基层犯罪论文：湖南L县农村基层干部职务犯罪问题调查【中文摘要】农村基层干部直接面对群众,村干部就是党和政府形象的代表者,老百姓从他们的一言一行中来认识、评价党和政府的形象。然而我国农村基层一直以来因为监管不到位、管理制度漏洞多而成为职务犯罪的高发点。目前对于农村基层干部职务犯罪问题的研究者和成果是大多为实务部门的法律工作者,在实践中根据当地司法状况而提出的一些区域性的研究和对策。在司法实践中,对农村基层干部职务犯罪定性不清楚,处罚不当甚至无法处罚,由此引起一些农民因村干部的违规行为得不到法律惩处而反复上访甚至爆发群体性事件的恶劣后果。严重影响的国家机关的正常工作秩序和农业生产、农民生活,造成了社会的不稳定因素,破坏了社会和谐,同时也制约了农村经济快速发展。因此,对不同地区的农村基层干部职务犯罪问题,应当有针对性的进行研究,分析其成因并制定相应对策,以缓解目前干群关系紧张的局面,维护整个社会的和谐、促进社会经济的可持续发展。首先,明晰什么人的何种行为才属于农村基层干部职务犯罪行列。其次,通过对大量案件的数据分析明确在统计地区农村基层干部犯罪所呈现出来的某些特点。最后,则是应从犯罪学和社会学等多种角度考虑,制定切实有效的法律监督措施和社会监管措施,有效预防和追查农村地区新职务犯罪出现。本文提出:首先,对湖南中部地区L县的全部已诉刑事案件进行了统计,对其中涉及到农村基层干部的部分职务犯罪进行了具体的阅卷。在对相应数据分析和排列组合后制作出表格,分析其中的特点,总结规律。进而发现在该地区农村基层干部职务犯罪所存在的普遍因素和个别因素。其次,通过对数据的分析和研究,发现了在该地区农村基层干部职务犯罪产生了一定的演变。主体由过去的党支部书记、村委会主任、村秘书、会计、出纳等职位上的干部单干演变成了由这些人牵头进行“团伙作案”。犯罪持续的时间也更长,部分人员以“少食多餐”作为掩护,长期从事职务犯罪活动。另外,随着经济条件的好转,在引诱干部走向的犯罪道路上,赌博成为了新的重大诱因。建议在未来的刑法中明确关于农村事务中公务行为、个人行为、集体行为等多种情况的标准或规定。对农村基层的日常村务活动以省为单位制定和推行模板管理制度,由当地村民自主选择模板管理制度中应当增删的相关条列。同时,作为社会监管的组成部分,推行网络到村。提高农村基层的精神文明建设,加强农村基层干部文化修养的提高,从内因上解决诱发犯罪提高的多种因素。【英文摘要】Grass-root cadres in villages serve the masses directly. Thus village officials represent the Party and the Government. From their words and behaviors, people know and judge our Party and Government. However, crimes by taking advantage of duty have commonly happened because of defective supervision and management system to the grass-root cadres. At present, the researches and achievement of such crimes to the grass-root cadres are mostly from lawyers of judicial departments of Practice. They come up with some regional studies and solutions according to the local justice conditions. In legal practices, there is no clear qualitative description to this kind of crime. As a result, some criminals can not be properly punished for their illegal behaviors or even not. Therefore, some villagers repeatedly petition higher authorities for help and even organize mass disturbances because of the illegal behavior of the village officials, which seriously disturbs the order of the government, agriculture production and villagerslife, brings instability to the society, breaks the harmony of our country, and sets back the development of rural economy. In this case, to post crimes from different regions, we should do relevant researches, and make corresponding strategies after analyzing their causes to ease the strained relationship between the officials and the mass, keep the harmonious society, and promote the substantial development of the economy. First, we should judge what kind of behavior from what kind of person belongs to post crime from grass-root cadres in villages. Second, through data analysis of a large number of cases, we can figure out some specific characteristics from such kind of crimes in the relevant regions. Finally, in terms of criminology, sociology and etc, we can work out efficient legal and social supervision measures to prevent and investigate those crimes alike.In this paper, firstly, all the criminal cases of L county in the middle area of Hunan province are calculated, among which about post crime of grass-root cadres in villages have been carefully studied. A chart has been made according to data analysis, permutation and combination. After studying the features of the chart, the prevalent and particular factors of post crimes in this region are found. Secondly, according to data analysis, the author finds that some changes have taken place in post crimes of this county. In the past, village officials, such as party branch secretary, head of villagers committee, secretary, accountant and cashier, committed post crime by themselves; however, gradually, those officials conspire with a gang. The criminal activities last longer. Under the guise of the principle of“eating small meals often”, some criminals engage in long-term crimes abusing power. Besides, as economy improves, gambling as a new major factor tempts officials to commit crimes.The author suggests that the standards and regulations of official behavior, personal behavior, and collective behavior in rural affairs should be clearly defined in future criminal laws. Management system patterns of daily rural affairs should be established and promoted in province. Local villagers can choose certain regulations in the management system patterns. In the meantime, internet , as one part of social supervision system, should be brought into villages.
