劳务派遣合同(中文和英文)CONTRACT OF LABOR DISPATCH SERVICEa党：法定代表人：合法表示法：地址：地址b侧：Party B:法定代表人：合法表示法：地址：地址：甲方双方根据中华人民共和国有关法律，平等互利的原则，经过友好协商，就甲方向乙方派遣员工一事达成了以下协议。According to Chinese relevent laws，and in consideration of the mutual covenants and agreements contained here in，the parties hereby reach第1章派遣和租赁CHAPTER ONE DISPATCH AND BORROWING第一条派遣是指甲方根据本合同向乙方派遣与甲方有劳动关系的人员工作的行为。article 1 for the purpose of this contract，“dispatching”means party a dispatches its employee who has employment relation with itself temployee第二条借款是指乙方根据本合同从甲方向乙方招聘人员的行为。article 2 for The purpose of this contract， borrowing means party b borrows，subject to The terms and conditions contained here in第三条甲方应按照乙方的要求向乙方派遣工作人员，乙方应按约定向甲方支付借款费。Article 3 at the request of party b，party a dispatches its employees to work for party b；And，party b shall pay party a the relevent borrowing fees accordingly。第四条职员和甲方是劳动关系，乙方和乙方是劳动关系。员工的工作地点、职位、方式由乙方根据工作要求决定。article 4 the relation between the employee who is concerned in this contract and party a belongs to employment relation；and the relation between the afore mentation ed employee and party b belongs to labor service relation。the working venue，Position and working method of the employee will be determined by party b based on its business。第五条借款费用是指乙方借用甲方员工的费用，包括：article 5 the borrowing fees means the payment that party b shall make to party a，which includes :(a)支付工作人员的工资；The wages of the Employee。(b)支付员工的社会保险、住房公积金费用；the social insurance premiums and housing fund of the employee .(c)甲方为员工派遣提供商业保险、福利费。other commercial insurance and welc fares that party a offers to the employee。(4)甲方对被派遣员工的管理、运营费大于租赁费的5%。the management cost and operation cost of the dispatched employee that party a spends，which is not less than 5% of the total borrowing fees(e)承担所得税和其他费用；taxes and other expenses that party a bears。第6条甲方派遣人员的姓名article 6 the name of the dispatched employee聘用工作和工作说明工作职位工作内容。第二章甲方的义务和权利章节two权限和obligations of party a第7条甲方承担以下义务：article 7 party a shall assume the following obligations :(a)根据乙方要求推荐人选，与乙方决定租赁的人员或乙方直接选定的人员签订派遣员工劳动合同。to recommend the candidates at the request of party b，and signs employment contract with the person who party b decides to borrow or directly chool(二)教育工作人员遵守中华人民共和国的法律、法规和规章。to educate the dispatched employee to observe the laws，decrees and relevant regulations enacted by the Chinese government。(3)派遣职员遵守乙方工作制度，教育乙方遵守商业秘密。to educate the dispatched employee to observe the working system and policies of party b，and keep the business secrets of party b in confidential(d)从借款费用中派遣的员工的工资和收入。to pay the employee wages and other remunteration s he deserves from the borrowing fees。(五)在乙方支付租金后，依法派遣员工的社会保险、住房公积金及福利费用。其中福利和医疗保险部分的具体履行按照本合同及其附件条件、甲方员工福利派遣治疗、医疗费用报销的规定执行。Shall pay the social insurance，Housing fund and other welc fares for the employee according to the relevent laws after it receivings the borrowing(六)向员工派遣提供双方规定的服务内容。to provide other services which are agreed by two parties。(七)听取乙方的意见和建议，不断改进工作；to accept the advices and suggestions provided by party b，and improve its work accordingly。第八条甲方享有以下权利：article 8 party a shall enjoy the following rights :(a)如果特殊情况，a国和b国不能达成协议，a国有权撤回被派遣的员工，终止本合同。但是，必须在30天前书面通知b方(派遣的员工在试用期内除外)，a方一次性向b方支付补偿金，如下：派遣职员的派遣时间每一年计算一次，补偿费是一个月的出租费，不足一年的部分是一年。补偿费以派遣职员撤回的月租金为计算标准。in case in some special situations when two parties cannot reach an agreement，party a shall have the right to recall its dispatched employeethe compensation payment shall be made based on the working time of the dispatched employee，Which shall be one month s borrowing fee for each for eachany period of not less than one year shall be counted as one year。the standard of Compensation fee shall be the borrowing fee of the same month when the dispatched employee is recalled .(二)甲方有权就乙方违反本合同有关条款或损害派遣人员合法权益的行为，书面提出意见并进行交涉。乙方应在收到甲方书面意见后6个工作日内书面答复甲方。party a is entitled to bring forward its opinions in written when party b vioates this contract or damages the legal rights of the dispatched employeeand party b shall reply in written within six(6)working days afing it receivings the afore mentioned written notice made by party a(3)乙方无故拖欠派遣员工的工资或借款费，甲方可以随时无条件终止本合同，向乙方申请赔偿。party a is entitled to terminate this contract at anytime for no reason，and claim for compensation from party b，If party b fails to pay the(四)派遣人员侵犯乙方的合法权益，甲方可以帮助乙方追究员工的相关责任。(4)party a may offer assistance to party b in asking the dispatched employee to take his liabilities，if the dispatched employee damages tamages第三章乙方的义务和权利chapter three the obligations and rights of p
