30、）乙方平均每周工作四十小时；（2）甲方因工作需要，安排乙方加班的，甲方按照国家有关规定给予乙方加班费或补休；（3）乙方因自身原因（如未能按时完成工作等情况下）需加班加点的，应事先征得甲方书面同意。乙方经甲方同意后加班的，甲方按照国家有关规定给予乙方加班费或补休；乙方未获甲方同意而自行延长工作时间的，不享受加班工资或补休等待遇。2、乙方为实行不定时工时制或综合工时制的员工，鉴于乙方工作性质而不享受加班工资或补休待遇，除非法律另有规定或双方另有约定。四、劳动报酬1、按甲方现行工资制度，在试用期间，乙方月工资为人民币元，试用期结束后，乙方月工资为人民币 元。甲方于下月15日前发放乙方上月工资。2、乙

31、方的奖金、津贴，按甲方有关考核规定规定支付（详见附件）。3、乙方认为，在甲方实行新的工资制度，或者甲方根据对乙方的工作绩效考核结果调整乙方工作岗位、职务时，甲方应当相应调高或降低乙方的工资待遇。4、甲方按月支付给乙方工资，乙方必须按照国家规定申报并缴纳个人所得税。五、社会保险、福利待遇1、乙方享有中国政府规定的法定节假日、公休假日和婚丧假等有薪假期，有薪假期待遇按国家或地方规定。在法定假日因甲方工作需要加班的，乙方依法享有相应待遇。2、根据中华人民共和国劳动法的相关规定，甲方在下列节日期间应当依法安排乙方休假：（1）元旦；（2）春节；（3）国际劳动节；（4）国庆节；（5）法律、法规规定的其他休

32、假节日。六、劳动保护、劳动条件和职业危害防护1、甲方执行国家有关劳动保护规定和标准，并根据乙方从事的工作岗位和有关规定，发给必要的劳动保护用品。2、甲方对乙方进行必要的安全生产培训、操作规程培训以及其他业务技术培训。乙方应参加上述培训并严格遵守有关的安全生产法规、规章、制度和操作规程。3、乙方有权拒绝甲方的违章指挥。4、乙方应当严格遵守甲方的安全工作制度，安全、规范地完成工作任务。七、劳动纪律1、乙方在甲方工作期间，应当严格遵守国家法律、法令，严格遵守甲方制定的各项规章制度（包括但不限于员工守则、规章制度等），对于前述规章制度，乙方确认在签定本合同之同时，已知晓并理解前述制度中的全部内容。乙方

33、应忠于职守、履行职责、诚实可靠、作风正派、服从管理，积极完成甲方赋予的各项工作任务。2、乙方违反甲方规章制度的，甲方有权按照相关规定予以相应处罚，直至解除本合同。3、尊重中国人民的道德规范和风俗习惯。八、乙方承诺1、乙方保证已与原用人单位依法解除劳动合同或劳动关系。2、乙方保证其向甲方提供的所有信息、资料、证明等均属真实、有效，否则甲方有权解除与乙方之间的合同关系，并不给予乙方任何经济补偿。九、保守商业秘密1、甲方的行销策略，计划，财务报表，人事档案，薪资及雇聘记录，会计资料，库存管理，客户名单，电脑程序及资料库，生产程序及物流图，标准作业程序，产品规格，员工训练资料等技术信息或商业信息，不论

34、以书面图表或电脑磁盘等形式存在，均属甲方商业秘密；2、乙方明白上述各项甲方甲方商业秘密的定义和范围，乙方承诺不得私自保留、影印、使用或者提供给他人，亦不得以任何直接或间接的方式侵害甲方的商业秘密。3、乙方承诺，不得将非执行工作任务所必需的任何甲方的设备、产品、文件、电脑资料等携带出甲方公司。4、在乙方为甲方工作期间，如一经查实乙方有上述行为的，甲方可立即将乙方开除，并可按中华人民共和国不正当竞争法之相关规定要求乙方进行赔偿，直至追究其刑事责任；在乙方与甲方解除或终止劳动关系之后，如一经查实乙方有上述行为的，甲方有权依法要求乙方进行赔偿，直至追究其刑事责任。5、前款所述“赔偿”范围，包括但不限于：（1）乙方因侵权而获得的利益，或甲方因被侵权而造成的损失；（2）甲方为制止与乙方有关的侵权行为和追究侵权者责任而生产的调查取证费用、诉讼费用、律师费用等。十、劳动合同的解除1、双方均应严格履行本合同。2、乙方符合下列情形之一的，甲方可以解除本合同，并不给予任何经济补偿：2.1在试用期内被证明不符合录用条件的；2.2严重违反用人单位的规章制度的；2.3严重失职、营私舞弊，对甲方利益造成重大损害的；2.4
