Contract 1.Contracting Parties Employer : （ ） (Party A) Contractor : Shanghai LePin Catering Management Co. , Ltd. (Party B)2.Contract Period Valid period starts at （ ） and ends at （ ）. A notification in writing format must be taken to the other party one month in advance if any party plans to terminate this contract before ending date. Without following the rules prescribed, defaulting party should make compensation to the other by 20% of cost of meals of last month.3.Contract Details (1)Party A provides free of charge for kitchen, kitchen utilities, water, electricity and gas. (2)Supplying meal standard is set at （ ） (including dinner). One complete meat dish, one partly meat dish, two vegetable dishes, one fruit or drink, unlimited supply of rice and soup. Please DO NOT waste. (3)Party B advances one months fee for party A. Party A should pay off last months fee in cash check within 15 working days counting from the day receiving invoice. Fee should be charged according to the amount of persons attending. Please DO NOT delay. Payment method: （ ） as the cost issuing invoice of purchasing food and （ ）as management fee issuing invoice of service. (4)In operating period, both parties should work together in accordance with the terms of the contract.4.Responsibility of Part A (1)With no reasonable reason, Party A should not terminate the contract and add the other charging items.(expecting that party B seriously violate the food safety system or the management system of Party A) (2)Party A should inform the amount of persons for dinner in advance.5.Permissions of Party A(1)Party A have all kinds of administration to Party B, such as health, safety, public security , complete governance，supervision etc.(2)Party A should have supervision to party B, including purchasing food，collocating food，the quality and quantity of food and service, and health condition. If necessary, party B should improve above condition timely according to party A.(3)Party A will implement performance appraisal to Party B on a monthly basis. If Party B does not reach performance goals, Party A will have the right of economic sanctions. Schedule of assessment will be served as the annex to the contract.6.Responsibility of Part B(1)Party B should strictly comply with rules and regulations of Party A, and do the relevant work rightly according to the provision about fire control, factory regulations and security.(2)The canteen staff should have the medical examination and have the health card according to the regulation of health authorities. The staff should bear the expense.(3)The operation place should be cleaned clearly and rodent and fly disinfestations and other regular health.(4)Party B should strictly comply with rules and regulations of the canteen, operate accordance with the procedures and health management system of the canteen, and ensure that the bacteria existing on the eating utensils are not exceeded.(5)Party B should arrange and ensure the dinner time according to the product schedule of Party A. and the food should be made fresh, delicious, rich kinds and nutrient.(6)Party B should ensure the quality of the food, and should not purchase the deterioration food, rice, ingredients and oil.(7)The staffs of Party B must wear unified working uniforms (which are chosen by Party B.), gloves and masks should be equipped while working. (8)Party B should do the best to coordinate the request of Party A, if party A has extra dinner request for meetings, trainings, marketing activities and festivals.(9)Party B should supply the meal according the timetable set by Party A, 11:15 for lunch, and 18:00 for supper. If time is changed, party A should inform B in advance.(10)The canteen staff of Party B should obey the rules and regulations set by Party A, they should be remained in kitchen area. Party As working area is not allowed. Party A has the right to punish those who break the rules.(11)All the equipments in the canteen should be operated properly, well reserved, should not be damaged manually. Party B will compensate if Party B causes damage of the equipments. Party B is also obliged to conserve water, electricity and gas. If abuse happened, Party A has the right to punish.(12)Material fees for operation are paid by Party B. Salary of canteen staff and insurance are paid by Party B. If law suit happens, Party A has no obligation to settle it.(13)Party B should keep the sample of the food and ingredients for 48 hours for examining when accident happens.7.Permissions of Party B1.Party B operates its own business, and bear the benefits and loss.2. Party B has the right to hire, transfer staff with the permit ion of Party A.3.Ifthecostofmaterialincreases,whichleadstolossofParty B,bothPartiescannegotiateandsettletheissue 8.Supplement (1)Party B does not undertake the loss of real estate and facility of party A, if the loss is caused by force majeure.(2)Party B must return all the estate, facility, equipment, and tools to Party A when the contract comes to an end, and coordinate Party A with the liquidation.(3)Within one month before the contract expires, two parties should notify each other if it intends to extend the leasehold.(4)Anything n
