硕士学位论文 m a s t e r s t h e 戤s 中文摘要 与文学翻译理论与实践所取得的成果相比，法律翻译方面的研究在我国还处于 起步阶段，其研究的范围与所取得的成果远远不能适应当代我国社会经济的发展， 不能跟上我国全球化进程的步伐。随着我国进一步融入国际社会，准确地翻译我国 法律，向国外介绍我国的法律法规，让外企了解我国的各项规章制度，变得不仅十 分必要而且非常紧迫，而要做好这项工作就必须做好法律文本翻译理论研究。本 文选取汉语立法文本中出现频率最高的“的”字短语作为研究的重点，期盼该研究对 促进我国法律翻译研究的繁荣与发展能有所帮助。 “的”字短语作为汉语立法文本所独有的一种特殊的句法结构，具有浓厚的民族 色彩。它起源于古汉语立法文本中常用的“者”字句，随着历史的发展慢慢演化而来。 “的”字短语省掉了中心词，但却具有名词的各种性质与功能，能在立法条文中充当 主语、宾语或状语，能使立法文本语言精练准确，具有法律语言的特色。“的”字短 语具有在汉语立法文本中提出假设、表类别与贬义、意义不指定以及信息储藏量大 等特点，这些特点是我们翻译时必须注意的重点，在目的语中必须予以再现。 功能翻译理论是本文分析的理论基础。其强调“目的决定手段：指出在翻译中所 使用的各种翻译策略与方法都是由翻译目的所决定的；文本类型的差异决定了翻译 目的的不同，汉英转换过程中译者必须注意篇内和篇际的连贯，原文文本体裁必须 在译文中完整地再现，所有这些努力都是为实现源语和目的语的功能对等，都是为 实现翻译目的。 本文论证了功能翻译理论对立法文本翻译具有指导意义，并且把它运用到对 “的 字短语的英译研究中。研究表明，“的”字短语英译的各种现象都可以用功能翻 译理论予以解释。把“的”字短语英译为状语从旬或介词短语是为了在立法文本中提 出和强调假设；译为名词性从句是为了再现“的”字短语的表类别和贬义、意义不指 定以及信息储藏量大等特点；译为非谓语动词是为了实现源语和目的语之间的题材 一致：译为补充主语式是因为“的”字短语省略了中心词，充当句子成分，为克服英 汉两种语言的差异，在翻译时调整的结果。这一切都论证了功能翻译理论对汉语立 法文本英译分析的适用性。 本文在利用功能翻译理论对“的”字短语英译单个分析的基础上，同时从整体上 对“的”字短语的英译也进行了评论，指出其英译中的诸多不足。首先，“的”字短语的 各类英译都只是在局部功能上与源语对等，在局部上再现了源语的特点，也就是说 硕士学位论文 m a $ t e r st 腿s l s 每种英译与源语都是部分对等的关系，都只是实现了翻译源语的部分目的，但部分 不等于整体，部分之和也不等于整体，所以同“的”字短语拥有多种不同英译的现 象，违背了科技型文体翻译所要求的译名同一原则。还有从文体上看“的”字短语的 翻译，可见译文中所使用的语言都比较简明，这与英美国家法律语言冗长的特点不 相符，其原因在于对目的语读者定位不足，而最终还是由“的”字短语的文化专属性 以及翻译目的的不同所造成的。 本文属于个案研究，所采用的研究方法是规定性与描写性相结合，其中以规定
