4、ment on December 9, 2009)Article 1 (purpose and basis)In order to control pollution and protect the environment and human health, according to the "prevention and control of radioactive pollution in People's Republic of China law" and "radioisotopes and radiation safety and protec

5、tion regulations" and other laws and regulations, with the actual city, the enactment of this provision.Article second (scope of application)These Provisions shall apply to the prevention and control of radioactive pollution within the scope of this Municipality and the supervision and administ

6、ration thereof.Third (department responsibilities)The administrative department of environmental protection of the Shanghai Municipality (hereinafter referred to as the municipal environmental protection department) shall exercise unified supervision over the prevention and control of radioactive po

7、llution within the scope of this municipality.The administrative departments for environmental protection under the district or county (hereinafter referred to as the district and county environmental protection departments) shall be responsible for the following work within the scope of their respe

8、ctive jurisdictions:(1) the production, sale and use of type IV, class V radioactive sources and class III ray installations, the supervision and administration of the prevention and control of radioactive pollution by units, and the administrative penalties for related violations;(two) the supervis

9、ion and administration of the flaw detection device containing radioactive sources in outdoor and field inspection operations and the administrative penalties for related violations;(three) commissioned by the municipal environmental protection department to examine, approve and issue class IV and c

10、lass V radioactive sources and class III ray installations for the sale and use of radiation safety permits of units.The administrative departments of public health, public security and urban transportation in this Municipality shall exercise supervision and control over the prevention and control o

11、f radioactive pollution in accordance with the division of responsibilities prescribed by relevant laws and regulations.Fourth (information sharing)The municipal and district / county administrative department of environmental protection (hereinafter referred to as the environmental protection depar

12、tment) shall be in conjunction with health, public security, city traffic administrative departments to take the form of regular joint meeting, study and solve the problem of radioactive pollution prevention and control, strengthen the supervision and management of the prevention and control of radi

13、oactive pollution.The environmental protection department shall organize the establishment of radioactive pollution management information system. The administrative departments for environmental protection, public security, sanitation and urban transportation shall exchange information and realize

14、information sharing.Article fifth (prevention and control planning)The municipal environmental protection department shall, in conjunction with the relevant departments, formulate a plan for the prevention and control of radioactive pollution in this Municipality and incorporate it into the environm

15、ental protection plan of the city.The district and county environmental protection departments shall, in accordance with the city's plan for the prevention and control of radioactive pollution, formulate the implementation plan for the prevention and control of radioactive pollution in this dist

16、rict and county.Clause sixth (Prohibition)The production, use and storage of radioisotopes or class I and class II radiation devices are prohibited in residential buildings, commercial and residential complexes.It is forbidden to transfer radioactive isotopes and radiation units to units that do not

17、 have radiation safety licenses or units that are beyond the scope and scope prescribed by the radiation safety license.Seventh (regular inspection of radioactive workplace)Unit of production, sale and use of radioactive isotopes and radiation equipment (hereinafter referred to as the radiation work

18、 units) shall entrust a qualified agency in accordance with the relevant provisions of the state of ionization radiation protection and radiation safety standards, regularly on the workplace and environmental testing. In the case of an abnormal situation, the radiation work unit shall take immediate

19、 measures and report it to the competent environmental protection department within 12 hours. Those who belong to the medical and health institutions shall also report to the administrative department for public health within 12 hours.The radiation work unit shall incorporate the regular monitoring

20、results into the annual assessment report on the safety and protection of radioisotopes and ray devices.Eighth (daily supervision of radioactive source flaw detector)The units that use radioactive sources for flaw detection shall check and record the use of flaw detectors and the safety and protecti

21、on of them, and report the inspection to the environmental protection departments in their respective districts and counties each month. The environmental protection departments in the districts and counties shall conduct random checks on the safety protection of the units that use radioactive sourc

22、e flaw detectors.In accordance with the regulations of the municipal environmental protection department, the units that use radioactive sources for flaw detection shall gradually implement real-time positioning and monitoring.Ninth (including radioactive source flaw detection device transfer use ma

23、nagement)Within the city containing radioactive source inspection device using the unit transferred out of the workplace, should be in use within 3 days prior to the radiation safety license, filing into the district and county environmental protection department, and let out of the district and cou

24、nty environmental protection department; moved in and out for the same the district and county, shall apply to the local district or county environmental protection department to handle the formalities. Within 5 days after the end of the use, the unit that uses the radioactive source flaw detector s

25、hall go through the procedures for recordation and cancellation of the original record of the district and county environmental protection departments. Among them, the use of districts and counties, the use of units should also be informed of the relocation of the District, county environmental prot

26、ection departments.If the use of radioactive source flaw detection devices is transferred in provinces, autonomous regions or municipalities directly under the central government, it shall be filed with the municipal environmental protection department in accordance with the relevant provisions of t

27、he state. The municipal environmental protection department shall notify the relevant district and county environmental protection departments within 24 hours after handling the formalities for archival filing.The district and county environmental protection departments shall strengthen the supervis

28、ion and inspection of the transfer of radioactive flaw detectors.Operation requirements of tenth (including radioactive source flaw detector)When a radioactive flaw detector is used in outdoor or field operation, the operating unit shall delimit the control area in a certain range at the job site in

29、 accordance with the regulations, and set up a warning line and obvious warning signs.In the course of operation, the entrusted operation unit and the inspection unit shall strengthen the safety inspection at the spot, and shall prohibit the irrelevant personnel from entering the site of the flaw de

30、tection operation. Each radioactive source flaw detector shall guarantee that more than 2 persons are responsible for the operation, and more than 1 persons shall be responsible for the vigilance and monitoring.Where a radioactive flaw detector needs to be stored in the field, it shall be stored in

31、a relatively enclosed place.Storage sites shall be taken care of by special personnel, and security measures such as theft prevention and radiation protection shall be taken to prevent the storage of radioactive source flaw detectors in residential buildings, commercial and residential complexes and

32、 other public places.The district and county environmental protection departments shall strengthen the supervision and administration of the on-site operation of flaw detection devices containing radioactive sources.Eleventh articles (radioactive sources and radioactive sources, ray installations, t

33、ransportation management)Radioactive sources and radiation installations containing radioactive sources shall be transported by units qualified for the transportation of dangerous goods. No unit that is qualified for the transportation of dangerous goods shall not engage in the transportation activi

34、ties of radioactive sources and radiation devices containing radioactive sources.The use of public transport vehicles for the transport of radioactive sources and radiation equipment containing radioactive sources is prohibited. It is forbidden to combine radioactive sources or radiation devices con

35、taining radioactive sources with other substances.For the transport of class I, class II, class III radioactive sources and unsealed radioactive isotopes by road transport, special vehicles for the transport of radioactive substances shall be used. The special vehicle shall be in accordance with the

36、 "Regulations" the safe transport of radioactive material requirements, equipped with protective facilities, installation of satellite positioning system, to maintain the normal operation of the satellite positioning system, and set the radioactive clearly marked in a prominent position.Wh

37、en the public security traffic management department finds out that the vehicles carrying radioactive sources and radiation installations containing radioactive sources have abnormal circumstances, they should inform the environmental protection departments in a timely manner.Twelfth (radioactive is

38、otope and ray equipment account management)Radiation work units shall, in accordance with the provisions of the state and this Municipality, establish the accounts for the management of radioisotopes and rays.Sales of radioactive isotopes and radiation equipment unit, the management account shall sp

39、ecify the name, address and purchase units held by the radiation safety license number etc.; use of radioactive isotopes and radiation equipment unit, the management accounting should indicate the use, maintenance, inspection and maintenance etc.Article thirteenth (decommissioning of radioactive wor

40、kplaces)When the radioactive work unit stops using radioactive workplaces, it shall discharge the radioactive workplace and carry out the environmental impact assessment in accordance with the law. Where the environmental impact assessment document of the radioactive workplace is examined and approv

41、ed by the competent environmental protection department, the radioactive workplace may be used for other purposes.After the completion of the decommissioning of the radioactive work place, the radiation work unit shall, within 20 days, process the corresponding radiation safety license cancellation

42、or modification procedures.Fourteenth (emergency and accident management)The environmental protection department shall, in conjunction with the administrative departments of public security and public health at the same level, formulate emergency plans for radioactive pollution accidents and report

43、them to the people's governments at the same level for approval.Radiation work units shall, in accordance with the emergency plans for radioactive pollution accidents in cities, districts and counties, and the specific circumstances of their units, formulate emergency plans for their units and r

44、eport them to the environmental protection departments in their respective districts and counties for the record.Radioactive pollution accident, the relevant units shall immediately start the unit emergency plan, emergency measures, and immediately to the local emergency response agencies, county pe

45、ople's government public emergencies or environmental protection, public security, the administrative department of health report.The relevant departments after receiving radioactive pollution accident report, should be immediately sent to the scene, in accordance with the division of responsibi

46、lities, take effective measures to control and eliminate the effects of the accident at the same time, in accordance with the provisions of national public emergency grading report timely reporting of accident information.Article fifteenth (violation of the prohibition of punishment)In violation of

47、the provisions of the sixth paragraph second, no radiation safety license or permit to units beyond the category and scope of the unit transfer of radioisotope or ray devices, by the environmental protection department shall be ordered to make corrections, and impose a 10 thousand yuan fine of not l

48、ess than 100 thousand yuan.Article sixteenth (violation of the radioactive source flaw detector routine supervision regulations Punishment)In violation of the provisions of article eighth of the regulations, the use of security situation and failing to check, record and report inspection unit or fai

49、ling to implement the monitoring, the jurisdiction of the environmental protection department shall be ordered to make corrections, and may impose a 10 thousand yuan fine of not less than 30 thousand yuan.Article seventeenth (violation of the radioactive source flaw detection device transfer provisi

50、ons of punishment)In violation of the provisions of article ninth of the provisions of the first paragraph, not according to the provisions of the Environmental Protection Department filing procedures, by the use of area, county environmental protection department shall be ordered to correct, given

51、a warning; overdue correction, punishable by 10 thousand yuan to 30 thousand yuan fine.Article eighteenth (violation of the requirements of radioactive source flaw detection equipment operating activities)In violation of the provisions of the tenth and second paragraph of these Provisions, where the

52、 flaw detection device fails to carry out special personnel's warning, the environmental protection department under the jurisdiction of the district or county shall order it to correct immediately; if it refuses to do so, it shall impose a fine of not less than 10 thousand yuan but not more than 50 thousand yuan.In violation of the provisions of the tenth paragraph third, containing radioactive source inspection device stored in residential buildings, residential building or other public places in the area, the county environmental protection department shall be
