Contractors on site 1 DEFINITIONS Contractor A Contractor refers to a person company or provider who through a contractual arrangement with African Minerals Ltd performs work or provides services on the project site 2 PROCEDURE 2 1General African Minerals Ltd has a Duty of Care statutory obligation to ensure Contractor perform their activities in a manner which is safe and without risk to their own and other employees African Minerals Ltd will only engage Contractor and their lower tier contractors to work on African Minerals Ltd sites who share the view that working safely cannot be an afterthought or an added cost Working safely is simply good business Contractor personnel who show reckless behaviour or disregard of HSE requirements shall be immediately removed from site 2 2Invitation to Tender The Invitation to Tender sent to prospective Contractor must include GRP HSE 002 African Minerals Ltd HSE Contractor Specifications which outlines the HSE requirements of African Minerals Ltd and specifies documentation required to be submitted by the Tenderer at tender closure and prior to arrival at site The custodian of GRP HSE 002 African Minerals Ltd HSE Contractor Specifications is maintained by the Manager HSE and shall not be altered without approval For small subcontracts where less than five personnel are involved and the scope of work is considered by the Project Manager to be of a high risk a JSA may be sufficient to control any identified potential risks and the subcontractor shall work under the direct supervision and comply with the HSE Management System of African Minerals Ltd The Project Manager shall inform Procurement and the Manager HSE of the decision not to issue the GRP HSE 002 African Minerals Ltd HSE Contractor Specifications The following documentation is required to be submitted for review at tender stage is as follows DocumentWhenScope HSE Risk Assessment Record With tenderDetails the identified HSE hazards for the Contractor scope of work and controls to be used to mitigate the risks Senior Management Commitment Statement With tenderThe Senior Manager is required to demonstrate an understanding of HSE statutory Duty of Care requirements and an indication of the commitment to HSE within the organisation organisational culture HSE Statistics DataWith tenderDetails of HSE performance for this year and each of the preceding 2 years fatalities number of LTI s and work days lost number of MTI s number of FAI s number of near hits investigated number of site hours worked any improvement notices issued by any 2010 03 02 AFRICAN MINERALS LTD Page No 3 OF 6 Upon receipt of information submitted by the Tenderer the documents shall be reviewed by a qualified HSE staff member who shall complete form SWI F0402A HSE Document Review If required an HSE audit shall be conducted by the Manager HSE or delegated representative to audit the potential subcontractor s system to ensure it is satisfactory and meets African Minerals Ltd standards All such audits shall be recorded using African Minerals Ltd audit form SWI 0409B for small Contractor or SWI 0409B for large subcontract companies A copy of evaluations and audits shall be forwarded to the Manager Procurements and Manager HSE and a copy placed on the Project Tender File 2 3Post Award The subcontractor shall not proceed to site until the subcontractor has effectively rectified all requests from African Minerals Ltd to revise and resubmit their documentation The HSE Document Review shall be completed and forwarded to the Project Manager for any follow up actions The following documents are required to be submitted post award 3 DELIVERABLES HSE DOCUMENTATION TO SUPPLY ON AWARD PRIOR TO MOBILISATION DocumentWhenScope Project HSE PlanPrior to mobilisationProject HSE Plan specific to the contract Detailed Risk Assessment of All Identified Project Hazards Prior to mobilisationDocumented project specific Risk Assessment in accordance with AS4360 1995 Risk Management In contractors format or use of Appendix 1 All controls shall be allocated in accordance with the Hierarchy of Controls Method Draft JSA s for All Hazardous Tasks Prior to mobilisationDraft JSA s as identified by the Risk Assessment HSE Implementation Plan Prior to mobilisationAction plan outlining how the subcontractor will control and monitor the implementation of his minimum Contractor shall comply in full with the requirements set out in each African Minerals Ltd Project Health Safety and Environmental Plan PHSEP All Contractor shall provide their own PHSEP for review by African Minerals Ltd prior to commencing work on the project The PHSEP as a minimum shall include all elements referenced in the African Minerals Ltd Project HSE Specification and Client HSE requirements Contractors unable to provide a HSE system are to implement and operate under the African Minerals Ltd Contractors HSE Pack The African Minerals Ltd Contractor HSE Pack Form SWI F0402B has been developed to help formulate a standardised approach and is the minimum HSE requirements for Contractor who engage in work with African Minerals Ltd The Pack is designed to assist a company which has no safety management system by providing a standardised approach to help develop such a system The Pack is not designed to replace the existing safety management system of a company Where such a system exceeds the requirements of the Contractor Health Safety Pack then the forms and other documentation provided by such a system will be accepted provided they exceed Health Safety and Rehabilitation requirements outlined in the Pack 4 2Auditing Contractor s shall be required to participate in African Minerals Ltd HSE Audits while working on the project Contractor HSE audits shall be undertaken in accordance with the African Minerals Ltd Project HSE Plan or when requested by the Project Manager All Audit results shall be submitted to the Manager HSE on a monthly basis 4 3HSE Performance Rating All Contractor s will be evaluated during and on completion of the project This evaluation shall be used to give Company procure
