2026年渔业船舶租赁服务合同范本英文ThisLeaseAgreement(the"Agreement")ismadeandenteredintoasof[InsertDate],byandbetween[Lessor'sFullLegalName]("Lessor"),havingitsprincipalplaceofbusinessat[Lessor'sAddress],and[Lessee'sFullLegalName]("Lessee"),havingitsprincipalplaceofbusinessat[Lessee'sAddress].RecitalsWHEREAS,Lessorownsandpossessesafishingvessel,hereinafterreferredtoasthe"Vessel",suitableforfishingactivities;WHEREAS,LesseedesirestoleasetheVesselfromLessorforaspecifiedperiodforthepurposeofconductingfishingoperations;WHEREAS,LessordesirestoleasetheVesseltoLesseeunderthetermsandconditionssetforthherein;NOW,THEREFORE,inconsiderationofthemutualcovenantsandagreementssetforthherein,thepartiesagreeasfollows:1.VesselDescriptionTheVesselbeingleasedisdescribedasfollows:VesselName:[InsertVesselName],FlagState:[InsertFlagState],IMONumber:[InsertIMONumber],MMSI:[InsertMMSI],Dimensions:[InsertLengthxBreadthxDepth],GrossTonnage:[InsertGrossTonnage],NetTonnage:[InsertNetTonnage],EnginePower:[InsertEnginePower],HullMaterial:[InsertHullMaterial],withequipmentincludingbutnotlimitedto[Listkeyfishinggear,navigationinstruments,communicationequipment,livingquarters],asmoreparticularlydescribedintheVesselPlansreferencedhereinandintheconditionupondeliveryasmutuallyagreedupon.2.LeaseTermTheLeaseTermshallcommenceon[InsertStartDate]andendon[InsertEndDate],unlessterminatedearlierinaccordancewiththeprovisionsofthisAgreement.EitherpartymayhavetheoptiontorenewtheLeaseTermforafurtherperiodof[InsertNumber][InsertUnit,e.g.,monthsoryears]upon[InsertConditionsforRenewal,e.g.,60days'priorwrittennotice]at[InsertTermsforRenewal,e.g.,amutuallyagreedrent].3.PermittedUseTheVesselshallbeusedsolelyforcommercialfishingactivitiesinaccordancewithapplicablelawsandregulations,specificallywithinthefishinggroundsdesignatedorpermittedby[Insertrelevantauthority,e.g.,coastalstatelawsorinternationaltreaties],andshallnotbeusedforanypurposewhatsoeverthatisinconsistentwithitscharacterasafishingvessel,includingbutnotlimitedtotransportationofnon-fisherygoodsforprofit,unauthorizedfishingmethods,oranyactivityprohibitedbylaw.4.CrewArrangement[Insertdetailsofcrewarrangement:e.g.,"LessorshallprovideafullyqualifiedandexperiencedcrewtooperateandmaintaintheVesselduringtheLeaseTerm."or"Lesseeshallarrangeforandbefullyresponsiblefortherecruitment,paymentofwages,socialsecurity,insurance,andoverallmanagementofthecrewrequiredtooperatetheVesselduringtheLeaseTerm,ensuringallcrewmemberspossessvalidcertificatesandareauthorizedtosailundertheVessel'sflag."]5.BunkersandFuelFuelshallbesuppliedby[Insertpartyresponsible,e.g.,Lessor].Thequantityoffuelsuppliedshallbemeasuredinaccordancewithstandardmarinemeasuringpracticesusing[Insertmethod,e.g.,soundingsormeters].Thecostoffuelshallbepaidby[Insertpartyresponsible]atapriceof[Insertpriceperunit,e.g.,$Xpermetricton]basedonthequantityconsumedbytheVessel'sengine(s)duringtheLeaseTerm.Fuelshallcomplywithallapplicableenvironmentalstandards.6.RentandPaymentThemonthlyrentfortheVesselshallbe[InsertAmount][InsertCurrency].Rentshallbepayableinadvanceonthe[Insertday,e.g.,first]dayofeachmonthduringtheLeaseTerm,payabletoLessorat[InsertLessor'sBankAccountDetails].Latepaymentofanyrentamountshallincuraninterestchargeof[InsertRate]%perannumontheoverdueamountfromtheduedateuntilpaymentisreceived.7.CostAllocation除租金之外，以下费用由[Insertpartyresponsibleforeachitem,e.g.,Lessor,Lessee,orsharedasspecified]承担：(除租金之外，以下费用由[Insertpartyresponsibleforeachitem,e.g.,Lessor,Lessee,orsharedasspecified]承担)：Crewwagesandsocialsecuritybenefits(ifLessorprovidescrew);Vesselinsurancepremiums;Portdues,towage,andothernavigationrelatedcharges;Routinemaintenanceandrepairs;Fishinggearconsumables;Environmentalcompliancecosts;[Insertanyotheragreed-uponcosts].DetailedbreakdownandpaymentmechanismforsharedcostsshallbeagreeduponinwritingbytheParties.8.SecurityDepositPriortothecommencementoftheLeaseTerm,LesseeshallpaytoLessorasecuritydepositintheamountof[InsertAmount][InsertCurrency],tobedepositedinto[InsertBankAccountDetails].Thisdepositisintendedtocoveranyunpaidrent,damagestotheVesselbeyondnormalwearandtear,orotherlossesincurredbyLessorduetoLessee'sbreachofthisAgreement.ThedepositshallbeheldbyLessorforthedurationoftheLeaseTermplus[InsertNumber]monthsthereafter.UponterminationoftheLeaseTerm,providedLesseehasfulfilledallitsobligationsunderthisAgreement,includingpaymentofallduerentanddamages,thedepositshallbereleasedtoLesseewithin[InsertNumber]daysoftheendoftheLeaseTerm.9.VesselInsuranceLessorshallmaintainatalltimesduringtheLeaseTermcomprehensiveinsurancecoveragefortheVessel,includingbutnotlimitedtoHullInsurance,CrewLiability,FishingOperationLiability,andEnvironmentalLiability,withaggregatelimitsofnotlessthan[InsertMinimumLimitAmount][InsertCurrency]peroccurrence,coveringallrisksoflossordamagetotheVesselandliabilityforthird-partyclaims.LessorshallprovideLesseewithcertifiedcopiesoftheinsurancepoliciesuponrequest.Lesseeshallbefullynotifiedofanychangeintheinsurancepolicy,includingcancellationormaterialmodification.10.MaintenanceandRepairsLessorshallberesponsibleforthemaintenanceandrepairoftheVessel'shull,superstructure,mainengine,auxiliaryengines,andallnavigationandcommunicationequipmenttokeeptheVesselinagenerallygoodstateofrepairsuitableforitsintendedfishingusethroughouttheLeaseTerm.Lessorshallberesponsibleforallcostsassociatedwithsuchmaintenanceandrepairs.LesseeshallberesponsibleforthemaintenanceandrepairoffishinggearandanyotherequipmentinstalledbyLessee.BothPartiesshallcooperateinnecessaryrepairsandshallprovidereasonablenoticetoeachotherregardingplannedmaintenancethatrequiresvesseldowntime.11.DeliveryandReturnTheVesselshallbedeliveredtoLesseeat[InsertDeliveryPort]onoraround[InsertDeliveryDate],inaseaworthyconditionandinaccordancewiththespecificationssetforthherein.Atdelivery,ajointinspectionshallbeconducted,andalistoftheVessel'sconditionshallbesignedbybothParties.UponexpirationorterminationofthisAgreement,LesseeshallreturntheVesselto[InsertReturnPort]within[InsertNumber]days,inthesameconditionasatdelivery,exceptfornormalwearandtear,reasonabledepreciation,anddamagecausedbyLessee'suseornegligence.LesseeshallberesponsibleforallcostsassociatedwiththeVessel'sreturnandrefuelingunlessotherwiseagreed.12.BreachofContractIfanyPartyfailstoperformanyobligationunderthisAgreement,thenon-breachingPartyshallhavetheright,inadditiontoanyotherremediesavailable,tosuspendfurtherperformanceunderthisAgreementand/orterminatethisAgreementupon[InsertNumber]days'writtennoticetothebreachingPartyifthebreachisnotcuredwithinsuchperiod.Theconsequencesofspecificbreaches,suchasfailuretopayrent,unauthorizeduse,orsignificantdamagetotheVessel,shallbedetailedinthisSectionandinSection17.13.DisclaimerofLiabilityandLimitationofLiabilityEachPartyshallnotbeliabletotheotherPartyforanylossofprofit,lossofuse,lossofmarket,orotherconsequentialorindirectlossarisingoutoforinconnectionwiththisAgreement,exceptasexpresslyprovidedherein.EachParty'stotalliabilityunderthisAgreement,whetherincontract,tort,orotherwise,shallbelimitedtotheaggregateamountoftheSecurityDepositpaidbyLessee.14.ForceMajeureNeitherPartyshallbeliableforanyfailureordelayinperformingitsobligationsunderthisAgreementifsuchfailureordelayiscausedbyForceMajeure,definedaseventsbeyondthereasonablecontroloftheaffectedParty,includingbutnotlimitedtoactsofGod,war,terrorism,riots,civilcommotion,strikes,governmentalactions,andnaturaldisasters.TheaffectedPartyshallpromptlynotifytheotherPartyofanysucheventandtakeallreasonableeffortstomitigateitseffects.15.NoticesAllnotices,requests,demands,andothercommunicationsrequiredorpermittedunderthisAgreementshallbeinwritingandshallbedeemedgiven:(a)whendeliveredpersonally;(b)uponconfirmationofreceiptwhensentbyemail;(c)onebusinessdayafterdepositwithanationallyrecognizedovernightcourierservice;or(d)threebusinessdaysaftermailingbyregisteredorcertifiedmail,returnreceiptrequested,postageprepaid.AllnoticesunderthisAgreementshallbeaddressedtothePartiesattheaddressessetforthintheRecitalsortosuchotheraddressaseitherPartymaydesignatebynoticetotheotherinwriting.16.GoverningLawandDisputeResolutionThisAgreementshallbegovernedbyandconstruedinaccordancewiththelawsof[InsertJurisdiction,e.g.,theStateof[State]andfederallawsoftheUnitedStatesthereof].Anydispute,controversy,orclaimarisingoutoforrelatingtothisAgreement,includingitsbreach,termination,orinvalidity,shallfirstbeattemptedtoberesolvedamicablythroughgoodfaithnegotiationsbetweentheseniormanagementoftheParties.Ifthedisputecannotbesettledwithin[InsertNumber,e.g.,30]daysfromtheinitiationofnegotiations,thedisputeshallbefinallysettledby[InsertArbitration,e.g.,arbitrationinaccordancewiththeRulesofArbitrationofthe[InsertArbitrationInstitution,e.g.,InternationalChamberofCommerce]tobeheldin[InsertCity,Country],withthe仲裁languagebeingEnglish,orbylitigationinthecourtsof[InsertJurisdictionspecifiedinSection16]inwhichtheLessorhasitsprincipalplaceofbusiness.17.EntireAgreementThisAgreement,includingtheAppendicesifany,constitutestheentireagreementbetweenthePartiesconcerningthesubjectmatterhereofandsupersedesallprioragreements,negotiations,andunderstandings,whetheroralorwritten,betweenthePartiesrelatingtothesubjectmatterof
