2026年海上集装箱保险协议THISAGREEMENTOFINSURANCE,effectiveasof[StartDate]([EffectiveDate]),ismadebetween[NameofInsurer(s)],withitsprincipalofficeat[Insurer'sAddress],hereinafterreferredtoasthe"Insurer",and[NameofInsured(s)],withitsprincipalplaceofbusinessat[Insured'sAddress],hereinafterreferredtoasthe"Insured".NOW,THEREFORE,inconsiderationofthepremiumstobepaidbytheInsuredtotheInsurerashereinafterprovided,theInsureragreestoinsuretheInsured,subjecttotheterms,conditions,exclusions,andlimitationssetforthinthisAgreementandtheattachedSchedule,ifany,andtheInsuredagreestopaythepremiumsdueunderthisAgreement.1.THISINSURANCECOVERSTHEINSUREDGOODSdescribedinScheduleNo.[ScheduleNumber]attachedhereto,being[DescriptionofGoods,e.g.,Containerizedcargoconsistingof...],beingthereindescribedas"Goods",subjecttothetermsandconditionsofthisAgreement.2.THEPERIODOFINSURANCEshallcommenceat[Time],on[StartDate],andterminateat[Time],on[EndDate],oruponcompletionofthevoyagefrom[PortofLoading],[Country](hereinafterreferredtoasthe"PortofLoading"),to[PortofDischarge],[Country](hereinafterreferredtoasthe"PortofDischarge"),whicheveroccursfirst,providedthevesselengagedisaseagoingvesseloftheclassandtypenormallyusedforthecarriageofgoodsbetweenthePortsofLoadingandDischarge.3.THESUMINSUREDunderthisAgreementshallbe[Amount],[Currency],representing[DescriptionofValuation,e.g.,theinvoicevalueplus10%forfreightandinsurance],withoutdeductionforanyanticipatedoractuallossoranyreductionfortheinsured'sinterestintheGoods.ThissuminsuredshallapplytoeachindividualcontaineranditscontentscoveredbythispolicyunlessotherwisespecifiedintheSchedule.4.THEINSURERshallindemnifytheInsuredagainstlossestoordamagetotheGoodsduringthePeriodofInsurancecausedbyanyoftheperilsofthesea,includingbutnotlimitedto:a)Fireorexplosion;b)Impactbyorcollisionwithanyothervesselorobject;c)Stranding,groundingorsinking;d)Strikes,riots,andcivilcommotions;e)Theft,pilferage,orstranger'sinterference,providedthelossiscertifiedbyasurveyorappointedbytheInsurer;f)Vandalism;g)Heavyweather,includingtempest,storm,gale,andhurricane;h)Packedincontainers:Breakageofpacking,leakage,breakageofcases,andsustainedlossthroughsweatingorcondensation;i)Rain,moisture,and/orsweating,providedthelossiscertifiedbyasurveyorappointedbytheInsurer;j)Freezage,providedthelossiscertifiedbyasurveyorappointedbytheInsurer;k)Accidentsduringloading,unloading,ortransshipment,providedthelossiscertifiedbyasurveyorappointedbytheInsurer;l)Collisionofthecontainerwithloadingorunloadingmachinery,providedthelossiscertifiedbyasurveyorappointedbytheInsurer;m)LossordamagearisingfromtheuseofanydangerousgoodsormaterialsbytheGoods;n)Shortageinquantity,measuredbyweight,certifiedbyasurveyorappointedbytheInsurer;5.THEFOLLOWINGAREEXCLUDEDFROMTHISINSURANCE,WHETHERORNOTOTHERWISECOVEREDBYTHISAGREEMENT:a)LossordamagearisingfromanycausewhatsoeverwhiletheGoodsareinthepossessionoftheshipperatthePortofLoadingortheconsigneeatthePortofDischarge,orwhileintransitbetweentheshipper'spremisesandthePortofLoadingorbetweenthePortofDischargeandtheconsignee'spremises,unlesssuchlossordamagewascausedduringthePeriodofInsurancebyaperilinsuredagainsthereunder;b)Lossordamageresultingfromtheinherentvice,nature,orqualityoftheGoods;c)LossordamageresultingfromtheuseorconsumptionoftheGoods;d)WarRisks,asdefinedintheInstituteWarandStrikesClauses(Crew'sandPassengers'Liabilityexcluded)oranyotherwar,civilwar,rebellion,revolution,insurrection,civilcommotion,oractofterrorism;e)Strikes,Lockouts,andThoroughgoingSabotage,unlesscausedbyastrike,lockout,orsabotageofthecrewofthevesselcarryingtheGoods;f)Theconsequencesofanyactofnuclearfuelorradiationorofanynuclearweaponorothernucleardevice;g)Thedetentionorseizureorforfeitureorrequisitionbyanygovernmentorotherpublicauthority;h)AnylossordamagearisingfromorresultingfromtheneglectoftheInsured,itsagents,oremployees,orfromanylossordamagecausedbyorresultingfromtheuseofanyapparatusorequipmentprovidedbytheInsured,itsagents,oremployees;i)AnylossordamageresultingfromtheneglectoftheInsuredtotake合理的precautionstopreventlossordamage;j)Delayindelivery;k)AnylossordamagearisingfromtheuseoftheGoodsforanypurposeotherthanthatforwhichtheywereintendedbythemanufacturer;l)Lossordamagetothecontaineritself,unlessotherwiseprovided;m)AnylossordamagenotcoveredbytheInstituteCargoClauses(A)or(B)asmaybeapplicablein2026;n)Lossordamageresultingfromcontaminationbychemicalorradiologicalagentsorbyradioactivematerialfromanynuclearfuelorfromanynuclearwastefromtheprocessingofnuclearfuelorfromanynuclearincident.6.THEINSUREDshallbeliableforallpremiumsdueunderthisAgreement.PremiumsshallbecalculatedonthebasisoftheInstituteCargoClauses(A)or(B)asmaybeapplicablein2026,subjecttoanyvariationsagreeduponinwritingbytheInsurerandtheInsured.7.THEINSUREDshallgiveimmediatenoticetotheInsurer,attheInsurer'scost,ofanyloss,damage,orsuspectedtheftorpilferageoftheGoods,andshallaffordtheInsurereveryreasonableopportunitytoascertainthecauseandextentofanysuchloss,damage,orsuspectedtheftorpilferage,andshallexecuteanddeliveralldocumentsandinformationrequiredbytheInsurerinconnectiontherewith.8.THEINSUREDshall,atitsownexpense,employandpayallsurveyors,adjusters,lawyers,agents,andotherpersonsnecessarytoascertainandassessanylossordamage,andtheInsurershallhavetherighttoappointitsownsurveyors,adjusters,lawyers,agents,andotherpersonstoexercisetheInsurer'srightsanddutiesinconnectionwiththelossordamage.AllexpensesincurredbytheInsuredinconnectionwiththelossordamageshallbefortheInsured'saccount,unlessthelossordamageiscausedbyaperilinsuredagainsthereunder,inwhichcasetheInsurershallbeliableforsuchexpensesincurredbytheInsured.9.THEINSUREDshall,atitsownexpense,takeallreasonablemeasurestomitigateorpreventanylossordamagetotheGoods.10.THEINSUREDshallnotbeentitledtoanyclaimunderthisAgreementunlesstheloss,damage,orsuspectedtheftorpilferageoftheGoodsiscausedbyaperilinsuredagainsthereunder.11.THEINSURERshallindemnifytheInsured,withinthelimitsoftheSumInsured,foranylossordamagetotheGoodscoveredbythisAgreement,inaccordancewiththetermsandconditionsofthisAgreement.12.THESETTLEMENTOFCLAIMSshallbemadewithoutdeductionforanyanticipatedoractualloss,andwithoutpaymentofinterest,inthecurrencyspecifiedinClause3,attheInsurer'spremisesoratsuchotherplaceastheInsurermaydesignate.13.THEINSURERshallbeliabletotheInsuredforanylossoccasionedbyitsfailuretoperformanyoftheobligationssetforthinthisAgreement,butthetotalliabilityoftheInsurerunderthisAgreement,whetherinrespectofanyoneclaimorallclaimsarisingtherefrom,shallnotexceedtheSumInsuredspecifiedinClause3.14.THISAGREEMENTconstitutesthe
