试论立法语篇及其翻译 摘要 事实上，法律翻译实践在国内外历史悠久。但是，无论在法学领域还是在 翻译领域，针对法律翻译的系统研究却远远不够，至今，法律翻译在译学研究 领域仍未获得独立分支的学科地位。作为法律语言学主要研究内容之一的法律 翻译，包括口译和笔译，在国内外政治、经济生活中将起到同益重要的作用。 法律翻译不仅需要翻译者谙熟国内外程序法、实体法及其体系，还需从宏观和 微观的语用原则两方面掌握法律语言的特点。因此，根据法律翻译的基本要求， 分析法律语言特点对法律翻译的影响也是翻译界的一个重要的研究课题。 法律翻译历来被认为是对译者要求最为苛刻的一类翻译，但是随着法律翻 译理论和实践的发展，法律翻译者正在逐步改变过去所扮演的被动角色，在翻 译过程中拥有了更大的主动性和自由度，甚至成为法律的共同起草者。本文结 合中西方多语立法国家的法律翻译理论与实践，在翻译过程中对法律语言特 点、法律言语行为、普通翻译与法律翻译的差异性以及当前法律翻译理论界以 及翻译实践中存在的严峻的实际问题进行了较为深入的分析和探讨。 本文共分六章。首先，对法律翻泽的历史阶段、主旨以及具体翻译方法做 了简要的说明。根据法理学传统分类方法，对法律进行了简单的分类。其次， 为保证立法语言的权威性、庄严性和强制性，通过国内外大量立法语言的系统 分析，总结归纳出立法语言的宏观语用原则。本文又从法律翻译的角度探讨文 本类型和法律文本的内在规律和特点。再次，论述法律翻译与普通翻译理论的 差异性，重点探讨了c a t f o r d 、n i d a 、v e r m e e r 等翻译学家倡导的普通翻译理 论能否实际应用于法律翻译领域并取得期望效果，以及法律翻译目标的重新定 位等理论问题。文中指出并详尽地讨论了当前法律翻译理论界以及翻译实践中 存在的实际问题，并重点探讨了可译性的限度问题和归化、异化在法律翻译中 的具体应用。最后，从法理学和哲学的角度，对法律翻译中相互矛盾的精确性 和模糊性进行了辨证的分析，在法律翻译中力求最佳结合点，采取适当的翻译 策略，以保证翻译的质量。 关键词：法律翻译，法律语言，法律言语行为，法理学，文本类型， 可译性 o nl e g i s
