劳务派遣合同协议书（中英文版）ContractAgreementforLaborDispatch(Chinese-EnglishVersion)甲方（派遣单位）：PartyA(DispatchingUnit):公司名称：[公司全称]CompanyName:[FullCompanyName]法定代表人：[法人姓名]LegalRepresentative:[NameofLegalRepresentative]地址：[公司地址]Address:[CompanyAddress]联系电话：[联系电话]ContactNumber:[ContactNumber]乙方（用工单位）：PartyB(EmployingUnit):公司名称：[公司全称]CompanyName:[FullCompanyName]法定代表人：[法人姓名]LegalRepresentative:[NameofLegalRepresentative]地址：[公司地址]Address:[CompanyAddress]联系电话：[联系电话]ContactNumber:[ContactNumber]鉴于甲方具有合法从事劳务派遣的资质，乙方因业务需要拟使用甲方派遣的员工，根据《中华人民共和国劳动合同法》及相关法律法规的规定，甲乙双方经平等自愿、协商一致，就劳务派遣事宜达成如下协议：WhereasPartyAhasthelegalqualificationtoengageinlabordispatch,andPartyBintendstousetheemployeesdispatchedbyPartyAduetobusinessneeds.InaccordancewiththeprovisionsoftheLaborContractLawofthePeople'sRepublicofChinaandrelevantlawsandregulations,PartyAandPartyB,throughequality,voluntarinessandconsensus,havereachedthefollowingagreementonlabordispatchmatters:一、派遣员工的基本信息I.BasicInformationofDispatchedEmployees甲方按照乙方要求派遣的员工信息见附件一《派遣员工名单》。TheinformationofemployeesdispatchedbyPartyAinaccordancewithPartyB'srequirementsisshowninAnnex1"ListofDispatchedEmployees".二、派遣期限II.DispatchPeriod本劳务派遣协议期限自[起始日期]起至[结束日期]止。其中，试用期为[试用期时长]，自派遣员工实际到岗之日起计算。Thetermofthislabordispatchagreementshallbefrom[StartDate]to[EndDate].Amongthem,theprobationperiodis[DurationofProbationPeriod],calculatedfromtheactualdatewhenthedispatchedemployeetakesupthepost.三、工作内容和工作地点III.WorkContentandWorkLocation1.甲方派遣乙方的员工到乙方从事[具体工作岗位]工作，工作内容按照乙方的岗位职责要求执行。1.TheemployeesdispatchedbyPartyAtoPartyBshallengageintheworkof[SpecificWorkPosition]atPartyB,andtheworkcontentshallbecarriedoutinaccordancewithPartyB'sjobresponsibilityrequirements.2.工作地点为[具体工作地点]。若乙方因业务需要调整工作地点，应提前通知甲方，并与派遣员工协商一致。2.Theworklocationis[SpecificWorkLocation].IfPartyBneedstoadjusttheworklocationduetobusinessneeds,itshallnotifyPartyAinadvanceandreachaconsensuswiththedispatchedemployees.四、工作时间和休息休假IV.WorkingHours,RestandLeave1.派遣员工的工作时间按照乙方的规定执行，乙方应确保派遣员工每周至少休息一天。1.TheworkinghoursofdispatchedemployeesshallbeimplementedinaccordancewithPartyB'sregulations.PartyBshallensurethatdispatchedemployeeshaveatleastonedayoffperweek.2.派遣员工享有国家规定的法定节假日、婚假、产假、丧假等休息休假权利，具体休假办法和待遇按照乙方的规定执行。2.Dispatchedemployeesshallenjoytherightstorestandleavesuchaslegalholidays,marriageleave,maternityleave,andbereavementleaveasstipulatedbythestate.ThespecificleavemethodsandbenefitsshallbeimplementedinaccordancewithPartyB'sregulations.五、劳动报酬V.LaborRemuneration1.甲方按照乙方确定的薪酬标准，每月[具体支付日期]以货币形式支付派遣员工的工资。工资标准不低于当地最低工资标准。1.PartyAshallpaythewagesofdispatchedemployeesincurrencyonthe[SpecificPaymentDate]ofeachmonthinaccordancewiththesalarystandarddeterminedbyPartyB.Thesalarystandardshallnotbelowerthanthelocalminimumwagestandard.2.若派遣员工在乙方工作期间加班，乙方应按照国家规定支付加班工资，甲方负责将加班工资发放给派遣员工。2.IfdispatchedemployeesworkovertimeduringtheirworkatPartyB,PartyBshallpayovertimepayinaccordancewithnationalregulations.PartyAisresponsiblefordistributingtheovertimepaytodispatchedemployees.六、社会保险和福利待遇VI.SocialInsuranceandWelfareBenefits1.甲方按照国家和地方规定为派遣员工缴纳各项社会保险费用，包括养老保险、医疗保险、失业保险、工伤保险和生育保险。派遣员工个人应缴纳的社会保险费由甲方代扣代缴。1.PartyAshallpayvarioussocialinsurancepremiumsfordispatchedemployeesinaccordancewithnationalandlocalregulations,includingendowmentinsurance,medicalinsurance,unemploymentinsurance,workinjuryinsuranceandmaternityinsurance.ThesocialinsurancepremiumspayablebydispatchedemployeespersonallyshallbewithheldandpaidbyPartyA.2.派遣员工在乙方工作期间，享有乙方提供的与工作岗位相关的福利待遇，具体福利项目和标准由乙方确定。2.DuringtheperiodwhendispatchedemployeesworkatPartyB,theyshallenjoythewelfarebenefitsrelatedtotheworkpositionsprovidedbyPartyB.ThespecificwelfareitemsandstandardsshallbedeterminedbyPartyB.七、劳动保护、劳动条件和职业危害防护VII.LaborProtection,WorkingConditionsandOccupationalHazardProtection1.乙方应为派遣员工提供符合国家规定的劳动安全卫生条件和必要的劳动保护用品，建立健全生产工艺流程，制定操作规程、工作规范和劳动安全卫生制度及其标准。1.PartyBshallprovidedispatchedemployeeswithlaborsafetyandhealthconditionsandnecessarylaborprotectionarticlesinlinewithnationalregulations,establishandimprovetheproductionprocess,andformulateoperatingprocedures,workspecifications,laborsafetyandhealthsystemsandtheirstandards.2.乙方对可能产生职业病危害的岗位，应当向派遣员工履行如实告知的义务，并做好职业危害防护工作。2.Forpositionsthatmaycauseoccupationaldiseasehazards,PartyBshallfulfilltheobligationoftruthfullynotifyingdispatchedemployeesanddoagoodjobinoccupationalhazardprotection.八、员工的培训与管理VIII.TrainingandManagementofEmployees1.甲方负责对派遣员工进行入职前培训，包括但不限于劳动法律法规、职业道德、安全生产等方面的培训。1.PartyAisresponsibleforconductingpre-employmenttrainingfordispatchedemployees,includingbutnotlimitedtotraininginlaborlawsandregulations,professionalethics,worksafety,etc.2.乙方负责对派遣员工进行工作岗位所需的技能培训，并对派遣员工在工作期间进行日常管理和考核。乙方应将考核结果及时反馈给甲方。2.PartyBisresponsibleforprovidingskillstrainingrequiredfortheworkpositionsofdispatchedemployeesandconductingdailymanagementandassessmentofdispatchedemployeesduringtheirwork.PartyBshallpromptlyfeeXXacktheassessmentresultstoPartyA.九、合同的解除和终止IX.TerminationandCessationoftheContract1.经甲乙双方协商一致，可以解除本合同。1.ThiscontractcanbeterminateduponconsensusreachedbyPartyAandPartyBthroughconsultation.2.有下列情形之一的，甲方可以与派遣员工解除劳动合同：2.PartyAmayterminatethelaborcontractwithdispatchedemployeesunderanyofthefollowingcircumstances:（1）派遣员工在试用期内被证明不符合录用条件的；(1)Thedispatchedemployeeisprovednottomeettheemploymentconditionsduringtheprobationperiod;（2）派遣员工严重违反乙方规章制度的；(2)ThedispatchedemployeeseriouslyviolatesPartyB'srulesandregulations;（3）派遣员工严重失职、营私舞弊，给乙方造成重大损害的；(3)Thedispatchedemployeeisseriouslyderelictinduty,engagesinmalpracticeforpersonalgain,andcausessignificantdamagetoPartyB;（4）派遣员工被依法追究刑事责任的；(4)Thedispatchedemployeeisinvestigatedforcriminalliabilityaccordingtolaw;（5）法律法规规定的其他情形。(5)Othercircumstancesstipulatedbylawsandregulations.3.本合同期满或者双方约定的终止条件出现时，本合同自行终止。3.Thiscontractshallterminateautomaticallywhenthetermofthiscontractexpiresortheterminationconditionsagreedbybothpartiesoccur.十、违约责任X.LiabilityforBreachofContract1.甲乙双方应严格履行本合同约定，如一方违约给对方造成损失的，违约方应承担赔偿责任。1.PartyAandPartyBshallstrictlyperformtheprovisionsofthiscontract.Ifonepartybreachesthecontractandcauseslossestotheotherparty,thebreachingpartyshallbeartheliabilityforcompensation.2.若甲方未按照约定为派遣员工缴纳社会保险费用，导致派遣员工无法享受相应社会保险待遇的，甲方应承担赔偿责任。2.IfPartyAfailstopaysocialinsurancepremiumsfordispatchedemployeesasagreed,resultingindispatchedemployeesbeingunabletoenjoycorrespondingsocialinsurancebenefits,PartyAshallbeartheliabilityforcompensation.3.若乙方未按照约定支付劳动报酬或提供劳动条件，导致派遣员工权益受损的，乙方应承担赔偿责任，甲方应协助派遣员工向乙方追偿。3.IfPartyBfailstopaylaborremunerationorprovideworkingconditionsasagreed,resultingindamagetotherightsandinterestsofdispatchedemployees,PartyBshallbeartheliabilityforcompensation,andPartyAshallassistdispatchedemployeesinrecoveringcompensationfromPartyB.十一、争议解决XI.DisputeResolution甲乙双方在履行本合同过程中发生争议，应首先通过友好协商解决；协商不成的，任何一方均有权向有管辖权的人民法院提起诉讼。AnydisputesarisingbetweenPartyAandPartyBduringtheperformanceofthiscontractshallberesolvedfirstthroughfriendlyconsultations.Iftheconsultationsfail,eitherpartyhastherighttofilealawsuitwiththepeople'scourthavingjurisdiction.十二、其他条款XII.OtherProvisions1.本合同未尽事宜，按照国家和地方有关法律法规执行，或由甲乙双方协商一致后签订补充协议。补充协议与本合同具有同等法律效力。1.Mattersnotcoveredinthiscontractsha
