ScopeandPurpose

TheStaffRegulationsembodythefundamentalconditionsofserviceandthebasicrights,dutiesandobligationsoftheWorldHealthOrganizationSecretariatstaff.TheyarethebroadprinciplesofpersonnelpolicyfortheguidanceoftheDirector-GeneralinthestaffingandadministrationoftheSecretariat.TheDirector-Generalmay,asChiefAdministrativeOfficer,provideandenforcesuchStaffRulesconsistentwiththeseprinciplesasheconsidersnecessary.

PURPOSE

TheStaffRulesimplementtheprovisionsoftheStaffRegulationsandgoverntheconditionsofserviceoftheWorldHealthOrganization(the“Organization”).

TheStaffRulesareestablishedbytheDirector-GeneralundertheauthorityoftheStaffRegulationsandaresubjecttoconfirmationbytheExecutiveBoard.TheStaffRulesshallbeconsistentwiththeStaffRegulations.

TheStaffRegulationsarepromulgatedbytheWorldHealthAssemblyand:

015.1.1embodythefundamentalconditionsofserviceandthebasicrights,

duties,andobligationsoftheOrganization’sstaff;and

015.1.2providebroadprinciplesofpersonnelpolicyfortheguidanceofthe

Director-GeneralinthestaffingandadministrationoftheOrganization.

AMENDMENTS

SubjecttoconfirmationbytheExecutiveBoard,theStaffRulesmaybeamendedbytheDirector-GeneralinamannerconsistentwiththeStaffRegulationsandwithoutprejudicetotheacquiredrightsofstaffmembersundertheStaffRegulations.

APPLICATION

TheStaffRulesapplytoallstaffmembersoftheOrganization,exceptasprovidedotherwiseinanyparticularStaffRule.NothingintheStaffRulespreventstheDirector-Generalfrommakingtemporaryappointmentsof60daysorlesswithtermsofservicedifferentfromthoseprovidedintheStaffRules,wheretheDirector-GeneralconsidersthattheinterestsoftheOrganizationsorequire.

TheseStaffRulesareeffectiveasfrom1January2023andsupersedeallStaffRulesinforcebeforethatdate.

EXCEPTIONSTOTHESTAFFRULES

TheDirector-GeneralmaymakeexceptionstotheStaffRules.SuchexceptionsshallnotbeinconsistentwithanyStaffRegulationordecisionoftheWorldHealthAssembly.Furthermore,eachexceptionshallbeagreedtobythestaffmemberdirectlyaffectedand,intheopinionoftheDirector-General,shallnotprejudicetheinterestsofanyotherstaffmemberorgroupofstaffmembers.

DELEGATIONOFAUTHORITY

TheDirector-GeneralmaydelegatetootherofficersoftheOrganizationsuchofhispowersasheconsidersnecessaryfortheeffectiveimplementationofthe

StaffRules.

MASCULINEANDFEMININEGENDERS

IntheseStaffRulestermsreferringtopersonsandstaffmembersinthemasculinegendershallapplyequallytomenandwomenexceptwhereacontraryintentionisevidentfromthecontext.

ARTICLEI

Duties,ObligationsandPrivileges

1.1AllstaffmembersoftheOrganizationareinternationalcivilservants.Theirresponsibilitiesarenotnationalbutexclusivelyinternational.Byacceptingappointment,theypledgethemselvestodischargetheirfunctionsandtoregulatetheirconductwiththeinterestsoftheWorldHealthOrganizationonlyinview.

1.2AllstaffmembersaresubjecttotheauthorityoftheDirector-GeneralandtoassignmentbyhimtoanyoftheactivitiesorofficesoftheWorldHealthOrganization.Theyareresponsibletohimintheexerciseoftheirfunctions.Inprinciple,thewholetimeofstaffmembersshallbeatthedisposaloftheDirector-General.

1.3IntheperformanceoftheirdutiesstaffmembersshallneitherseeknoracceptinstructionsfromanygovernmentorfromanyotherauthorityexternaltotheOrganization.

1.4Nostaffmembershallaccept,holdorengageinanyofficeoroccupationwhichisincompatiblewiththeproperdischargeofhisdutieswiththeWorldHealthOrganization.

1.5Staffmembersshallconductthemselvesatalltimesinamannercompatiblewiththeirstatusasinternationalcivilservants.Theyshallavoidanyactionandinparticularanykindofpublicpronouncementwhichmayadverselyreflectontheirstatus.Whiletheyarenotexpectedtogiveuptheirnationalsentimentsortheirpoliticalandreligiousconvictions,theyshallatalltimesbearinmindthereserveandtactincumbentuponthembyreasonoftheirinternationalstatus.

1.6Staffmembersshallexercisetheutmostdiscretioninregardtoallmattersofofficialbusiness.Theyshallnotcommunicatetoanypersonanyinformationknowntothembyreasonoftheirofficialpositionwhichhasnotbeenmadepublic,exceptinthecourseoftheirdutiesorbyauthorizationoftheDirector-General.Atnotimeshalltheyinanywayusetoprivateadvantageinformationknowntothembyreasonoftheirofficialposition.Theseobligationsdonotceasewithseparationfromservice.

1.7Nostaffmembershallacceptanyhonour,decoration,favour,giftorremunerationfromanygovernment,orfromanyothersourceexternaltotheOrganization,ifsuchacceptanceisincompatiblewithhisstatusasaninternationalcivilservant.

1.8AnystaffmemberwhobecomesacandidateforapublicofficeofapoliticalcharactershallresignfromtheSecretariat.

1.9TheimmunitiesandprivilegesattachingtotheWorldHealthOrganizationbyvirtueofArticle67oftheConstitutionareconferredintheinterestsoftheOrganization.Theseprivilegesandimmunitiesfurnishnoexcusetostaffmembersfornon-performanceoftheirprivateobligationsorfailuretoobservelawsandpoliceregulations.ThedecisionwhethertowaiveanyprivilegesorimmunitiesofthestaffinanycasethatarisesshallrestwiththeDirector-General.

1.10Allstaffmembersshallsubscribetothefollowingoathordeclaration:

Isolemnlyswear(undertake,affirm,promise)toexerciseinallloyalty,discretion,andconsciencethefunctionsentrustedtomeasaninternationalcivilservantoftheWorldHealthOrganization,todischargethosefunctionsandregulatemyconductwiththeinterestsoftheWorldHealth

Organizationonlyinview,andnottoseekoracceptinstructionsinregardtotheperformanceofmydutiesfromanygovernmentorotherauthorityexternaltotheOrganization.

1.11TheoathordeclarationshallbemadeorallybytheDirector-GeneralatapublicmeetingoftheWorldHealthAssembly,byeachDeputyDirector-General,AssistantDirector-GeneralandRegionalDirectorbeforetheDirector-Generalandinwritingbyotherstaffmembers.

STANDARDSOFCONDUCTFORSTAFFMEMBERS

AllstaffmembersshallsubscribetotheoathordeclarationassetoutinStaffRegulation1.10.

ThebasicstandardsforstaffmembersaresetoutinArticleIoftheStaffRegulations.

Astaffmembermaynotactasadelegateorobserverfor,oradviserto,hisgovernment.

AstaffmembermayparticipateininternationalornationalsocietieswhensuchparticipationisnotinconflictwiththestandardsreferredtoinStaffRule110.2above,andmayrepresentsuchsocietiesataninternationalmeetingwiththeDirector-General’sauthorization.

AstaffmembershallobtaintheDirector-General’spermissionbeforepublishingarticleswhosecontentsreflectworkperformedfortheOrganizationorinformationobtainedarisingoutofsuchwork.

Astaffmemberwhoisofferedanyhonour,decorationorgiftfromsourcesexternaltotheOrganizationshallreportthisfacttotheDirector-GeneralwhoshalldecideontheapplicabilityofStaffRegulation1.7.

TheDirector-GeneralshalldecideonthecompatibilityofanyinterestsdeclaredbystaffmemberswithArticleIoftheStaffRegulations,andonanyactiontobetakenunderthisRule:

have,anyinterestin(includingassociationwith)anyentity:

(1)withwhichthestaffmembermayberequired,directlyorindirectly,tohaveofficialdealingsonbehalfoftheOrganization;or

(2)whichhasacommercialinterestintheworkofWHO,or

(3)whichhasacommonareaofactivitywithWHOshallreporttheinteresttotheDirector-General.

“Misconduct”means:

StaffmembersshallexercisereasonablecareinanymatteraffectingthefinancialinterestsoftheOrganization,itsphysicalandhumanresources,propertyandassets.

TheDirector-GeneralshallestablishandapprovehumanresourcesplanswhichwillincludetheclassificationofallpostsintheOrganizationaccordingtothetypeandlevelofthedutiesandresponsibilitiesoftheposts.

Allposts,otherthanthoseattheUngradedlevels,shallbeclassifiedincategoriesandlevelaccordingtostandardspromulgatedbytheDirector-Generalandrelatedtothenatureofthedutiesandthelevelofresponsibilitiesrequired.

3.1ThesalariesforDeputyDirector-General,AssistantDirector-GeneralandRegionalDirectorshallbedeterminedbytheWorldHealthAssemblyontherecommendationoftheDirector-GeneralandwiththeadviceoftheExecutiveBoard.

3.2SalarylevelsforotherstaffshallbedeterminedbytheDirector-Generalonthebasisoftheirdutiesandresponsibilities.ThesalaryandallowanceplanshallbedeterminedbytheDirector-GeneralfollowingbasicallythescalesofsalariesandallowancesoftheUnitedNations,providedthatforstaffoccupyingpositionssubjecttolocalrecruitmenttheDirector-Generalmayestablishsalariesandallowancesinaccordancewithbestprevailinglocalpracticesandthatforstaffoccupyingpositionssubjecttointernationalrecruitmenttheremunerationshallbevariedbetweendutystationstotakeintoaccountrelativecostoflivingtothestaffmembersconcerned,standardsoflivingandrelatedfactors.AnydeviationsfromtheUnitedNationsscalesofsalariesandallowanceswhichmaybenecessaryfortherequirementsoftheWorldHealthOrganizationshallbesubjecttotheapprovalof,ormaybeauthorizedby,theExecutiveBoard.
