国泰财产保险有限责任公司货物运输保险附加险条款本附加险条款共计95条，其中A01～A58为扩展类，B01～B27为规范类，C01～C10一、扩展类A01.CARGOSTRIKECLAUWhereastheCoveragainsttheRisksofStrikesisincorporatedhereinasindicated,thisPoundertakestoindemnifyfor:1.Lossofordamagetothegoodsherebyinsureddirectlycausedbyaclocked-outworkmenorpersonstakingpartinlabordisturbances,riotsorcivilcommotionsomaliciousactsofanypersonorpersonswhomsoever;2.SacrificeinandcontributetoGeneralAverageanThisPolicydoesnotcoverlossofordamagetotheinsureshortageoforincapabilitytoemploylaborduringthetimeofstrikesinclurefrigeratedgoodsattributedtothestoppageofrefrigeratingmachinerycausedbylackofpowerorNote:ThisClauseisanadditionalclausetodifferentsetsofCargoTofconflictbetweenthisClauseandanyClausesinthedifferentsetsofCargoTransportationClauses,thisClauseshallpreA02.THEFT,PILFERAGENON-DELIVERYCLAUSES(INSUREDVALUE)Tocoverlossofordamagetotheinsuredgoodsontheinsur2.Non-Deliveryofentirepackage;3.LossordamageforwhichtheliabilityoftheShipownerorothexemptedbytheContractofCarriage.TheInsuredshalltakedeliveryingoodtimeandnoclaimshallbeadmittedunlesssurveyshallhavebeenappliedforwithin10daysaftertakingdandtheCertificateofNon-deliveryobtainedfromthepartyconcernedincaseofNon-deliveryofThisCompanyisentitledtoanyamountrecoveredfromtheShiconcernedinrespectofsuchlossesuptotheamountpaidbythisCompanyinrespectoftheloss.ThisClauseissubjectotherwisetotheterms,conditionsandexclusionsofthiA03.FRESHWATER&/ORRAINDAMAGECLThisinsurancecoverslossofordamagetotheinsuredgoodsdirectlyfreshwater,butnoclaimshallbeadmittedunlesspackagesshowexternalsignofsuchdamagetocontentsorotherappropriateevidenceisprovidedandtheInsuredtakedeliveryingoodtimeandapplyforsurveywitThisClauseissubjectotherwisetotheterms,conditionsandexclusionsofthiA04.SHORTAGECLAUSETocoverriskofshortageoccurringduringthecourseoftransitduetobreakageofouterpacking,orlossofquantityandactualshortageinweighinthecaseofbulkcargo,butexcludullage.ThisClauseissubjectotherwisetotheterms,conditionsandexclusionsofthiA05.INTERMIXTURE&CONTAMINATIONCLAUTocoverrisksofintermixtureandcontaminationoccurringduringthecourseoftransit.ThisClauseissubjectotherwisetotheterms,conditionsandexclusionsofthiA06.LEAKAGECLAUSETocoverriskofleakageoccurringduringthecourseoftransitcausedbydamagetothecontainer,ordeteriorationoftheinsuredgoodsresultingfromleakageofliquidinwhichtheThisClauseissubjectotherwisetotheterms,conditionsandexclusionsofthisA07.CLASH&BREAKAGECLAUSETocoverrisksofbreakageandclashoccurringduringthecourseoftransitcausedbyshock,collisionorpressoftheinsuredgoods.ThisClauseissubjectotherwisetotheterms,conditionsandexclusionsofthisTocoverriskoftaintofodouroftheinsurededibles,Chinesemedicine,toiletmaterialetc.occurringduringthecourseoftransiteffectedbyothergoods.ThisClauseissubjectotherwisetotheterms,conditionsandexclusionsofthi本保险对被保险货物在运输过程中因气温突然变化或由于船上Tocoverrisksofsweat,heatingandwettingoccurringduringthecourseoftransitarisingfromsuddenchangeoftemperatureorbreakdownofventilationofthecarryingvessel.ThisClauseissubjectotherwisetotheterms,conditionsandexclusionsofthisA10.HOOKDAMAGECLAUSETocoverhookdamagetotheinsuredgoodsoccurringduriexpensesofreconditioningorchangeofpacking,ifany.ThisClauseissubjectotherwisetotheterms,conditionsandexclusionsofthiA11.BREAKAGEOFPACKINGCLAUSETocoverlossordamageoccurringduringthecourseoftransitcausedbybreakageofpackingresultingfromroughhandling,loadingandunloadingincludingexpensesofreconditioningandchangeofpackage(s),ifany,forthesafeprosecutionoftransportation.ThisClauseissubjectotherwisetotheterms,conditionsandexclusionsofthisA12.RUSTCLAUSETocoverriskofrustoccurringduringthecourseoftransit.ThisClauseissubjectotherwisetotheterms,conditionsandexclusionsofthiA13.PERISHABLEGOODSCLAUSEWarrantedfreeofanyclaimforlossofmarketorloss,damageordeterdelaywhethercausedbyaperilinsuredagainstorotThisClauseissubjectotherwisetotheterms,conditionsandexclusionsofthiA14.ONDECKCLAUSEIncasetheinsuredgoodsareshippeofjettisonand/orwashingoverboard.ThisClauseissubjectotherwisetotheterms,conditionsandexclusionsofthi本保险对被保险货物在保险责任有效期内，在进口港或进口地本条款不负责由于其他原因所致的被有关当局拒绝进口或没收A15.AFLATOXINCLAUSEIntheeventthatthecargocoveredbythisPolicy/CertificateisreoriginalpurposethereofforwhichitisintendediscompulsorilyalteredwhilstthisinsurainforcedbyreasonoftheexistenceofaflatoxintoanextentexceedingthelimitsanctionedbytheimportingcountryasevidencedbytheinspectionbythelocalHealthAuthoritiesatthepoplaceofimport,thisCompanyshallbeliabletopaytheinsuredvalueoftheportionsorejectedorconfiscatedorthelossarisingfromthealterationoftheoriginaintended.IncaseoflossfallingunderthisClause,theInsuredagrees,whenrequiredbythisCompany,tomakehisbesteffortstodisposeofthecargorejectedoraffectedbythecompulsoryalterationoftheoriginalpurposeforwhichitisintendedortoapplyforarThisCompanyshallnotbeliableforanylossacompulsoryalterationoftheoriginalpurposeforwhichthecargoisintendedbytheAuthoritiesconcernedduetocausesotherthantheexistenceofafThisClauseissubjectotherwisetotheterms,conditionsandexclusionsofthiA16.SURVEYINCUSTOMSCLAUSENotwithstandingthetermsofthecommencementandterminationclauseoftheOceanMarineCargoClauses,therisksoftheftand/orpilferageandshortagecoveredheonlyuptothearrivaloftheinsuredgoodsIncaseoflossbeingfoundattheabove-mentionedplace,applicationshallbemadetothesurveyingandclaimssettlingagentstipulatedinthePolicyfThisCompanyshallnotbeliableforanylossordamashortageoccurringafterthecompletionoftheabove-mentionedsurvey.ThisClauseissubjectotherwisetotheterms,conditionsandexclusionsofthiA17.SURVEYATJETTYCLAUSENotwithstandingthetermsofthecommencementandterminationClauseoftheOceanMarineCargoClauses,therisksoftheftand/orpilferageandshortagecoveredhereunderinforceonlyuptothearrivaloftheinsuredgoodsatthelandingshedatthefinalportofIncaseoflossbeingfoundattheabove-mentionedplace,applicationshallbemadetothesurveyingandclaimssettlingagentstipulatediThisCompanyshallnotbeliableforanylossordamshortageoccurringafterthecompletionoftheabove-mentionedsurvey.ThisClauseissubjectotherwisetotheterms,conditionsandeA18.HoistingExtensionClauseNotwithstandinganythinghereincontainedtothecontrary,itisherebyunderagreedthatthewithinpolicywill,subjecttoitsterms,limitations,extendtocoveraccidentallordamagetomachineryarisingoutofhoistingoperationsatinsuredlocations.Warrantedoperatedbyprofessionalhoister,subjecttothelimitaggregatepereachconveyingevent,theinsuredshouldcompanyinwritingwithinThisClauseissubjectotherwisetotheterms,conditionsandexclusionsofthi1、进口集装箱货物运输保险责任按原运输险2、集装箱货物运抵目的港，原箱未经启封而转运内地的，其保险责任至转运目的地收3、如集装箱货物运抵目的港或目的港集装箱转4、集装箱在目的港转运站，收货人仓库或经转运至目的地收货人仓库，被发现箱体有5、凡集装箱箱体无明显损坏，铅封完整，经启封开箱后6、进口集装箱货物残损或短缺涉及承运人或第三者责任的，被保险人有义7、装运货物的集装箱必须具有合格的检验证书，如因集装箱不适货而造成的货物残损本附加条款与主条款内容相悖之处，以本附加条款为准；未尽之处，以A20.FIRERISKEXTENSIONCLAUSE(FORSTORAGEOFCARGDESTINATIONHONGKONG,INCLUDINGKOWLOONORMACAO)1.Intheeventthecargoherebyinsured,HongKong,includingKowloonorMacaofromthecarryingconveyance,bedirectedtobesinwarehouse(s)specificallydesignatedbytheBanktoWhomassignedasstatedherein,thispolicyshallextendtocoverfireriskatstimethemarinecoverageheretoceasestoattachunt(1)theterminationofthesaidBank’sinterestsinth(2)theexpirationof30dayscountingfromthedaythinsuredmayhoweverapplyinwritingpriortotheexpirationthereofforanextensionatanadditionalpremiumtobearWhichevershallfirst2.Shouldafterdischargefromthecarryingconveyaotherthanthat/thosestatedin1.above,thisconditionoftheCargoClausesofthisCompany.ThisClauseissubjectotherwisetotheterms,conditionsandexclusionsofthispA21.IMPORTDUTYCLAUSEThisinsurancecoverstheInsured’scontingentinteresttheinsuredgoodsarrivingattheportofdestinationdamagedbyaperilinsuredagainstbutfullimportdutyhadbeenleviedandpaidthereonasifthegoodshadarrivedsoundprovidedclaimspayablehereundershallnotexceed________percentoftheinsuredvalueonthedamagedportionoftheinsuredgoods.ThisClauseissubjectotherwisetotheterms,conditionsandexclusionsofthi本附加条款与主条款内容相悖之处，以本附加条款为准；未尽之处，以本附加条款与主条款内容相悖之处，以本附加条款为准；未尽之处，以2、从船只或飞机上卸装货物所发生的费用。在任何情况下，保险人在本条款项下所承2、机械、电子和电器紊乱责任除外，除非是承保风险所造成的物理损害;3、因空调控制温度变化所引起的被保险货物的损失或损坏为除外责任，A24.RemovalofDebrisClauseB(Limit:USDAnyOneOccurrence)Thisinsuranceisextendedtocover,inadditiontoanyinsurance,extraexpensesreasonablyincurredbytheAssuredfortheremovalanddisposalofdebrisofthesubjectmatterinsured,orpartthereof,byreasonofdamagetheretocausedbyaninsuredrisk,butexcludingabsolutely:1.anyexpensesincurredinconsequenceofortopreventorcontamination,oranythreatorliabilityther2.thecostofremovalofcargofromanyvesselorcraft.InnocaseshallUnderwritersbeliableunderthisClauseformorethanUSDperoccurrExclusionsItisagreedthatthefollowingextensionsshall1.Excludingtherisksofinsta2.Excludingtherisksofmechanical,electronicandelectricalderangementunlessasaresultofphysicaldamagecausedbyinsuredperils;3.Excludinganylossofand/ordamagetotheair-controlledinsuredgoodsarisingfrvariationoftemperatureunlessasaresultofdamagetothepackages/containersusedtocontainthesubjectmatterinsuThisClauseissubjectotherwisetotheterms,conditionsandexclusionsofthisA25.DELIBERATEDAMAGE-POLThisinsuranceisextewaterborneconveyance,lossofordamagetosaauthoritiesactingforthepublicwelfaretopreventormitigateapollutionhazardorthreatthereof,providedthattheaccidentoroccurrenceactionwouldhaveresultedinarecoverableclaimunderthisinsurance.ThisagreementshallnotincreasetheLimitsofLiabilityprovidedforelsewhereherein.a）为修理受损物件必需发生的清除污染费用，例如：对在正常操作过程中暴露于离子c）为保护修理受损物件的人员而发生的费用，例如：购买防护服，为避免辐射而设置本附加条款与主条款内容相悖之处，以本附加条款为准；未尽之处，以本附加条款与主条款内容相悖之处，以本附加条款为准；未尽之处，以仓库日内，拆包及/或打开集装箱、包装箱及/或包装时发现被保险标的物的任何损失及/或损坏，如无任何相反证据可以证明，将被认为是发生在本保险合同中所载明的运输过A28.CONCEALEDDAMAGECLAUSE(MARINECARGO)Inconsiderationofconcealeddamagewhichmayoccurduringthevoyagecovethispolicyisextendedtocoverlossesarisingfromperilsinsuredagainstwhileintranarenotascertaineduntiltheopeningofpackagebytheassured;providedsuchopeningofpackageshallbecompletedwithindaysafterarrivalaassured’swarehouseand,intheabsenceofprooftothecontrary,suchlosseashavingoccurredduringthevoyagecoveredunderthiNothingcontainedherein,however,shallbeconstruedtoextendthecoverageelsewhereprovidedherein.PackageshowingexternalevidenceofdamagearetobeopenedimmediatelyAllothertermsandconditionsremainunchanged.损失或损害应尽速通知保险人。货物外包装有货损迹象、润湿，和/或沾染必须马上开箱並Theassuredshallbeallowedaperiodofupto60daystoopenpexaminecontentsandarrangeforsurveyintheeventoflAllpackagingtobeinspectedandanylossordamagetobenotifpossible.Packagingshowingexternaldamage,wetting,and/orstainingmustbimmediatelyandallpossiblestepstakentominimizedamagNoclaimwillbeadmittedunderthisclauseifthepackagingisnotavailablefortheindependentsurveyor’sinThisClauseissubjectotherwisetotheterms,conditionsandexclusionsofthi如保险设备的单个或多个部件发生保险单责任范围内的损失,保险人的赔偿责任仅限除非保险金额是保险货物的完税价,否则保险人不负责关税的赔偿责任,但由于保险货物损无论何种情况,在本条款下保险人的赔偿责任不超过保险设A30.INSTITUTEREPLACEMENTCIntheeventoflossofordamagetoanypartofpartsofaninsuredinterestcausedbyanperilreplacementorrepairofsuchpartorpartsastheinsuredvalumachineplusadditionalchargesforforwardingandrefittingthenewparts,ifincurred,butsustainedbypaymentofadditionaldutyshallalsoberecoverable.ProvidedthatinnocaseshalltheliabilityofUnderwrit本附加条款与主条款内容相悖之处，以本附加条款为准；未尽之处，以主A32.LABELCLAUSEamountsufficienttopaythecostofreconditioning,costofnewlabelsandreprovidedthedamagewillhaveamountedtoaclaimunderthetermsofthepolicy.ThisClauseissubjectotherwisetotheterms,conditionsandexclusionsofthi本附加条款与主条款内容相悖之处，以本附加条款为准；未尽之处，以A34.ERRORSANDOMISSIONSThisinsuranceshallnotbeprejudicedbyanyunremittanceofcopiesofpoliciesand/orcertificatesand/ordeclarationsorbyanyunintentionalshippedbyanothervesselorconveyance;providedpromptnoticebegiventhisCompanyassoonassaidfactsbecomeknowntotheAThisClauseissubjectotherwisetotheterms,conditionsandexclusionsofthi自保险标的应到达最后目的地之日起满60天后仍未找到被保险货物，保险人本附加条款与主条款内容相悖之处，以本附加条款为准；未尽之处，以三、本保险的终止，自被保险货物卸离海轮存入卸货港的仓库时A36.REJECTIONCLAUSE1.ThisCompanywillbeliableforrejectionand/orcondemnationattheporgovernmentofthecountryofimportoritsrelevantAuthoritiesandwillindemnifytheInsuredonthebasisoftheinsuredvalueofthegoodssorejectedorcondemned.2.IntheeventofanyembargoorprohibitionbeingdeclaredbytheimportingCountryafterinsuredgoodshavelefttheportofshipmentnamedinthepolicostofreturnfreighttothecountryofexportortheadditionalfreighttootherdestination,butsuchreturnfreightoradditionalfreightshallnotexceedtheinsuredvalueo3.Thisinsuranceshallterminateatthewarehouseoftheportofdischargeafterlandingfrom(1)Ontheexpiryof30daysafterdischargeofthegoodsfromtheseagoi(2)WhenthegoodshavebeenpassedbythegovernmentofthecountryofimportoritsrelevantAuthorities.Whichevershallfirst4.ItiswarrantedbytheInsured:(1)Thattheproduction,quality,packingandinspectionandtestingofthcomplywiththerelevantregulationsofthecountryoforiginandtheimportingcountry;and(2)Thatallnecessaryvalidpermitsandlicensesoftheinsuredgoodsmustbeobtained.5.Thisinsurancedoesnotcov(1)Breachofanyconditionsstipulatedincla(2)Lossofmarket;(3)Misbranding,faultylabels,misdescriptionoftheinsuredgoodsorinthecontractofsaleorother(4)Non-compliancewithanyregulationsofthegovernmentofthecountryoforiginoritsrelevantAuthoritiesonexportedgoods;(5)Embargoorprohibitionhasalreadybeendeclaredbytheimportingcountrybinsuredgoodsleavetheportofshipmentnamedinthepolicy;6.Intheeventoflosswithinthescopeofcover,theInsuredshallnotifythisCompimmediatelyandtakeallpossiblemeasuresasrequiredbythiscompany.AllmeasuressotakenbytheInsuredorbytheCompanyonthegoodsrejectedorcondemnerespectively,asawaiveroranacceptanceofclaim.ThisClauseissubjectotherwisetotheterms,conditionsandexclusionsofthiA37.CONTINGENCYINSURANCECLAUSE(COVERSSELLERS'INTThisinsurancecoversthesellers'contingentinterestinhereundersubjecttotheclausesprintedand/orattachedhereto.Claimsinrespectoflossofordamagetothegoodsshallbepayablehereunderonlyifandtotheextentthatthebuyerfailforsuchlostordamagedgoods.Underwritersaretobesubrogatedtotheassured’srightsagainstthebuyerasotherparties.Anyassignmentofthispolicy,orofanyinterestorClaimhereunder,shalldischargeunderwritersfromallliabilitywhatsoever.ThisClauseissubjectotherwisetotheterms,conditionsandexclusionsofthi保险单中所描述的货物由列明的风险所承保，但本保险只承保A38.BUYER’SINTERESTCOTheGoodsdescribedinthePolicyareinsuredagainsttherisksasspeciInsurancecoversBuyer’sInterestonClaiminrespectoflossofordamagedtothegoodsshallbepayablehereunderonlyifandtotheextentthatthePolicyissuedtosellUnderwriterstobesubrogatedtotheAssuredInsuranceCompany,aswelTheassignmentofthisPolicyorofanyinterestorclaimhereunderisprohibited.ThisinsuranceisnottobedivWarrantedthisdoesnottobedeemedaThisinsuranceshallappfailedtoeffectinsurance,butneverthelessprotectionhereundercoversfortheBuyers＇intereonly,andinnocircumstancesshallbefortheThisinsuranceexcludesinsolvencyandfinancialdefaultabsolut(3)运输途中，被保险人为了保全自身利益，而合理的对该批货物使用留置权或中断其被保险货物的估价将以被保险人每一销售契约中规定的被保险人应采取合理的可行的措施(包括保险公司所要求的措施)以防止或减轻损失和/A39.SELLER’SINTERESTCONisnotobligatedtofurnishoceanmarineinsurance,willbecoveritstermsandconditions,fromthetim(1)thebuyerfailsorrefusestoac(2)thebuyercancelsthecontractpriortoarrivaloftheshipmentsatfinalwarehouse;and/orcontractwhilethegoodsareintransitwhenthisisreasonabletosafeguarcontractofsale.theyareotherwisedisposedof.WarrantedthatthisindeemeddoubleinsurTheAssuredmu
