房屋租赁合同TENANCY AGREEMENT房屋租赁合同TENANCY AGREEMENT 第 号一、 出租人（以下简称甲方） Landlord (hereinafter referred to as party A)二、 承租人（以下简称乙方） Tenant(hereinafter referred to as party B)三、 租赁范围及用途 Tenancy:甲方同意将其所有的位于 北京市朝阳区光华路2号阳光100座2001 室的房屋及其设施（包括家具和电器）在良好及可租赁的状态下租给乙方为 居住 使用，出租房的面积总计约 110 平方米。Party A hereby agrees to lease its property located at RM2001, Building B, Sun100 Guanghua Road, Chaoyang District, Beijing and the related facilities(including furniture and appliances) in good tenantable condition to Party B for 1 year .The size of the leased property is approximately 110 spm.四、 租赁期： Term of Tenancy: 4.1 租赁期为 壹 年，自 2010 年 07 月 15 日起至 2011 年 7 月 14 日止。 The above property is hereby leased for a term of one year, commencing on July15,2010 and expiring on July14,2011 .4.2 租赁期满，甲方有权收回全部出租房屋，乙方应如期交换。乙 方如有要求续租或退租，应提前壹个月通知甲方。 Upon expiration of the tenancy, Party A has the right to take back the entire leased property, and Party B shall deliver the leased property to Party A on time. Alternatively, Party B have the opton to renew this agreement or quit this agreement upon giving one month prior notice to Party A before the expiration of this agreement.五、 租金及付款方式Rent and the way of payment5.1 双方谈定的租金为每月 5800 元。 The rent, agreed by both parties, is RMB5800 per month.5.2 乙方支付甲方每月的租金，应 壹 个月支付一次。付款日期 应在每月 25 日之前。 Party B shall pay One months rent in advance, on or before 25th of each calendar month.A： 汇至甲方指定的银行账号，支付租金日期以乙方汇出日期为准。 By transferring the amount or such rent to a bank account designated by Party A and the date of transfer shall be the date of payment.B： 以现金方式支付 Payment in cashC: 以支票方式支付 Payment in check5.3 由于乙方原因未能按期支付租金，乙方须按日加付其月租金0.5的滞纳金。 If the rent remain being unpaid on time, Party B shall be liable to pay a late penalty fee equal to 0.5 of the month rent per day.六、 保证金（押金）：Security Desposit:6.1 为确保出租房屋及其设施之安全并完好及租赁期内相关费用之如期结算，乙方同意于签订合同当日支付给甲方的租赁押金5300元作为乙方确保合同履行之保证金。 To ensure the welfare and good condition of the leased property and the related facilities as well as the prompt payment and settlement of all related charges durning the term of tenancy, Party B agrees to pay to Party A within one day after the agreement signed a security desposit 5800 in the amount of as security for Party Bs obligations hereunder.6.2 除合同另有约定外，乙方应于租赁期满之日与甲方点清室内设施，并付清所有应付费用后，甲方当天将保证金全额无息退还乙方。 Unless other provided in agreement, Party A shall return to Party B the entire security desposit without interest thereon upon expiration of the tenancy or sooner determination of this agreement after Party B settled all charges of leased property with Party A. 七、 费用担保：Payment:7.1 租赁期间物业费和取暖费由甲方承担。 Durning the term of the tenancy, the property management fees and the heat-preservation fees shall be paid by Party A.7.2 房屋的冷、热水、电、天然气消耗按每月查表实数由乙方支付。 The cold, hot water, electricity, and gas payment(for water and tear) of the property shall be paid by Party B according to its actual payment per month.7.3 电话费、有线收视费按实际费用由乙方交付。 Party B according to its zctual payment shall pay the payment for telephone and international channel.八、 出租人的责任Landlords obligations:8.1 甲方须按时将出租房屋及其设施以良好的状态交付乙方使用。 Party A shall deliver the leased property and the related facilities in good condition to Party B on schedule.8.2 租赁期内甲方不得收回出出租房屋（除非本合同另有规定） Party A shall not take back the leased property durning the term of the tenancy.(Unless otherwise stipulated in this agreement)8.3 在乙方遵守本合同的条款及交付租金的前提下，乙方有权于租赁期内拒绝甲方或其他人骚扰而安静享用出租房屋。 Provided that Party B abides and performs the appendixes of the agreement and the payment for the tenancy, Party B has the right to refuse the interruption from Party A to enjoy the life satisfaction and peace. 8.4 房屋基本设施和结构，甲方有修缮的责任并承担有关的费用，并对其做定期修缮。 Party A is responsible for repairing and maintaining the basic facilities of the leased property and for bearing all costs thereto.8.5 甲方谨在此声明及保证甲方为出租房屋的合法拥有人并由合法地位出租此房屋与乙方。 Party A hereby represents and warrants that Party A is the legal owner of the leased property and has the necessary legal capacity to lease the property to Party B.8.6 如在租赁期内，租赁房屋发生所有权全部或部分转移、或其他影响乙方权益的事情时，甲方应保证所有权人或者其他影响乙方权益的第三者，能继续遵守本合同所有条款，如乙方与本合同的权益人首次等所有权人或第三者所影响或损害，甲方须负责任补偿乙方的所有损失、损害、支出及费用。 If durning the term of the tenancy, all or part of the leased property is transferred or Party Bs right to use the leased property is attested, Party A shall ensure that such transferee or third party having an effect on Party Bs right to use the leased property will continue to abide by the terms of this Agreement.Party A shall also be liable to keep Party B be fully indemnified against any costs,expenses,losses, and damages suffered by Party B if any of Party Bs interests herein are affected or prejudiced by a third party. 九、 承租人的责任：Tenants Obligatons:9.1 乙方应按合同的规定，按时支付租金，保证金及其他各项应付费用。 Party B shall be responsible to pay all rents and fees in at timely manner according to the terms of the contract.9.2 乙方经甲方事先同意，可在承担租用房内进行装修及添置设备，租赁期满必须恢复原状（正常损耗除外），并承担其费用，经甲方验收认可后归还甲方。 Party B with the prior consent of Party A, can renovate and install additional facilities in the leased property.Upon expiration if the tenancy the leased property shall be resumed to Party A in its original conditions (fair wear and tear exempted)and all expenses arising there from shall be borne by Party B.9.3 乙方应爱护使用租赁的房屋，如因乙方的过失或过错致使房屋及设施受到损失（正常损耗除外）乙方应负赔偿责任。 Party B shall treat the leased property with care. Because of Party Bs negligence or misconduct, the leased property and the related facilities suffer any damage(fair waer and tear exempted) Party B shall be responsible for compensating Party A for such damages.9.4 乙方应按本合同的规定合法使用租赁房屋，不得擅自改变其性质，不应存放中华人民共和国法律下所禁止的危险物品，如因此发生损害，乙方应承担全部责任。 Party B shall use the leased property legally as agreed in this agreement and may not change such use on its own.Party B shall not store any dangerous items, which are prohibited by the laws in the Peoples Republic of China in the leased property and shall be fully responsible for any damages or a result thereof.9.5 租赁期即将结束之日，经乙方同意，甲方可以带其他客户看房。 Upon expiration of the tenancy or sooner determination of this agreement, Party A could take others to check the apartment with the Party B agreement. 9.6 中英文条款及意思如有不一致之处，双方协调解决。 In the event that there is the conflict between the Chinese version and English version, in such case Party A and Party B shall go together and resolve the problem.十、 违约处理：Breach of Agreement10.1 乙方如有下列行为之一的，甲方有权终止本合同，收回出租房屋，并且扣除房屋保证金。 Party A shall have the right to terminate this agreement repossess the leased property and porfeit the money of the security desposit if Party B commits one of the followings.a、 未得甲方同意将承租房屋擅自拆改结构改变用途Alters the structure of the l
