武汉理t = 人学硕十学位论文 中文摘要 随着全球化和中国加入w t o ，为了吸引更多外资和游客，中国有必要向国外 推广中国的法律，同时也应对国外的法律有更多的了解。在此种情况下，法律 翻译至关重要。 众所皆知，精确是法律语言的一个重要要求。如果法律语言不精确，对法 律的诸多误解将会产生，个人利益会造成损失，社会进步也会随之受阻。尽管 如此，我们仍可以在法律条文中找到许多模糊表达。另外，人们在法庭上使用 的语言也没有我们想象得那样具体。这种现象看似存在矛盾，而如何应对法律 英语中出现的这种矛盾，成了法律翻译工作中的一个重大难题。 1 9 5 6 年，美国加利福尼亚大学的资深教授l a z a d e h 介绍了著名的模糊 理论，指出现实世界的事物通常没有明确的界限。从某种程度而言，法律英语 中的模糊性使法律法规更具精确性和可操作性。尽管国内外的学者在法律领域 有大量研究，但很少有从语用学角度处理法律英语翻译中该矛盾现象的研究。 因此，传统的法律英语翻译策略面临极大挑战，因为它忽视了其功能性和灵活 性，几乎不可能解决翻译过程中的具体问题。 在这篇论文中，笔者着手于分析法律英语的模糊性和精确性，并在保持其 实用性的立场上提出翻译策略。法律英语翻译中，保证模糊性和精确性问的“辩 证统一 已成为处理该问题不可缺少的方法。在论文的第一章中，笔者在分析 模糊性产生的原因和必要性之前基于模糊理论介绍法律英语中的模糊性；在第 二章中，主要从语意和句法两个方面来强调法律英语的精确性；第三章介绍翻 译理论和其相关的翻译策略，主要是有关处理模糊性及精确性的翻泽策略；在 第四章中，笔者提出与传统的翻译策略作对比的“辩证统一”翻译策略，强调 法律英语翻译中模糊和精确的平衡。 总而言之，该研究的意义在于如何巧妙地处理法律英语中看似存在的模糊 和精确之问的矛盾以及恰当的翻译策略在实际中的运用，希望能给普法工作贡 献一点绵薄之力。由于时间和笔者知识面的局限性，该研究不能触及到问题的 方方面面。在将来的研究中，笔者势必将更加专注于法律翻译中模糊性和精确 性在理论上的发展和实践中的应用。 关键词：模糊性，精确性，法律英语，翻译策略 武汉理j ：人学硕十学位论文 a b s t
