1.PositionandResponsibilities

(b)Participatinginthecompany'strainingprogramsandimprovingpersonalprofessionalskills;

(c)Maintaininggoodinterpersonalrelationshipswithcolleaguesandprovidingexcellentservicestocustomers.

2.TermofEmployment

2.1ThetermofthisContractshallbe[duration],commencingon[startdate]andendingon[enddate].

2.2TheEmployerandtheApplicantmayagreetoextendthetermofthisContractinwriting,providedthatbothpartiesconsenttotheextension.

3.SalaryandCompensation

3.1TheApplicant'smonthlysalaryshallbe[amount]yuan,payableonthe[date]ofeachmonth.

3.2TheEmployershallprovidetheApplicantwiththefollowingcompensation:

(a)Socialsecurityandhousingfundaccordingtotherelevantlawsandregulations;

4.WorkingHoursandPlaceofWork

4.1TheApplicantshallworkfull-timeintheEmployer'scompany,withaworkinghourof[hoursperday]from[starttime]to[endtime].

4.2TheApplicant'splaceofworkshallbe[location],andtheEmployerreservestherighttochangetheplaceofworkasnecessary.

5.ConfidentialityandNon-Competition

5.1TheApplicantagreestokeeptheEmployer'sbusinesssecretsconfidentialduringandafterthetermofthisContract.

5.2UpontheexpirationorterminationofthisContract,theApplicantagreesnottoengageinanybusinessactivitiesthatcompetewiththeEmployer'sbusinessforaperiodof[duration]aftertheterminationdate.

6.TerminationofEmployment

6.1TheEmployermayterminatethisContractforthefollowingreasons:

(a)BreachoftheContractbytheApplicant;

(b)TheApplicant'sinabilitytoperformthejobduetoillnessordisability;

(c)Otherreasonsasstipulatedbylawsandregulations.

6.2TheApplicantmayterminatethisContractforthefollowingreasons:

(a)TheEmployerviolatesthetermsofthisContract;

(b)TheApplicantisdemotedorreducedinsalarywithoutalegitimatereason;

(c)Otherreasonsasstipulatedbylawsandregulations.

7.DisputeResolution

7.1IncaseofanydisputesarisingfromtheexecutionofthisContract,bothpartiesshalltrytosettlethedisputesthroughfriendlynegotiations.

7.2Ifthedisputescannotbesettledthroughfriendlynegotiations,eitherpartymayfilealawsuitwiththepeople'scourthavingjurisdictionovertheEmployer'splaceofbusiness.

8.Miscellaneous

8.1ThisContractissignedintwocopies,eachpartyholdingonecopy.ThisContractshallbeeffectiveuponthesignatureofbothparties.

8.2ThisContractshallbegovernedbyandconstruedinaccordancewiththelawsofthePeople'sRepublicofChina.

(c)Complywiththerelevantlaborlawsandregulations.

5.ThirdParty'sRightsandObligations

5.1TheThirdPartyhastherightto:

(a)ReceiveafeeforprovidingrecruitmentservicestotheEmployer;

(b)RequesttheEmployertoprovidenecessaryinformationanddocumentsfortherecruitmentprocess.

5.2TheThirdPartyisobligatedto:

(a)ConducttherecruitmentprocessinaccordancewiththeEmployer'srequirements;

(b)ProvidetheEmployerwithqualifiedcandidatesfortheposition;

(c)MaintainconfidentialityoftheEmployer'sbusinesssecrets.

6.Applicant'sRightsandObligations

6.1TheApplicanthastherightto:

(a)ReceiveafairsalaryandbenefitsasagreedinthisContract;

(b)RequesttheEmployertoprovidetraininganddevelopmentopportunities;

(c)SeekredressforanybreachofthisContractbytheEmployer.

6.2TheApplicantisobligatedto:

7.Applicant's违约及限制条款

8.DisputeResolution

4.ServiceProvider'sRightsandObligations

4.1TheServiceProviderhastherightto:

(a)ReceivepaymentfortheservicesrenderedasagreedintheAgreement;

(b)BecompensatedforanyadditionalworkrequiredduetochangesinthescopeofservicesagreeduponbytheClient;

(c)SeekclarificationfromtheClientonanyaspectoftheservicesthatisunclearorsubjecttointerpretation.

4.2TheServiceProviderisobligatedto:

(a)Providetheserviceswiththehighestdegreeofskill,care,anddiligence;

(b)KeeptheClientinformedofanyissuesorchangesthatmayaffectthedeliveryoftheservices;

(c)Complywithallapplicablelawsandregulationsintheperformanceoftheservices.

5.Client's违约及限制条款

5.1IftheClientfailstopaythefeesfortheservicesprovidedbytheServiceProvideraspertheagreed-uponpaymentschedule,theServiceProvidermaysuspendtheservicesuntilpaymentisreceived.

5.2TheClientagreesnottoengageanyotherserviceproviderforthesameservicesduringthetermofthisAgreementwithoutthewrittenconsentoftheServiceProvider.

6.DisputeResolution

6.1IncaseofanydisputesarisingfromtheexecutionofthisAgreement,bothpartiesshallattempttoresolvethedisputesthroughgoodfaithneg
