土地使用权流转合同(Land use rights transfer contract)甲方First party.: 乙方Party b:: 经各方友好协商,本着平等、自愿、有偿、诚实信用原则,The parties through friendly consultation, adhering to the principle of equality, voluntary, compensation, honesty and credit,就土地使用权流转事宜达成协议如下:On the right to use land transfer agreement as follows:一、地块概况(A, plot overview)1、该地块位于the site is located in 土地面积为Area of land 平方米(折 亩).Square meters (fold acres) .2、现该地块的用途为农业用地。the land use for agricultural land.二、转让方式means of conveyance ;1、乙方保证通过土地使用权转让形式把该地块转让给甲方,土地用途为农业及相关产业。Party B shall ensure the transfer of land use rights to the land mass transfer form to the party, the land use for agriculture and related industries.2、土地使用权的转让价位 元/亩(每年),转让总价为人民币 元。Land use rights transfer price yuan / mu (year), the transfer price is rmb.3、该土地流转后由甲方独立运作,盈亏自负。The transfer of land by the Party of independent operation, self-financing4、土地流转的期限为 年 月 日至 年 月 日。The deadline for the land transfer5、土地使用权流转费交付方式为每一年度一次,每年第 月份,甲方将土地使用权流转费用打入乙方指定账户。Land use right transfer fee is to be paid for each a year, every year the month, Party A will be the transfer of land use rights fees into the designated account of Party B.三、甲、乙双方的及义务A, B both sides and obligation甲方First party:1、甲方在土地租凭期限,有权处置土地一切的经营事务;Party A in the land lease term, have the right to dispose of land all business affairs;2、有权在农作物收获完成后,给予土地良好改良,以便于来年更好耕作;Right in the harvest is completed, the granting of land good improvement, in order to facilitate the next better farming;3、甲方在土地租凭期间,不能改变其土地用途,应合法经营。Party A in the land lease period, can not change the land use, should be legitimate business.乙方Party b: :1、在土地流转租凭期限,不能参与土地任何的经营活动;In the transfer of land lease term, not in the business of any of the land;2、在土地流转租凭期限,乙方不能在每年土地收获完成后,在其上放牧等活动出现,因甲方在此期限需给土地进行相关的改良活动,如:大干、培肥、平整等。In the transfer of land lease term, Party B can not be completed in the year after harvest in the land, grazing activities, due to Party A in this period need to land improvement activities, such as: work related, fertilizing, leveling etc.四、违约责任Liability for breach of contract1、甲方未能按时支付土地租凭费用,乙方应相关部门积极反应解决。如未能按时付款超过 个工作日,视同终止履行本协议。Party A fails to pay land leasing fees, Party B shall solve the relevant departments to actively response. Failure to pay on time more than a day, the performance of this Agreement shall terminate2、乙方应保证在土地租凭期限,土地能够连续正常使用,如发生不可抗拒因素,视为本合同终止。Party B shall ensure that in the land leasing period, the land can continuous normal use, such as the irresistible factors, as the termination of this contract.五、其他Other1、甲方的开发建设应依法律、法规和规定办理有关手续。Party of the first part of the development and construction in accordance with the laws, regulations and rules shall go through the relevant formalities.2、本协议未尽事宜,须经各方协商解决,并签订想定相应的补充协议,补充协议与本协议具有同等法律效力。Matters of this agreement, shall be approved by the parties negotiated and signed the supplemental agreement, to the corresponding, the supplemental agreement has the same legal effect as this agreement3、本协议在执行过程中发生矛盾、争议,经协商无效时,提请法院裁决。This agreement conflicts, during the execution of the dispute, the
