2025标准版设备租赁合同【中英文版】2025StandardEditionEquipmentLeaseContract(ChineseandEnglishVersion)LeaseAgreementNo.:ThisEquipmentLeaseContract(hereinafterreferredtoasthe"Contract")ismadeandenteredintoon(the"EffectiveDate")byandbetween:Lessor(出租方):NameofLessor(出租方名称):Address(地址):ContactPerson(联系人):PhoneNumber(电话号码):EmailAddress(电子邮箱):Lessee(承租方):NameofLessee(承租方名称):Address(地址):ContactPerson(联系人):PhoneNumber(电话号码):EmailAddress(电子邮箱):Recitals(鉴于条款):TheLessorownsorhasthelegalrighttoleasetheequipmentdescribedbelow(hereinafterreferredtoasthe"Equipment").TheLesseedesirestoleasetheEquipmentforthepurposesof(the"PurposeofUse").TheLessoriswillingtoleasetheEquipmenttotheLesseeunderthetermsandconditionssetforthherein.1.EquipmentDescription(设备描述):TheEquipmenttobeleasedunderthisContractisasfollows:NameofEquipment(设备名称):ModelNumber(型号):SerialNumber(序列号):YearofManufacture(制造年份):ConditionofEquipment(设备状况):AttachmentsandAccessories(附件及配件):2.LeaseTerm(租赁期限):Thetermofthislease(the"LeaseTerm")shallcommenceon(the"CommencementDate")andterminateon(the"TerminationDate"),unlessterminatedearlierinaccordancewiththetermsofthisContract.3.RentandPaymentTerms(租金及支付方式):Themonthlyrent(the"Rent")shallbe(RMB/Cny).TheLesseeshallpaytheRentonamonthlybasis,withthefirstpaymentdueonandsubsequentpaymentsdueonthedayofeachmonththereafter.TheRentshallbepaidtotheLessoratthefollowingaccount:BankName(银行名称):AccountName(账户名称):AccountNumber(账户号码):TheLesseeshallpayallapplicabletaxes,fees,andchargesrelatedtotheEquipmentduringtheLeaseTerm,unlessotherwisespecifiedherein.4.SecurityDeposit(押金条款):TheLesseeshalldepositasecuritydeposit(the"SecurityDeposit")intheamountof(RMB/Cny)withtheLessorassecurityfortheperformanceoftheLessee'sobligationsunderthisContract.TheSecurityDepositshallbereturnedtotheLesseewithindaysaftertheterminationofthisContract,providedthattheEquipmentisreturnedingoodconditionandtheLesseehasfulfilledallobligationsunderthisContract.5.MaintenanceandService(维修与保养):TheLessorshallberesponsibleforthemaintenanceoftheEquipmentduringtheLeaseTerm,exceptfornormalwearandtearcausedby正常使用.TheLesseeshallpromptlynotifytheLessorofanydamageormalfunctionoftheEquipmentandshallnotattempttorepairitwithouttheLessor'spriorwrittenconsent.TheLesseeagreestobearthecostsofanyrepairsormaintenancerequiredduetomisuse,neglect,ordamagecausedbytheLesseeoritsemployees,agents,orcontractors.6.Insurance(保险):TheLessorshallmaintaininsurancecoverageontheEquipment,includingbutnotlimitedtopublicliabilityinsuranceandpropertydamageinsurance,withcoveragelimitsofatleast.TheLesseeshallbenamedasanadditionalinsuredundersuchinsurancepolicies.TheLesseeshallatitsownexpenseobtaininsurancecoverageforitsownrisksassociatedwiththeuseoftheEquipment,includingbutnotlimitedtoliabilityinsuranceanddamageinsurance.7.UseofEquipment(设备使用):TheLesseeagreesthat:TheEquipmentshallbeusedsolelyforthePurposeofUseandinaccordancewiththemanufacturer'sspecificationsandinstructions.TheLesseeshallnottransfer,sublease,orassigntheEquipmentorthisContractwithoutthepriorwrittenconsentoftheLessor.TheLesseeshallnotusetheEquipmentforanyillegalorunauthorizedpurposes.8.EarlyTermination(提前终止):EitherpartymayterminatethisContractbygivingtheotherpartydays'writtennoticeif:TheotherpartybreachesanymaterialtermofthisContractandfailstocuresuchbreachwithindaysafterreceivingwrittennoticethereof.TheEquipmentisdestroyedorrenderedunusableduetofire,accident,orotherunavoidablecircumstances.9.违约责任(违约责任):IfeitherpartyfailstoperformitsobligationsunderthisContract,theotherpartyshallbeentitledto:Requirethe违约partytocurethe违约withindays.TerminatethisContractandrecoverpossessionoftheEquipment.Claimfordamagesforanylossessufferedasaresultofthe违约.10.Notices(通知):Allnotices,requests,demands,orothercommunicationsrequiredorpermittedunderthisContractshallbeinwritingandshallbedeemedtohavebeendulygivenwhen:Deliveredpersonally;orSentbyregisteredorcertifiedmail,returnreceiptrequested,totheaddressoftherespectivepartyassetforthinthisContract.11.GoverningLaw(适用法律):ThisContractshallbegovernedbyandconstruedinaccordancewiththelawsofthePeople'sRepublicofChina.AnydisputesarisingoutoforrelatingtothisContractshallberesolvedthrough友好协商;if协商fails,eitherpartymaybringthematterbeforethe人民法院locatedinforarbitration.12.Miscellaneous(其他条款):ThisContractconstitutestheentireagreementbetweenthepartiesconcerningthesubjectmatterhereofandsupersedesallpriororcontemporaneousunderstandings,agreements,orrepresentations,whetheroralorwritten.AnyamendmentstothisContractmustbemadeinwritingandsignedbybothparties.ThisContractisforthebenefitofbothparties,andnothirdpartyshallhaveanyrightsorobligationshereunder.ThefailureofonepartytoenforceanyprovisionofthisContractshallnotbeconstruedasawaiverofsuchprovisionortherighttoenforcesuchprovisionatalatertime.Inwitnesswhereof,thepartiesheretohaveexecutedthisContractasofthedatefirstabovewritten.Lessor(出租方):Name:Signature:Date:Lessee(承租方):Name:Signature:Date:EnglishVersion:2025StandardEditionEquipmentLeaseContractLeaseAgreementNo.:ThisEquipmentLeaseContractismadeandenteredintoonbyandbetw
