Charter,be in full pliance with ISMCode ifessential and/or all applicable internationalconventions,all applicablelaws,regulations and/or otherrequirements of the countryof the vessels registryand of the countriesand/or statesof theport(s)and/or place(s)to whichthe vesselmay beordered hereunder.Owner furtherwarrants that the vessel shall haveon board,during thesubject period,all certificates,records orother documentsrequired byaforesaid conventions,laws,regulations and/or requirements.If anyof thewarranties stipulatedin thisclause arebreached,any delayresulting therefromshall notcount aslaytime orif the vessel ison demurrage,as timeon demurrageand anyexpense attributable to suchdelay shall be for Owners aount.2.QUESTIONNAIRE CLAUSE It is an expresscondition precedentto the Charter that (1)The questionnaire88shall have been fullypleted by the Owneror its authorizedrepresentative,and (2)that Owners responses to the questionnaire shall be subjectto aeptancebythe Charterer inits solediscretion.Owner represents and warrantsto Chartererthe pletenessand auracyof allinformation andresponsesto thequestionnaire,which representationand warrantyshall be deemed reaffirmedwhen the vessel tendersNotice ofReadiness atthe loadport.Charterers aeptanceof responsesto thequestionnaire shallnot bedeemed tobe awaiver ofany rightswhich Charterer may have.The pletedquestionnaire shall bedeemedattached to and fullyincorporated into theCharter.3.OIL INSURANCECLAUSEItisacondition ofthisCharterthat Ownerhas inplace coverfor oil pollution ofupto themaximum availablethrough theinternational groupof P&I clubsand excessoilpollutioncover availablethrough OwnerP&I cluband/or firstclass marketunderwriters.If requestedby Charterer,Owner shall immediately furnishto Chartererfull andproper evidenceof thecoverage.4.SPILL RESPONS旧旧ILITY CLAUSEVessel shalltake allnecessary precautionsto preventspillage orleakage of cargo orbunkers.Prior tomencement of cargo orbunkering operations,vessel shallverify allappropriate overboardlines areclosed securely,and shallplete theapplicable oiltransfer formin conjunctionwith theterminal orbunkering authoritiesand involvedpersonnel,conduct athorough investigation,and pleteappropriate actionbefore resumingsuch operations.5.DRUG ANDALCOHOL POLICYCLAUSE Owner warrants thatit has a policyon Drugand AlcoholAbuse Policyapplicable to the vesselwhich meetsor exceedsthe standardsin theOil CompaniesInternational MarineForum(OCIMF)Guidelines for the Controlof Drugsand AlcoholOnboard Ships.6.BERTH TIMECLAUSE Thevessel shallvacate theberth immediatelyafter pletionof dischargeand hoseshavebeendisconnected providedthat properdocuments areprepared,or withinfour hoursbefore sunsetfollowing pletionof discharge,whichever firstours.If afterhoses aredisconnected vesselremains at berth solelyfor shippurposes,Owner will be responsiblefor anycosts chargedto Chartererby terminal,supplier orreceivers.If vesselremains atCharterer ownedfacilities forits ownpurposes andcosts areincurred byCharterer whichcan bedocumented andsupported solelydue to vessel remainingatberth,Owner will be responsiblefor allcosts incurred.7.ETANOTICECLAUSE Owner/Master togive Charterer and MAI LIAO port agent ETAwhere applicable7/5/4/3/2/1days in advance MAI LIAO port.As soonas Ownerhas hadall load/discharge portsnominated on the vessel,Owner to advise Charterer and MAI LIAO port agent ofload/discharge portrotation,and theETA Charterers port.After havinggiven theload/discharge rotationand ETAto Charterer,Owner thentoadviseChartererandMAI LIAO portagentany change of rotationand anychangeofmore than24hours of the givenETA.8.RESPONSIBLE CARECLAUSE The Owner is fully mittedtotheprinciples ofResponsible Care.The Owneracknowledges theimportance ofhandling product inamanner thatwill ensurethe safetyof peopleand theprotection of the environment.The Owner agrees theywill use,handle,store,transport anddispose ofproductinaordance withallapplicablelaws andregulations.9.PORT RESTRICTIONCLAUSE ONBERTH Ownerswarrant that they arefully awareof thephysical andoperational restrictionsat MAI LIAO port,terminals andberths,and willabide bysame.Possible restrictionsinclude butare notlimited to;physical limitationon the vessel draft,length,beam,displacement etc.,and restrictionson nighttime cargooperations navigationand/or berthing.Any delaydue tonon-pliance withrestrictions shall be forOwners aount.10.CLEAN BALLASTCLAUSEOwner warrants that thevessel will arrive at port/area withclean ballast.Nothing,including cleanballast,can bedischarged overboardin MAI LIAOportunless otherwiseapproved.Also Owner warrants that thevessel will ply with ballastwater supportforthe manifoldsystemmust bedesigned toprevent bothlateral andvertical movementofthemanifold.B)Ownerwarrantsthat allpiping,valves,fittings andreducers onthemanifoldsystem thatare properlyprepared insizes as required andused inthe transferofcargoand ballastwillbemade ofaeptable materials.13.CLOSE LOADING/UNLOADING CLAUSEOwnerwarrantsthatthevessel isequipped forand ableto carryout closedloading anddischarging operations infullpliance withInternational SafetyGuide for Oil Tanker&Terminal(ISGOTT).Furthermore Ownerwarrantsthatthevesselhas anoperational closedullage systemavailable and is capable of ventingvapors ashoreduring loadingvia singlecentral vaporreturn lineasrequired.14.CONSIGNEE AGENCYCLAUSE For strict safety management purpose,Owner agreesto appointFormosa PlasticsMaritime Corporationas theirportagentin MAILIAO Port.15.BUNKERING CLAUSE For strict safety management purpose,Ownerwarrantsthatthevessel shallplywithMAILIAO Port BunkeringProcedure whilebunkering inMAILIAOPort.16.VESSEL MAINTENANCECLAUSEForstrictsafetymanagementpurpose,any repairingwork inMAILIAOPort isprohibited unlessspecially permittedby MAILIAOPortAuthority andmanaged byFormosa PlasticsMaritime Corporation.Violated vesselshall befined.17.CREW MEMBERSHORE WORKPERMIT CLAUSEForstrictsafetymanagementpurpose,any shore work bycrewmember inMAILIAOPort isprohibited withoutshoreworkpermit.Violated vesselshall befined.18.IGS CLAUSEA)Owner representsand warrantsthat vessels InertGas System(IGS)isfullyoperational and thatthevesselwillarriveatport withcargo tanksinerted,andthatcargo tankswill remaininerted throughoutthe voyage,including duringloading anddischarge,so thatin noevent shall cargo tankshave anoxygen contentin excessof eightpercent(8%)by volume.B)Master maybe requestedby terminalpersonnel orindependent inspectors)to breachthe IGSfor purposesof gauging,sampling,temperature measurementand/or measurementofthequantity ofcargo remainingon boardafter discharge.Breach anddepressurization oftanks for such purposesshallbeallowed inaordance withthe provisionsofthemost current/amended InertGas SystemsforOilTankers publicationissued bythe InternationalMaritime Organization(IMO IGS Publication).C)Owner furtherrepresentsand warrantsthatshould theIGS systemfail,vesselshallstrictly adhereto EmergencyProcedures ofthe IMOIGSPublication.D)Charterer shall have the right torequest depressurizationunder APIguidelines ofthe tanksto allowmeasurements bydesignated inspectors,provided
