动合同书篇三甲方:法定代表人:乙方:身份证号:甲、乙
