9-1该房屋交付时存在缺陷的,甲方应自交付之日起的3日内进行修复,逾期不修复的,甲方同意减少租金并变更有关租金条款。

9-2因甲方未在本合同中告知乙方,该房屋出租前已抵押或产权转移已受到限制,造成乙方损失,甲方应负责赔偿9-3租赁期间甲方不及时履行本合同约定的维修,养护责任,致使房屋损坏,造成乙方损失或人身伤害的,甲方应承担赔偿责任。

10-3甲乙双方在签署本合同时,对各自的权利、义务责任清楚明白,并愿意按本合同规定严格执行,如一方违反本合同,另一方有权按本合同规定索赔。

10-4甲乙双方就履行本合同发生纠纷,可通过中介方协商解决,中介方协商解决不成的,可依法申请有关部门仲裁或直接向人民法院起诉。

3、乙方对租用房没有处理权,不能擅自与人合租、转租或借给他人,也不能改变其用途,否则属于违约。如有此类情况发生除支付违约金外,甲方有权解除协议并收回房屋。

六、有关退租、转让的条款

1、协议期内,乙方履行本协议所有条款后,甲方不得提前收回房屋(发生甲方能力范围之外的不可抗事件和乙方违约的情况下除外),。

2、乙方租期未到期而要求退租时,必须与甲方协商一致,另要支付违约金给甲方。

3、协议期内,乙方如果出现以下任何情况:退租、转让、及由于乙方违约原因造成甲方提前收回房屋的任一情况下,乙方都必须按协议缴清所有应付款项。

4、乙方承租到期应完好归还租房协议和所有钥匙及有关物品,如果所租房内的所用设备有损坏,乙方负责修复或者甲方在保证金内扣除相应赔偿金额。

5、甲方原则上不同意转让,但乙方经营确有困难时,应提前向甲方申明,经甲方授权同意,乙方才可实施转让事宜,但转让风险自担,请转让双方谨慎考虑。

6、乙方转让时需向续租方明示本协议内容,转让期为租期内期限;乙方没有通过甲方书面同意及签字的转让行为,属乙方无效转让、乙方的无效转让是违约行为甲方不予承认.

7、乙方无效转让的责任由乙方(即转让方)和续租方承担,如该无效转让已交接结束,责任由续租方全额承担,甲方在收回房屋的同时续租方还将支付乙方应负担的全额违约金及相关费用。

8、有效转让租期为合同内租期,有效期内租金本次调整为叁万陆仟元整(人民币3万6千元正)。

9、续租方需超出租期时,必须同甲方签订新的租房协议。

10、转让交接,水、电、电视、设施及有关经济费用问题,由双方自行处理,如有遗留问题,续租方自行承担,甲方不负连带责任。

七、有关续租的事项

1、租房者在遵守前期协议的情况下,可以获得优先续租权,但必须在原租期结束日前一个月与甲方重新签订租房协议,租金在前期协议租金基础上逐年捉增,提增幅度根椐当年情况确定,一般在15%-20%左右.

2、在原租期已到期,新的续租协议还未签订的情况下,甲方将收回房屋,不再签约续租。

(一)租赁期内,甲方应保障该房屋及其附属设施处于适用和安全的状态。乙方发现该房屋及其附属设施有损坏或故障时,应及时通知甲方修复。

甲方应在接到乙方通知后的▁▁▁日内进行维修。逾期不维修的,乙方可代为维修,费用由甲方承担。因维修房屋影响乙方使用的,应相应减少租金或延长租赁期限。

(二)对于乙方的装修、改善和增设的他物甲方不承担维修的义务。

(三)乙方应合理使用并爱护该房屋及其附属设施。因乙方保管不当或不合理使用,致使该房屋及其附属设施发生损坏或故障的,乙方应负责维修或承担赔偿责任。如乙方拒不维修或拒不承担赔偿责任的,甲方可代为维修或购置新物,费用由乙方承担。

(四)对于该房屋及其附属设施因自然属性或合理使用而导致的损耗,乙方不承担责任。

第十二条转租

(一)除甲乙双方另有约定以外,乙方需事先征得甲方书面同意,方可在租赁期内将该房屋部分或全部转租给他人。

(二)乙方转租该房屋,应按规定与接受转租方订立书面转租合同。

(三)接受转租方对该房屋及其附属设施造成损坏的,由乙方向甲方承担赔偿责任。

第十三条所有权变动

(一)租赁期内甲方转让该房屋的,甲方应当提前▁▁▁日书面通知乙方,乙方在同等条件下享有优先于第三人购买的权利。

(二)租赁期内该房屋所有权发生变动的,本合同在乙方与新所有权人之间具有法律效力。

第十四条合同的解除

(一)经甲乙双方协商一致,可以解除本合同。

(二)有下列情形之一的,本合同终止,甲乙双方互不承担违约责任:

1、该房屋因城市建设需要被依法列入房屋拆迁范围的。

2、因地震、火灾等不可抗力致使房屋毁损、灭失或造成其他损失的。

(三)甲方有下列情形之一的,乙方有权单方解除合同:

1、未按约定时间交付该房屋达▁▁▁▁日的。

2、交付的房屋不符合合同约定严重影响乙方使用的。

3、不承担约定的维修义务致使乙方无法正常使用该房屋的。

4、交付的房屋危及乙方安全或者健康的。

第十五条违约责任

(一)甲方有本合同第十四条第三款约定的情形之一的,应按月租金的▁▁▁%向乙方支付违约金。

(二)因甲方未按约定履行维修义务造成乙方人身、财产损失的,甲方应承担赔偿责任。

(三)租赁期内,甲方需提前收回该房屋的,应提前▁▁日通知乙方,将已收取的租金余额退还乙方并按月租金的▁▁▁▁%支付违约金。

(四)乙方有本合同第十四条第四款约定的情形之一的,应按月租金的▁▁▁%向甲方支付违约金。

(五)乙方擅自对该房屋进行装修、装饰或添置新物的,甲方可以要求乙方恢复原状或者赔偿损失。

第十六条无权代理

第十七条合同争议的解决办法
