时工作制。(3)Flexibleworkinghoursystem:Uponapprovalbythelaboradministrativedepartment,PartyB'spositionshallimplementaflexibleworkinghoursystem.第六条(Article6)甲方保证乙方每周至少休息一日。PartyAensuresthatPartyBhasatleastonerestdayperweek.第七条(Article7)甲方依法安排乙方带薪年休假、婚假、产假、丧假等法定节假日和休假，具体标准按照国家及地方有关规定执行。PartyAshallarrangeforPartyBtoenjoypaidannualleave,marriageleave,maternityleave,bereavementleaveandotherstatutoryholidaysandleavesinaccordancewiththelaw.Thespecificstandardsshallbeimplementedinaccordancewithrelevantnationalandlocalregulations.四、劳动报酬(LaborRemuneration)第八条(Article8)乙方正常工作时间的工资标准（试用期满后）为人民币____元/月（大写：____）。工资组成包括：基本工资____元，岗位工资____元，绩效工资____元（或其他形式，请具体说明：____）。或/OR乙方正常工作时间的工资标准（试用期满后）为人民币____元/小时。PartyB'swagestandardduringnormalworkinghours(aftertheprobationperiod)isRMB____perhour.甲方每月____日（遇节假日顺延）以货币形式（或银行转账方式）足额支付乙方工资。甲方支付乙方的工资不得低于当地最低工资标准。PartyAshallpayPartyB'swagesinfullinmonetaryform(orbybanktransfer)onthe____dayofeachmonth(postponedincaseofholidays).ThewagespaidbyPartyAtoPartyBshallnotbelowerthanthelocalminimumwagestandard.第九条(Article9)甲方安排乙方延长工作时间的，按《劳动法》第四十四条的规定支付延长工作时间的工资报酬。IfPartyAarrangesPartyBtoworkovertime,itshallpayovertimewagesinaccordancewiththeprovisionsofArticle44ofthe"LaborLaw".第十条(Article10)非因乙方原因造成甲方停工、停产，未超过一个工资支付周期的，甲方应按本合同约定的工资标准支付乙方工资；超过一个工资支付周期的，若乙方提供了正常劳动，则支付给乙方的劳动报酬不得低于当地最低工资标准；若乙方没有提供正常劳动，甲方应按国家有关规定计发生活费。IfPartyAsuspendsworkorproductionnotduetoPartyB'sreasons,andtheperioddoesnotexceedonewagepaymentcycle,PartyAshallpayPartyBwagesaccordingtothewagestandardagreedinthisContract;ifitexceedsonewagepaymentcycle,ifPartyBhasprovidednormallabor,thelaborremunerationpaidtoPartyBshallnotbelowerthanthelocalminimumwagestandard;ifPartyBhasnotprovidednormallabor,PartyAshallissuelivingexpensesinaccordancewithrelevantnationalregulations.五、社会保险和福利待遇(SocialInsuranceandWelfareBenefits)第十一条(Article11)甲乙双方必须依法参加社会保险（包括养老保险、医疗保险、失业保险、工伤保险、生育保险），甲方按国家和地方政府规定的标准为乙方缴纳社会保险费，乙方个人应缴纳的部分由甲方从其工资中代扣代缴。Bothpartiesmustparticipateinsocialinsuranceinaccordancewiththelaw(includingendowmentinsurance,medicalinsurance,unemploymentinsurance,work-relatedinjuryinsurance,andmaternityinsurance).PartyAshallpaysocialinsurancepremiumsforPartyBinaccordancewithnationalandlocalgovernmentregulations,andthepartthatPartyBshallpaypersonallyshallbewithheldandpaidbyPartyAfromhiswages.第十二条(Article12)乙方患病或非因工负伤，其医疗期待遇和病假工资按国家及地方有关规定执行。IncasePartyBsuffersfromanillnessornon-work-relatedinjury,hismedicaltreatmentperiodandsickleavewagesshallbeimplementedinaccordancewithrelevantnationalandlocalregulations.第十三条(Article13)乙方患职业病或因工负伤的，其待遇按照国家及地方有关规定执行。IncasePartyBsuffersfromanoccupationaldiseaseorwork-relatedinjury,histreatmentshallbeimplementedinaccordancewithrelevantnationalandlocalregulations.第十四条(Article14)甲方根据本单位经济效益及乙方的工作业绩、贡献大小，可给予乙方相应的福利待遇，具体办法由甲方依法制定。PartyAmayprovidePartyBwithcorrespondingwelfarebenefitsaccordingtotheeconomicbenefitsoftheunitandPartyB'sworkperformanceandcontribution.ThespecificmeasuresshallbeformulatedbyPartyAinaccordancewiththelaw.六、劳动保护、劳动条件和职业危害防护(LaborProtection,WorkingConditionsandOccupationalHazardProtection)第十五条(Article15)甲方必须建立健全劳动安全卫生制度，严格执行国家劳动安全规程和标准，对乙方进行劳动安全卫生教育，为乙方提供符合国家规定的劳动安全卫生条件和必要的劳动防护用品，改善劳动条件。PartyAmustestablishandimprovethelaborsafetyandhealthsystem,strictlyimplementnationallaborsafetyregulationsandstandards,conductlaborsafetyandhealtheducationforPartyB,providePartyBwithlaborsafetyandhealthconditionsandnecessarylaborprotectionarticlesinaccordancewithnationalregulations,andimproveworkingconditions.第十六条(Article16)甲方对可能产生职业病危害的岗位，应当向乙方履行如实告知的义务，并对乙方进行劳动过程中的防护。Forpositionsthatmayproduceoccupationalhazards,PartyAshallfulfilltheobligationoftruthfulnotificationtoPartyBandprovideprotectionforPartyBduringthelaborprocess.第十七条(Article17)乙方在劳动过程中必须严格遵守安全操作规程。乙方对甲方管理人员违章指挥、强令冒险作业，有权拒绝执行。PartyBmuststrictlyabidebythesafetyoperationproceduresduringthelaborprocess.PartyBhastherighttorefusetoexecuteifthemanagementpersonnelofPartyAgiveillegalinstructionsororderriskyoperations.七、规章制度(RulesandRegulations)第十八条(Article18)甲方依法制定的各项规章制度（包括但不限于员工手册、岗位职责、劳动纪律、绩效考核、保密制度、奖惩办法等）作为本合同的附件，与本合同具有同等法律效力。乙方应认真阅读并严格遵守。VariousrulesandregulationsformulatedbyPartyAinaccordancewiththelaw(includingbutnotlimitedtoemployeehandbook,jobresponsibilities,labordiscipline,performanceappraisal,confidentialitysystem,rewardandpunishmentmeasures,etc.)areattachedasannexestothisContractandhavethesamelegaleffectasthisContract.PartyBshallreadthemcarefullyandstrictlyabidebythem.甲方有权根据国家法律法规及自身经营管理需要，对规章制度进行修改和完善，修改后的规章制度应向乙方公示或告知，公示或告知后对乙方具有约束力。PartyAhastherighttomodifyandimprovetherulesandregulationsaccordingtonationallawsandregulationsanditsownoperationandmanagementneeds.ThemodifiedrulesandregulationsshallbepublicizedornotifiedtoPartyB,andshallbebindingonPartyBafterpublicityornotification.八、劳动合同的变更、解除、终止和续订(Modification,Termination,TerminationandRenewalofLaborContract)第十九条(Article19)本合同的变更、解除、终止和续订，按照《中华人民共和国劳动合同法》及相关法律法规的规定执行。Themodification,termination,terminationand
