税收信用等同于税收诚信，将税收信用与财政信用、银行信用等信用形式相 2 内容摘要 并列、相对应、相混同；有人认为纳税信用等同于税收诚信，缩小了税收诚 信的范畴；还有人界定了税收诚信的内涵，但失之偏颇地认为税收诚信主体 是由纳税人、征税入、用税人三部分构成。针对上述三种观点，论文提出税 收诚信是国家在参与一部分社会产品或国民收入分配和再分配的一系列经济 活动中，各主体基于内心的自我约束而作出的符合社会规范，并以实现各主 体问责权利平衡为最终目标的税收实践活动。税收诚信包括主观诚信和客观 诚信，税收诚信的主体由纳税主体及关联人、征税主体及关联人、用税主体 及关联人、税收中介及关联人四部分构成。 观点二：重新审视了我国税收诚信机制缺失的原因。现有的研究成果， 在分析税收诚信机制缺失的原因时，基本上是分别从各个主体的自身找原因， 难免存在着“头痛治头，脚痛治脚”，缺乏系统的、深入分析。笔者认为还可 以从各主体之间的联系以及制度根源等方面寻找原因，因而，论文从税收诚 信主体之间的“责、权、利”分配失衡、涉税制度的供给失当、体制的转型 三个方面，重新审视了我国税收诚信机制缺失的深层次原因。其中从制度供 给角度，指出当前涉税相关制度的供给不足、相关制度供给过剩、制度安排 显失公正以及内外制度失衡是税收诚信缺失的重要原因。 观点三：从管理学和法学的角度研究税收诚信机制，视角新颖。论文以 管理领域的激励理论与法学领域的威慑理论作为理论依托，以正式、非正式 制度作为税收诚信机制存在形式，建设性地构建了税收诚信机制的理论框架， 具体包括：税收诚信宣传机制、税收诚信实现机制、税收诚信评价机制、税 收诚信保障机制、税收诚信循环运行机制等几个方面。 观点四：重新构建了税收诚信主体之间的责、权、利关系。目前税收诚 信主体之问的“责、权、利”分配失衡，严重制约了我国税收诚信机制的构 建。论文通过重新构建税收诚信主体之间的责、权、利关系，调整“诚信监 督权”的流向，实现纳税主体及关联人、征税主体及关联人、用税主体及关 联人、税收中介及关联人之间制约关系的均衡。 本文的不足之处主要体现在以下几个方面： 1 论证的广度、深度不足。税收诚信机制的构建是一个综合系统的工程， 涉及内容广袤庞杂，加之本人理论素养、知识结构、实践经验、资料收集、 、研究方法的局限，论文内容有待拓展，论证的广度、深度有进一步加强。 3 我国税收诚信机制的构建研究 2 实证分析的不足。目前中国税收诚信机制的构建正处于摸索阶段，各地 经济发展、制度建设、推行条件都存在一定的差异，鉴于本人时间、精力、 信息等多方面的限制，不能一一调研，提出的税收诫信机制的构建对策，其 针对性和适用性难免有所影响。
