如美国政府规定：外国商品刚到岸价低于出厂价格时被认为商品倾销，立即采取反倾销措施。虽然在《关税及贸易总协定》中对反倾销问题做了明确规定，但实际上各国各行其是，仍把反倾销做为贸易战的主要手段之一。

世贸组织的《反倾销协议》规定，一成员要实施反倾销措施，必须遵守三个条件：首先，确定存在倾销的事实；第二，确定对国内产业造成了实质损害或实质损害的威胁，或对建立国内相关产业造成实质阻碍；第三，确定倾销和损害之间存在因果关系。

按照倾销的定义，若产品的出口价格低于正常价格，就会被认为存在倾销。出口价格低于正常价格的差额被称为倾销幅度。所以，确定倾销必须经过三个步骤：确定出口价格；确定正常价格；对出口价格和正常价格进行比较。

正常价格通常是指在一般贸易条件下出口国国内同类产品的可比销售价格。如该产品的国内价格受到控制，往往以第三国同类产品出口价格来确认正常价格。与启动反补贴调查不同的是，倾销行为的受害国在开始反倾销调查前没有与当事成员进行磋商的义务；在审查倾销对国内产业的影响时，需要考虑倾销幅度的大小并确定倾销幅度。世贸组织规定，倾销幅度不超过进口价格2%，倾销产品进口量占同类产品进口比例不超过3%是可以忽略不计的倾销幅度的最低限额。

反倾销的最终补救措施是对倾销产品征收反倾销税。征收反倾销税的数额可以等于倾销幅度，也可以低于倾销幅度。

尽管反倾销调查并未结束，但在已经初步裁定存在倾销及其造成的损害，并防止倾销在调查过程中继续造成损害，各当事方已经得到充分的提供情况和发表意见的机会的前提下，受害成员可以采取临时措施。

另外一种补救措施是价格承诺。若出口商自愿作出了令人满意的承诺，修改价格或停止以倾销价格出口，则调查程序可能被暂停或终止，有关部门不采取临时措施或征收反倾销税。

与启动反补贴调查程序一样，一成员政府应该在接到国内受倾销产品损害的企业或产业的申请后，展开反倾销调查。各当事方必须得到关于启动调查的通知。它们包括出口商所在成员政府、出口商或国外生产商、被调查产品的进口商、行业协会、进口国同类产品的生产商及其行业协会等。若没有充分证据表明存在倾销及其损害，或者倾销幅度或倾销进口数量低于最低限额，则应终止调查。

在世贸组织框架下，只有政府，而不是贸易商和产业界，才能采取反倾销措施。因此，一国的贸易商或产业界必须通过政府来启动反倾销程序。

若出口产品受到调查的成员不满展开调查的成员所采取的行动，它可以将问题提交世贸组织争端解决机构解决。在这种情况下，出口商必须通过本国政府采取这样的行动。反倾销三个条件

WTO《反倾销协议》规定，对倾销产品征收反倾销税必须符合三个基本条件：
