4.1GENERALPROVISIONS4.1.1GeneralIntroductiontotheProjectGeneralIntroductionThisprojectconsistsofconstructionsofSino-GermanFriendshipBuilding,Students’CanteenandStudents’ApartmentinXXNormalUniversity.(1)TheSino-GermanFriendshipBuilding(2)TheStudents’Canteenisa10.5metershighframe-structuredconstructionoftwostoreysabovethegroundandonebelowtheground,whosebuildingareais10,081squaremeters.(3)TheStudents’Apartmentisa23.65metershighsix-storeybuilding.Itslowerpartisframe-structuredwhileitsupperpartisbrick-and-concretestructure.Itsbuildingareais19,603squaremeters.ClimateandHydrologicCondition(1)ClimateXXlocatesineasternpartofHenanProvince,sharingboundarywithotherthreeprovinces,namelyShandongProvince,JiangsuProvinceandAnhuiProvince.Itrangesfrom114°49′-116°39′Eand33°43′-34°52′N.ItisonepartoftheHuang-Huai-HaiPlaininNorthChina.Itis30-70metersabovesealevel.AlltheriversinXXleadtoHuaiheRiver.XXisinthewarm-temperatesub-humidcontinentalmonsoonclimatezone,andtherefore,itiswarmandwindyinspring,hotandrainyinsummer,coolandsunnyinautumn,andcoldanddryinwinter.TheannualaveragetemperatureinXXisbetween13.9℃-14.3℃.Theextremelowesttemperatureis-23.4℃,whiletheextremehighesttemperatureis43.6℃.Thereare2200-2500hoursofsunshineand212frost-freedaysineachyearinXX.Theaverageannual(2)HydrologicConditionThesiteisintheYellowRiveralluvialplainarea,andinthewarm-temperatemonsoonclimatezone.Thesurveyandinvestigationshowsthatthemainsupplyoftheshallowgroundwaterofthisareaislateralrun-offandrainfall,anditsdrainagedependsonevaporationandlateralrun-off..TopographyandGeology(1)TopographyTheareaoftheproposedconstructionistopographicallyflat.Themaximumelevationofeachexplorationportholeis0.08m,andtheminimumelevationis-0.29m.Themaximumrelativeelevationis0.37m.ThesiteofproposedSino-GermanFriendshipBuildinginXXNormalUniversityisintheYellowRiveralluvialplainarea,belongingtoalluvialsedimentofQuatemaryHolocene(2)GeologyAccordingtotheseismicfortificationintensityofChina’smaincitiesandtownssetin”AppendixA”inCodeforSeismicDesignofBuilding(GB50011-)(edition),XX’sseismicfortificationintensityis6,itsseismicclassificationisinthefirstgroup,anditsbasicseismicaccelerationis0.05g.AccordingtoStandardforClassificationofSeismicFortificationofBuildingConstructionsandconsideringtheimportanceofthefunctionoftheproposedconstruction,theseismicfortificationclassificationofthisconstructionshouldbeC-class.Thebasicseismicintensityofthesiteofthisprojectis6,andtherefore,theearthquakeactionandearthquakeresistantconstructionshouldmeetthedemandofseismicfortificationinthisarea..DistributionofBuildingMaterialThisdependsonthelocalcondition.TransportationXXNormalUniversityisinXXcity,about200kmfromZhengzhoucity.Thereisairharbour,railwayandhigh-standardhighwayinthisarea.XXlocatesintheeasternpartofHenanProvince.SharingboundarywithShangdongProvince,JiangsuProvinceandAnhui4.1.2ContractItemsandScopeofWork(1)Themainconstructionprojectsinthisbidsectionareprescribedintheprovision(Article1,item5)oftheparticularcontract.ThemainconstructionquantitycanbefindinChapter6inRenderingDocument.(2)Thecontractorshouldcarryout,completeandmaintainthemainconstructionofthebidsectionheundertakesinaccordancewiththerenderingdrawings,contractterms,technicalregulationandthedetailedlistofconstructionquantity,andthecontractorshouldberesponsibletobuildsometemporaryconstruction.4.1.3DrawingsOfferedbyProjectEmployer(1)DrawingsinRenderingDocumentTherenderingdrawingsinChapter10Drawingsinrenderingdocumentareofferedfortheuseofbiddingperiod.(2)DrawingsforConstructionDrawingsforconstructionshouldbereadtogetherwiththistechnicalspecificationandthewritteninstructionsfromprojectsupervisor.Areportshouldbesenttotheprojectsupervisorinwrittenformwhenmistakesorambiguousexpressionsarefound,andthesupervisorshouldreplyinwrittenforminsevendays.Projectsupervisorshouldofferthecontractoreightcopiesoftheformalblueprintdrawingsofthemainconstructioninthecontract.(3)PlanofOfferingDrawingsProjectsupervisorwillofferthecontractordetaileddrawingsforconstructionin14daysafterthecontractissigned.4.1.4DrawingsandDocumentsOfferedbyContractor(1)Thecontractorshouldsubmitdrawings,designdata,testresult,constructionsampleandnecessarytextualdescriptionthatarerequiredinconstruction(shortfordrawingsanddocuments)onscheduletotheprojectsupervisor.Drawingsanddocumentsshouldnotbecontradictorywitheachother.Allthedocumentssubmittedformallyshouldbesignedorsealedbyauthorizedrepresentativeofthecontractor.In7daysafterthecontractissigned,thecontractorshouldofferatimetableofsubmittingallkindsofdrawingsanddocuments(inquadruplicate)toprojectsupervisorforapproval.Drawingsanddocumentsshouldbesubmittedinsequencelistedinthetimetable.Thenecessarydrawingsanddocumentsshouldbesubmitted14daysbeforetheconstructionstarts,unlessotherwisespecifiedbythecontractandtheprojectsupervisor.(2)DrawingsandDocumentsforConstructionManagementandDesignIn14daysafterthecontractissigned,thecontractorsendthedrawingsanddocumentsoftheprojectconstructionmanagementanddesign(inquadruplicate)includingconstructionschedulemadeupbykeycircuitnetworktoprojectsupervisorforinvestigationandapproval.Thedrawingsanddocumentssubmittedbycontractorshouldbedetailed,sothattheprojectsupervisorcaninvestigatethecontractor’sdoingsinbuildingthemainconstruction,suchas,generalarrangement,aggregatescheduling,constructionprocedure,,mainconstructionmethodsandmeasures,mainconstructionequipmentsandmaterialplanning,labourforceplanningandsafetyprecautions,andsoon.Ingeneralconstructionarrangement,theboundaryandareaoftheconstructionshouldbemarked:builder’sroads,constructionadministration’slocationandregion,eachconstructionsite’slocationandareaandtheareaoflivingquarters.Theoccupiedareaofconstructioninthegeneralconstructionarrangementshouldbelimitedintheareadefinedbyprojectemployerorprojectsupervisor.(3)DrawingsandDocumentsofPreparatoryConstruction:thecontractorshouldsubmitthemaindrawingsanddocumentsofpreparatoryconstructionincludingthearrangementanddesignandnecessarytextualdescriptionofconstructionarea,domesticinstallation,andconstructionwarehouse(inquadruplicate)toprojectsupervisorforapproval.(4)ExaminationandApprovalofDrawings:theprojectsupervisorhastherighttodecidewhetherhewillexaminethedrawingsanddocumentssubmittedbycontractorornot,excepttheseitemsthatmustbeapprovedbyprojectsupervisoraccordingtothecontract.Projectsupervisorshouldputforwardjudgmentsandgivethembacktothecontractorin7daysafterreceivingthesedrawingsanddocuments.Thejudgmentscanbe”approved”,”revisededitionapproved”,”revisionandre-submit”or”disapproved”.In7daysafterreceivingdrawingsanddocumentswithjudgmentsas”revisionandre-submit”or”disapproved”,thecontractorshouldrevisethemandre-submittoprojectsupervisorforexamination.(5)Contractor’sResponsibilitytoOfferingDrawingsandDocuments(a)Thecontractormustsubmitdrawingsanddocumentsinquadruplicatetoprojectsupervisorforexamination.Theremustbespecialblanksforapprovalsandsuggestionsoneachdrawinganddocument.Aftertheexaminationandapproval,projectsupervisorshouldgivebackonecopyofdrawingsanddocumentsthataresignedwith”approved”,”revisededitionapproved”.Thecontractorshouldsubmitadditionaldrawingsanddocumentsinquadruplicatewhenhereceivesdrawingsanddocumentswithjudgmentas”revisededitionapproved.”(b)Aftertheprojectsupervisor’sapproval,thecontractoralsoneedstore-submitdrawingsanddocumentsforapprovalwhenhehastomodifythemreasonably.(c)Whenthecontractorcannotsubmitdrawingsanddocumentsintime,heshouldtakealltheresponsibilityofdelayinconstructionandextracostofconstruction.(d)Accordingtothecontract,somedrawingsanddocumentsmustbeapprovedbyprojectsupervisor,andonlywhenprojectsupervisorsigns”approved”or”revisededitionapproved”onthem,thecontractorcanstartconstructioninaccordancewiththem.Thecontractorshouldnotclearhisresponsibilityoraskprojectemployerforadditionalcostonthereasonthatprojectsupervisorapprovesandexaminesthesedrawingsanddocumentsorprojectsupervisorputsforwardrevisingsuggestions.(e)Projectsupervisorhasrighttoaskthecontractortoaddandre-submitwhentheprojectsupervisorbelievesthedrawingsanddocumentssubmittedbythecontractorarenotcompletedindesigningcalculation,dataordrawings.(6)CostandPaymentTheprojectemployerwillnotseparatelypayforthecostofthedrawingsanddocumentssubmittedbycontractor,whichshouldbeincludedintheofferedpriceofthedetailedlistofconstructionquantity.4.1.5ImplementationofProjectSchedule(1)TimeofEmployer’sOfferofConstructionArea:Thetimewhenbid-winningnoticeissendisthetimewhentheprojectemployerofferstheconstructionarea.(2)Thecontractormustentertheareaandstartconstructionin14daysafterthecontractissigned.(3)Project’sImplementationPlan:(a)Theimplementationtimeoftheprojectinthiscontract:Startingdateofthisproject:seeArticle18incontract;Completiondateofthisproject:seeArticle18incontract.(4)SubmitConstructionSchedulePlan(a)Thecontractorshouldsubmitdetailedconstructionplanandschemetoprojectsupervisorinordertoprovethattheconstructioncanbefinishedbeforethecompletiondate.Thoughprojectsupervisorapprovestheplanandscheme,thecontractor’sresponsibilityinthiscontractcouldnotgetanyexemptionbecauseofprojectsupervisor’sapprovalofhisconstructionplanandscheme.(b)In14daysafterthecontractissigned,thecontractorshouldsubmit(inquadruplicate)detailedschedulethatcancompletetheconstructionprojectontimetoprojectsupervisorforapproval,withkeyrouteofprojectscheduleanddetailedexplanationsoftheconstructionscheduleofeachsubdivisionalproject.Itshouldincluderequiredconstructionquantity,consumptionofmaterials,labourarrangement,andarrangementofmaterials’supplyineachsubdivisionalperiod.Besides,thecontractorshouldsubmittheproject’smonthlyscheduletoprojectsupervisorontimeasitisprescribedinthecontract(c)Thecontractorshouldsubmittheconstructionscheduleoffollowingmonthfivedaysbeforetheendofeachmonth,whichshouldincludeplannedconstructionquantity,consumptionofmaterials,labourarrangement,purchasingplanofmaterialsandequipments,andsoon.Thecontractorshouldsubmitthesedrawingsanddocuments(inquadruplicate)toprojectsupervisorforexaminationandapproval,andtheprojectsupervisorshouldreleaseawrittennoticein7daysafterreceivingeachmonthlyschedule.(d)Thecontractorshouldhandinaconstructionscheduleimplementationreport(inquadruplicate)ofprecedingmonthbeforethefifthdayineachmonth,andthereportshouldbeaccompaniedwithproperexplanationsandfigurativediagramoftheconstructionprogress.Theconstructionscheduleimplementationreportshouldincludeallthefollowingpointsatleast:◆Completedconstructionquantityincludingpreparatoryprojectandaccumulatedcompletedconstructionquantity;◆Actualpurchasing,consumptionandstorageofmaterials;◆StatisticTotalstermbytermandpercentageofeachmonth’saccumulatedamountoftheabovetwopoints;◆Purchasingandarrangementforuseofequipments;◆Figurativeprogressofimplementation;◆Factorsthatdelayedorwillpossiblydelayimplementationprogress,andmeasuresthatwillbetakentogetridofthesefactorsandre-realizetheplannedimplementationprogress.4.1.6CooperationwithotherContractors(1)Allthecontractorofthiscontractshouldfullyrealizethatallthepublicserviceofthisprojectmaybeusedtogetherbyseveralcontractors.Whenthereisinterference,thecontractorsshouldinformprojectsupervisorandfollowhisarrangementandorders.(2)Thecontractorsshouldcooperatewithprojectemployerandhelphimtodogeologicalrecordingworkwell.Whenthecontractordrawsuptheirimplementationschedule,heshouldconsiderprojectemployer’sgeologicalrecordingwork.(3)Allthedelegatesshouldsignonthemeetingsummarythatformedinthecoordinationmeetinghostedbyprojectemployerorsupervisorduringconstructionimplementation.Dissentingopinionscouldbereportedinthemeetingsummary,butwhendecisionsaremadeinthemeeting,allthecontractorsshouldfollowthem.(4)BesidescompletionoftheconstructionprescribedinArticle8inthecontract,allthecontractorsshouldalsoensuretheprogressbalanceandcoordinationinthejointedplaceoftheprojectinthecontractunderthedirectionsofprojectsupervisors.(5)Thecontractorshouldprovideneedfulconditionsunderthesupervisor’sdirectionsforothercontractors’worksinthesameconstructionareaorinnearbyareathatarerelatedtotheproject.Anothercontractcanbesignedaboutthecontentandcostofprovidingconditionsundersupervisor’scoordination,unlessthereisrelatedtoprovisionsinthecontract.Ifanagreementcannotbemade,theprojectsupervisorhasrighttomakeadecisionandalltherelatedsidesshouldfollowit.(6)CostAllthecostinthecoordinationwithothercontractorsshouldbeincludedintheofferedpriceofthedetailedlistofconstructionquantity,andtherefore,theprojectsupervisorwillnotpayforitseparately.Costwillbepaidforin28daysafterprojectsupervisor’sconfirmationandpermissioninspecialcircumstances.4.1.7ConstructionSafetyandProtection(1)Contractor’sresponsibilityofsafetyandprotection(a)In14daysafterconstructionstarts,contractorshouldformadocumentofsafetyprotectivemeasuresinprojectconstructionandsendittoprojectsupervisorforexaminationandapproval,andthisdocumentshouldincludethesettingofsafetyoffice,theequipmentsofprofessionals,andsafetyprotectivemeasuresoffire-proofing,gas-defense,noise-proofing,floodcontrolling,medicalaids,alarming,publicsecurity,demolitionsandexplosivemanagement,etc..Thedocumentofsafetyprotectivemeasuresshouldalsoincludeidentificationofmajorhazardandrelevantmeasures,safetyprotectionandfirecontrolofficeandnamelistofmembers,leadinggroupofemergencyandnamelistofmembers.Theplanofsafetyprotectivemeasuresmustbesenttosupervisorforapprovalandthencarryoutfollowingit.Planofspecialtechnicalsafetymeasures:Thecontractorshouldmakeupaplanofspecialtechnicalmeasuresintimeaccordingtorelevantprovisions.Theplanincludestowercranefoundation,installationandremovaloftowercrane,deepfoundationpit,supportsystemofhighformwork,andsoon.Theplanshouldbesenttoqualitysafetysupervisionstationforrecordaftertheprojectsupervisorapprovesit.Facingverygreatdeepfoundationpitandultrahighformworksupportingsystem,theprojectsupervisor(inaccordancewithspecialprovisions)shoulddecidewhetheritneedsexperts’demonstration.(b)Thecontractorshouldstrengthenworkers’constructionsafetyeducationanddistributethehandbookofsafetyandprotectionprintedaccordingtotheabovepointtoallthestaff.Theworkersshouldtakepartinanexaminationorassessmentbeforetheystarttheirconstructionworkandonlythequalifierscangettowork.(c)ThecontractorshouldfollowChina’srelevantsafetyregulations.Whenthereisgreatsafetyaccidentinacontractor’sareaofoperations,heshouldinformtheprojectemployerimmediatelyandsubmitawrittenreportoftheaccidentconditionstoprojectemployerin24hoursaftertheaccidenthappens.(d)Thecontractorshouldstrengthensafetyinspectionofdangerouswork,andestablishparticularinspectingofficeequippedwithsuffice,qualifiedprofessionalsafetyinspectors.Intheperformanceofthecontract,thecontractorshouldbeinchargeoftheprojectsafetyandprovideandcontinuouslykeepagroupofcapablesafetyguardstotakechargeofthesafetywork.Intheperformanceofthecontract,duringworkingandnon-workinghoursincludingnightandholidays,thedutyofthissafetygroupshouldinclude,butarenotlimitedto,keepingconstructionareainorder,providingallthemeansthatthesafetyprotectiveworkneedsforlighting,guardsandflagmeninlivingquartersandsomeotherareaontheconstructionarea,andensuingthesafetyofallthematerialsandequipmentsontheconstructionareaandallthepeopleemployedforconstruction.(2)LabourProtectionThecontractorshoulddistributenecessarylabourprotectionsupplies(includinghelmet,watershoes,raincoat,glove,lantern,protectivemask,safetybelt,etc.)totheworkersonconstructionareaatregularintervals,inaccordancewiththerulesinChina’sNationalLabourProtectionLaw.Besides,thecontractorshouldalsodistributelabourprotectionallowanceandnourishmentsubsidytoworkersofspecialprofessionsaccordingtoLabourProtectionLaw.(3)LightingforSafetyUnlessthereisdifferentinstructionfromprojectsupervisor,thecontractorshouldfollowrelevantprovisionsandmakesurethatthereisenoughbrightnessonconstructionarea.Theso-called”enoughbrightness”heremeansthelightingisbrightenoughtoensurethatconstructioncanbefinishedaccordingtodrawingsandtechnicalspecification.Thecontractorshouldalsoberesponsibletothesupply,installation,andmaintenanceofthelightingfacilitiesintheoutdoorplaceonworkers’campandalongtheroadsinhischarge.(4)Fire-ControllingThecontractorshouldequiptheconstructionareawithfire-controllingoperatorsandenoughfirefightingequipments.Thecontractorshouldtakesufficefire-controllingmeasurestoensuethesafetyofthewholestaffandtemporaryorpermanentproject,andtakeactionstopreventlossanddamagebecauseoffireoftrees.Thefire-fightingequipments’modelandpowershouldsatisfytheneedoffirecontrolling,andthefire-controllingoperatorsshouldbefamiliarwithfire-fightingandbewell-trained.Thefire-controllingequipmentsshouldbeexaminedandmaintainedfrequentlyinordertokeepthemingoodconditions.Whenthecontractorsubmitsconstructionmanagementanddesign,heshouldalsosubmitareportoffire-controllingmeasuresandplanincludingabovepointstoprojectsupervisorforexaminationandapproval.Thecontractorshouldalsoofferfire-controllingtrainingandorganizefire-controllingexercise.Besidessafetyeducationandtrainingofconstructiongroupandworkers,andsafetytechnicaldisclosure,thecontractorshouldalsoholdsafetymeetingsregularly.Theconstructionareashouldbeequippedwithsafetyandfire-controllingsigns.(5)CostandPaymentThecostofconstructionsafetyandprotectionshouldbeincludedineachunitcost,andtherefore,theprojectemployerwillnotpayforitseparately.4.1.8EnvironmentalManagementandCivilizedConstruction(1)ThecontractorshouldobeyandexecuteAdministrativeProvisionsofCostandOperationofConstructionProjectSafetyProtectionandCivilizedConstruction
