第一联—船员1stCopy-Seafarer第二联—船东2ndCopy-ShipOwner第三联—船舶3rdCopy-Ship上海傲兴国际船舶管理有限公司船员上船就业协议AOXINGSHIPMANAGEMENT(SHANGHAI)LTDSEAFARER’SEMPLOYMENTAGREEMENT本协议已由船员本人充分阅读，并理解其权利和义务。Thisseafarer’semploymentagreement(hereinafterreferredtoas“theAgreement”)hasbeenreadandagreedbytheseafarer.根据平等自愿原则，海员和船舶所属船东签订如下上船协议Accordingtotheprincipalofequalityandvoluntariness,theAgreementwasenteredintobetweentheseafarerandtheshipowneroftheship.协议签订日在Theagreementisenteredintoon地点at(place)船员THESEAFARER姓名Fullname:国籍Nationality:联系电话ContactNo.：出生日期Dateofbirth:出生地Placeofbirth:受雇职务Positionofemployment:海员证号码Seaman’sPassportNo:护照号码PrivatePassportNo：聘用港口Portwherepositionistakenup:健康证签发日期Medicalcertificateissuedon:计划聘用日期Estimatedtimeoftakingupposition:详细家庭地址Fullhomeaddress:公司/船东THECOMPANY/SHIPOWNER名称Name:上海傲兴船员管理有限公司/AoxingShipManagement(Shanghai)Ltd地址Address:中国浦东新区金茂大厦2604室/RM2604,JINMAOTOWER,NO.88CENTURYAVENUE,PUDONG,SHANGHAI,PRC船舶THESHIP船名Name:国际识别号IMONo.:船旗Flag：船籍港PortofRegistry：协议条款GENERALTERMSANDCONDITIONS协议期限PeriodofEmployment:±1months起薪日（包括）Wagesfromandincluding:请见备注pleaseref.*周基本工作小時Basichoursofworkperweek:44Hours月基本工资Basicmonthlywages:USD月超时津贴MonthlyOvertime：USD月休假天数Numberofpaidleavepermonth:Days月休假金Monthlyleavepay:USD月奖金和津贴MonthlyBonusandAllowance：USD月工资总额TotalMonthlyWage:USD船领薪Payonboardamount:USD家汇款HomeAllotment:USD家汇款方式HowtoreceiveAllotment:□Cash現金□Remittance汇款*船员上船就业协议从船员在其居住国港口登船或离开其居住国国际机场开始起算，下船之日结束。TheAgreementcommencesfromthedayoftheseafarer’sjoiningataportinhiscountryofresidenceordepartingfromtheinternationalairportinhiscountryofresidence,ceasesonthedayofhisleavingthevesselataport.确认签署Confirmationoftheagreement:本人已阅读、理解并同意签署本协议全部条款(随附协议的标准条款和条件)。Theseafarerofthebelowsignature,hasread,fullyunderstoodandagreedtoallthetermsandconditionsoftheagreement(standardtermsandconditionsofagreementhereunderattached).船东或船长（标题船）签字Signatureoftheshipowner(orthemasterofthecaptionedship):船员签字Signatureoftheseafarer:标准服务条款和条件StandardTermsandConditions总则GeneralProvisions本标准服务条款和条件是《船员上船就业协议》的组成部分，适用于与公司签订《船员上船就业协议》的所有船员。StandardtermsandconditionsispartoftheAgreement,whichapplytoalltheseafarerssignedtheAgreementwiththecompany.本协议所提及的公司或船东指本船的船舶管理公司“上海傲兴国际船舶管理有限公司”。“TheCompany”or“TheShipOwner”meanstheshipmanagementcompanyoftheship--“AoxingShipManagement(Shanghai)Ltd”.船员职责ResponsibilitiesoftheSeafarer船员应遵守船旗国相关法规及海员职业道德；TheseafarershallabidebythedutiesintherelevantregulationsoftheflagstateandtheCodeofEthicsforSeafarer.船员承诺诚实遵守本协议的条款和条件；Theseafarershallfaithfullycomplywithandobservethetermsandconditionsofthisagreement.船员承诺胜任工作且拥有和使用的技能与所持证书相匹配，可供公司验证。Eachseafarershallundertaketoservethecompanycompetentlyandshallundertakethattheypossess,andwillexercise,theskillscommensuratewiththecertificates,whichtheydeclaretohold,whichshouldbeverifiedbythecompany.船员应服从船长及其后继者的合法指令，遵循公司各项政策，包括安全方针和程序以及与此相关的各项命令。TheseafarershallbeobedienttothelawfulcommandsoftheMasteroranypersonwhoshalllawfullysucceedhimandtocomplywithcompanypolicyincludingsafetypolicyandproceduresandanyinstructionsgiveninconnectiontherewith.船员应服从船长的指令或者船舶可能到达的管辖地国家的法律要求进行接种或采取措施保证其本人及全体船员的健康安全。TheseafarershallsubmittotheorderoftheMasterortothelawsofanycountrywithintheterritorialjurisdictionofwhichthevesselmayentertohavesuchvaccinationorinoculationortoundertakemeasurestosafeguardhishealthandthehealthofthewholecrew.船员承诺对本职工作克尽职守，不论是船舶还是货物，也不论是在船、在艇还是在岸。Theseafarershallbediligentinhisdutiesrelatingtothevesselandcargo,whetheronboard,inboatsorashore.对与船舶相关的岸方、当局和其他官方个人采取正当有礼有节的方式。Theseafarershallconducthimselfinanorderlyandrespectfulmannertowardsterminaloperator,portauthoritiesandotherpersonsonofficialbusinesswiththeship.2.8船员必须保持居住舱室和其他生活场所（诸如餐厅、卫生间、浴室、走廊和娱乐室等）干净整洁，令船长满意。Theseafarershallkeephisquartersandotherlivingspaces-suchasmessrooms,toilets,bathrooms,alleywaysandrecreationroomsincleanandtidyconditiontothesatisfactionoftheMaster.就业期限DurationofEmployment3.1 船员上船就业的期限可按双方约定执行，其中干部船员协议期不超过7个月，普通船员协议期不超过9个月。因船舶停靠港口或者航行的航线不方便更换船员的，工作期限可适当提前或者延后1个月。TheseafarershallbeengagedforaperiodmutuallyagreedbetweentheseafarerandtheCompanybutnottoexceed7monthsfortheofficersand9monthsfortherating,andsuchperiodmaybeextendedorreducedby1monthforoperationalconvenience.3.2船员上船就业协议从船员在其居住国港口登船或离开其居住国国际机场开始起算。Theseafarer’semploymentshallcommencefromthedayofhisdeparturefromhisplaceofhire,i.e.whenjoiningataportinhiscountryofresidenceorfromtheinternationalairportinhiscountryofresidence.3.3船员上船就业协议从船员下船之日结束。Theseafarer’semploymentshallceaseonthedayofhisleavingthevesselataport.工作时间和休息时间HoursofWorkandRestPeriods船员在船期间，每周正常的工作时间为44小时，正常工作时间为周一至周五，每天8小时，星期六4小时。Thenormalworkinghoursshallbe44hoursperweek.Thenormalhoursofworkshallbe8hoursperdayfromMondaytoFriday,and4hoursonSaturdayfortheseafarers.船员休息时间的规定如下：船员的最短休息时间不得少于：在任何24小时时段内10小时以及在任何7天时间内77小时。Eachseafarershallhaveaminimumof10hoursrestinany24hourperiodand77hoursinanyseven-dayperiod.休息时间最多可分为两段，其中一段至少要有6小时，且相连的两段休息时间的间隔不得超过14小时。Thehoursofrestmaybedividedintonomorethantwoperiods,oneofwhichshallbeatleast6hoursinlength,andtheintervalbetweenconsecutiveperiodsofrestshallnotexceed14hours.少于30分钟的休息不能视为休息时间。Ashortbreakoflessthan30minuteswillnotbeconsideredasaperiodofrest.本标准的任何规定不得妨碍船长处于船舶、船上人员或货物的紧急安全需要，或出于帮助海上遇险的其他船舶或人员的目的而要求船员从事任何时间工作的权利。在此情况下，船长可中止工作时间或休息时间，要求船员从事任何时间的必要工作，直至情况恢复正常。一旦情况恢复正常，船长应尽快地确保所有在计划安排的休息时间内从事工作的船员获得充足的休息时间。NothinginthisArticleshallbedeemedtoimpairtherightofthemasterofashiptorequireaseafarertoperformanyhoursofworknecessaryfortheimmediatesafetyoftheship,personsonboardorcargo,orforthepurposeofgivingassistancetoothershipsorpersonsindistressatsea.Insuchsituation,themastermaysuspendthescheduleofhoursofworkorhoursofrestandrequireaseafarertoperformanyhoursofworknecessaryuntilthenormalsituationhasbeenrestored.Assoonaspracticableafterthenormalsituationhasbeenrestored,themastershallensurethatanyseafarerswhohaveperformedtheworkinascheduledrestperiodareprovidedwithanadequateperiodofrest.应急演练以及国家法律法规和国际文件规定的训练应以对休息时间影响最小和不会造成疲劳的方式进行。Emergencydrillsanddrillsprescribedbynationallawsandregulationsandbyinternationalinstrumentsshallbeconductedinamannerthatminimizesthedisturbanceofrestperiodsanddoesnotinducefatigue.在船员处于随时待命的情况下，例如无人机舱，如果船员因被招去工作而打扰了正常的休息时间，则应给与充分的补休。Whenaseafarerisoncall,suchasonUMSShips,theseafarershallhaveanadequatecompensatoryrestperiodifthenormalperiodofrestisdisturbedbycall-outstowork.所有加班时间应由船长或部门长进行记录，并至少按照每月的间隔或更短的时间由海员签字。Overtimeshallberecordedindividuallyandinduplicateeitherbythemasterortheheadofthedepartment.Suchrecordshallbehandedtotheseafarerforapprovaleverymonthoratshorterintervals.加班Overtime周一至周五每天8小时及星期六的4小时工作以外时间，周日以及法定节假日工作的时间都为加班时间。船员进行上述常规指定的工作时间以外的所有工作应获得超时津贴。Anyhoursofdutyinexcessofthe8(eight)fromMondaytoFridayandthe4(four)onSaturday,andanyhoursofdutyonSundayoraholiday,shallbepaidforbyovertime.超时津贴应不低于基本时薪的125%。Overtimepaymentshallnotbelessthan125percent(125%)ofthehourlybasicwage.船长和高级船员每月按照固定超时津贴支付，普通船员保证按照103个小时超时津贴支付。Monthlyovertimeallowancepayableforthemasterandofficersarefixedaswellasguaranteedovertime103hourspayablefortheratings.在经船长判断认为直接影响船舶、乘客、船员或货物安全的紧急情况下,或者安全演习，或救助其他船舶或人员的情况下，所产生的工作时间都不计算加班费。Anyadditionalhoursworkedduringanemergencydirectlyaffectingtheimmediatesafetyoftheship,itspassengers,creworcargo,ofwhichtheMastershallbethesolejudge,orforsafetydrillsorworkrequiredtogiveassistancetoothershipsorpersonsinimmediateperil,shallnotcountforovertimepayment.节假日和休假HolidaysandLeave如果法定节假日在周六、周日，则下一个相应的工作日为节假日时间。IfaholidayfallsonSaturdayorSunday,thefollowingworkingdayshallbeobservedasaholiday.船员无论何种原因，在合同结束时，每工作1个月享有不少于2.5天的年休假，不足1月的按比例计算。计算年休假的船员服务期包含了船员为上船工作所花的履行时间以及海员从国外到适当的返回港之间的遣返时间。合理的缺勤不应被视为年休假。禁止达成放弃享受年休假的任何协议。Eachseafarershall,ontheterminationofemploymentforwhateverreasons,beentitledtopaymentofnotlessthan2.5days’leave,foreachcompletedmonthofserviceandprorataforashorterperiod.Theserviceperiodforcalculatingtheannualleaveshouldincludingthetravellingperiodoftheseafarer’sjoiningandleavingship.Reasonableabsencefromthedutyshouldnotbecalculatedasannualleave.Anyagreementtoforgotheminimumannualleavewithpayshallnotbeallowed.薪酬和薪酬支付WagesandPayment7.1船员月薪应每月发放，包括船领薪、银行转账或家汇款部分，直至根据第十四条规定协议终止。Theseafarershallbepaidhiswagesmonthly,includingonboardpayment,banktransferorhomeallotmentsuntiltheterminationofhisemploymentpursuanttoarticle14ofthisAgreement.船员工资收入包括：基本工资、超时津贴、年休假金、奖金和津贴。Themonthlypaymentofwagefortheseafarerisincludingbasicwage,overtimepayment,annualleavepay,bonusandallowance.船东每月一次将船员的船领薪外的工资通过银行汇入船员本人指定的银行账户,且不收取船员的任何服务费。Theshipownershalltransfertheseafarers’wagesexcepttheonboardpaymenttothebankaccountsdesignatedbytheseafarersonmonthlybasis,andthecostisontheowner’saccount.船东应定期向船员提供月薪酬清单，该清单应包括薪酬结构和扣减内容。双方可自行约定清单签收方式。Theshipownershallprovidetheseafarerswiththelistofwagesonamonthlybasis,andthelistshallincludethedeductionsifany.Thetwosidesarefreetoagreethewaytosignthelist.为计算工资和津贴方便，每月按实际日历天数计算。Forthepurposeofcalculatingwages,amonthshallberegardedasactualcalendardayspermonth.社会福利和保险SocialSecurityandInsurance船东或船员用人单位按照国家法律法规的规定为其招募的船员办理社会保险，社会保险包括养老保险、医疗保险、工伤保险、失业保险、生育保险等，以及双方约定的其他商业保险。TheshipownerorthemanningcompanyshallparticipateinsocialsecurityandinsuranceinaccordancewiththerelevantprovisionsoftheP.R.Claw.Thesocialsecurityandinsurancemayincludepensioninsurance,medicalinsurance,work-relatedinjuryinsurance,unemploymentinsurance,maternityinsuranceaswellastheothercommercialinsuranceagreedbetweenbothpartiesifany.船员个人应当缴纳的社会保险费用，由船东或船员用人单位依照法律法规的规定从其本人工资中代扣代缴。代扣代缴金额需在每月工资单上列明。Thepremiumsoftheseafarer’sportioninrespectofhissocialsecurityandinsuranceshallbepaidbytheseafarerhimself,orwithheldfromhismonthlywageandpaidbytheshipownerorthemanningcompanyeachmonthinaccordancewiththerelevantprovisionsoftheState.Thedeductionswithheldshouldbelistedinthemonthlywagepayment.伙食、物料及供给Victualling,StoresandProvisions船东根据航海标准和惯例为在船船员提供生活物资。Theseafarershallbeprovidedbytheshipownerwithsubsistenceconsistencewithgoodmaritimestandardsandpracticeswhileonboardthevessel.为船员准备的物料和供给只供船员在船使用，未能使用或消耗的物料和供给应作为船东的财物留船，船员不能带上岸、出售、毁坏或拿走这些物品。Allstoresandprovisionsissuedtotheseafarerareonlyforuseandconsumptiononboardthevesselandanyunusedorunconsumedstoresorprovisionsshallremainthepropertyoftheshipowner.Theseafarershallnottakeashore,sell,destroyorgiveawaysuchstoresandprovisions.船员财物Crew’sEffects因船舶沉船、搁浅、弃船或者火灾、洪水、碰撞，船员个人财物遭受全部和部分损失、损坏，船员有权得到赔偿，金额最高不超过3000美元，因船员个人错误或者因偷窃或侵吞而导致的损失、损耗除外。Whenanyseafarersufferstotalorpartiallossof,ordamageto,theirpersonaleffectswhilstservingonboardtheshipasaresultofwreck,lossstrandingorabandonmentofthevessel,orasaresultoffire,floodingorcollision,excludinganylossordamagecausedbytheseafarer’sownfaultorthroughtheftormisappropriation,theyshallbeentitledtoreceivefromthecompanycompensationuptoamaximumofUS$3000.船员应保证关于财产损失所提供的任何信息尽量真实。Theseafarershallcertifythatanyinformationprovidedwithregardtolostpropertyistruetothebestoftheirknowledge.船东应采取措施保护生病、受伤或死亡船员在船上的财产，并将财物归还本人或亲属。Theshipownershalltakemeasuresforsafeguardingpropertyleftonboardbysick,injuredordeceasedseafarersandforreturningittothemortotheirnextofkin.服务于战区、疫区、海盗活动区ServiceinWarlikeOperationsAreas/InfectedAreas/Piracy-proneAreas战区、疫区的界定以船东互保协会的最新通告为准。ThepartiestotheIBFshalldetermineawarlike-operationsarea.如果船员所服务的船舶需驶往战区、可能严重威胁生命的传染疾病疫区或者海盗活动区域，船东应当及时向船员提供该地区的全面情报信息、本轮的航线和抵达港口，以及必要的防护措施和知识。Whereashipentersintoawarzone,epidemicareaorpiracyregion,aseafarershallbegivenfullinformationofthiszone,ship’svoyage,portofcallandnecessaryprotectivemeasures.船舶需要驶往战区、疫区需要征得船员的同意，如果船员拒绝前往，船东应当安排该船员遣返并支付遣返费用。Duringtheassignmentaseafarershallhavetherightnottoproceedtoawarzoneorepidemicarea,andinwhicheventtheseafarershallberepatriatedatshipowner’scost.船舶进入战区、疫区，船东每天向船员支付100%基薪的特殊津贴。不足五天的，至少按五天计算。Whereashipentersintoawarzoneorepidemicarea,theseafarershallbepaidabonusequalto100%ofthebasicwageforthedurationoftheship’sstayinsuchareasubjecttoaminimumoffivedays’pay.船舶驶经海盗活动区域，船东应参照国际规定，给予船员补偿。船员因海盗袭击受伤或死亡，应比照战区条款给予补偿或赔偿。Whereashipentersintoapiracyregion,theseafarershallbepaidabonusaccordingtotheregulationsofChineseMaritimeSafetyAdministrationorinternationalorganizations.遣返Repatriation船员在船工作期间，有下列情形之一的，可以要求遣返：Whenservingonboard,aseafarermayaskforrepatriationinanyofthefollowingcircumstances:船员的劳动合同终止或者依法解除的；Theseafarer’scontractexpiresoristerminatedinaccordancewithlaw;船员不具备履行船上岗位职责能力的；Theseafarerisincompetenttoperformthedutiesofhispostonboard;船员配偶、子女、父母死亡或病危的；Theseafarer’sspouse,orchild,oraparenthasdiedorhasfallendangerouslyill;船舶灭失的；Thevesselislost;由于破产、变卖船舶、改变船舶登记或者其他原因，船东不能继续履行对船员的法定或者约定义务的；Theshipownerisunabletocontinuetofulfillitslegalorcontractualobligationsforitsseafarersbyreasonofbankruptcy,saleofthevessel,changeofvessel’sregistrationorotherreasons;由于不可抗力造成的其它应当遣返的情况。Intheeventofforcemajeure船员可以从下列地点中选择遣返地点:Aseafarermaychoosetheplaceofrepatriationfromamongthefollowingplaces:船员接受聘用的地点或者上船任职的地点；Theplacewhereheisrecruitedorhefirstassumeshispostonboard;船员的居住地、户籍所在地或者船籍登记国；Theplaceofresidenceorregisteredpermanentresidenceoftheseafarer,orthevessel’sregistry;船员与公司约定的地点。Theplaceagreeduponbytheseafarerandtheshipowner.船员离开船舶回到遣返目的地的遣返费由船东支付。遣返应当以合理的方式进行，船东应当负责船员在途中食宿费、交通费，直至遣返目的地为止。Theshipownershallpaythecostofrepatriationofseafarersfromtheshipbacktohisemploymentport.Repatriationshalltakeplaceinareasonablemanner.Duringrepatriation,theshipownershallbeliableforthecostsofaccommodationandfoodandtravel.下列情况下，由船员自行负担遣返费用。Theseafarershallundertakethecostofrepatriationonhisownaccountduetothefollowingreason:无合理理由或值得同情的原因要求提前终止协议；Toterminatethecontractwithoutanyreasonableorcompassionatereasons;根据13.2条款被遣返的。Toberepatriatedaccordingtotheclause13.2Dismissal解雇如果船员渎职或不适任工作岗位，在公司书面通知船员指明其渎职或不适任的情况下，可终止雇佣船员。Thecompanymayterminatetheemploymentofaseafarerfollowinganactofmisconductorincompetencewhichgivesrisetoalawfulentitlementtodismissal,providedthatthecompanyshall,wherepossible,priortodismissal,givewrittennoticetotheseafarerspecifyingthemisconductorincompetence.如船员发生特别严重的渎职行为，公司有权可以不经过通知立即解雇船员，终止合同。特别严重的渎职行为包含但不仅限于：TheCompanyshallbeentitledtodismisstheseafarerandthusterminatethisAgreement,withimmediateeffectandwithoutgivingnoticeincasesofgrossmisconduct.Grossmisconductincludes(butisnotlimitedto):违反船旗国与/或船舶所在水域国的法律（不论在船或者在岸）Infringe(whethercommittedaboardoronshore)tothelawofflagstateand/oranycountryinwhosewatersthevesselshallbesituated.侵吞船舶财产，或故意损坏船舶的财产或货物。Misappropriatethevessel’spropertyorbewillfuldamagetosuchpropertyortothevessel’scargo.严重渎职或失职包括但不仅限于：不服从工作安排，拒绝工作，未经船长允许擅自离船，将酒精和毒品带上船，或滥用酒精和毒品，不遵守公司关于酒精和毒品的规定等。Seriousmisconductandneglectofdutiesincludingbutnotlimitedto:insubordination,refusaltowork,leavingthevesselwithouttheMaster’spermission,takingonboardand/orexcessiveuseofalcoholicdrinksandpossessionofdrugsand/orothernoncompliancewiththeCompany’sdrugandalcoholpolicy.任何危害船舶、船员、货物和人身安全的行为。Anyactionsjeopardizethesafetyofthevessel,itscrewand/orcargoaswellasthelifeofanyperson.任何直接或间接引起环境污染的行为。Anyactiondirectlyorindirectlycausingdeliberatepollutionorharmtotheenvironment.任何直接或间接造成损害公司名誉的行为。AnyactiondirectlyorindirectlycauseharmtothereputationoftheCompany.擅离职守或延误报告船舶离港时间。Desertionand/ordelayinreportingtothevesselforitssailingtime.为签订本协议而故意伪造、隐瞒真实情况，包括但不仅限于：提供虚假的过去/目前健康状况、船员资历或不真实表示自己胜任该岗位等。MisrepresentationorconcealmentofanymaterialfactforthepurposeofsecuringthisAgreement,suchas,butnotlimitedto,givingfalseinformationregardingpastorpresentstateofhealth,pastexperienceasaseamanand/orfalselyrepresentinghimselftobeofficiallyqualified.伪造任何文件。Forgeanykindofdocumentation.欺诈、泄密。Dishonesty,fraudorbreachoftheconfidentiality对乘客、官员、船员或临时雇员进行人身攻击。Physicalassaulttoanyguest,officerorcrewmemberand/orSupernumerary如果按照13.2条款解雇船员，公司有权从船员的剩余工资中扣除船员的遣返费用以及公司由于该船员渎职所产生的直接费用。但是，这些费用不包括替换解雇船员的费用。Intheeventofthedismissalofaseafarerinaccordancewithclause13.2,thecompanyshallbeentitledtorecoverfromthatseafarer’sbalanceofwagesthecostsinvolvedwithrepatriatingtheseafarertogetherwithsuchcostsincurredbythecompanyasaredirectlyattributabletotheseafarersprovenmisconduct.Suchcostsdonot,however,includethecostsofprovidingareplacementforthedismissedseafarer.协议的变更和终止AmendmentandTerminationofAgreement一旦船员在船提升，公司可书面授权船长与船员就工资等涉及职务变动的条款签订补充协议。Whentheseafarerispromoted,thecompanymayauthorizetheMastertosignamendmentsornewagreementwiththeseafarerespeciallyreferringtothewages.协议在下列情况下终止：Theemploymentshallbeterminated:协议所约定的双方同意的服务期限到期；UpontheexpiryoftheagreedperiodofserviceidentifiedintheAgreement;船员因病或因伤离船或死亡Whensigningoffowingtosicknessorinjury,ordeath以下情况公司可与船员终止协议：Thecompanymayterminatetheemploymentofaseafarer:据13.2条规定严重渎职的Iftheseafarerhasbeenfoundtobeingrossmisconductinaccordancewithclause13.2;一旦船舶完全灭失，或者船舶被留置一个月以上，或者船舶被出售Uponthetotallossoftheship,orwhentheshiphasbeenlaidupforacontinuousperiodofatleastonemonthoruponthesaleoftheship.以下情况船员可提出终止协议：AseafarertowhomthisAgreementappliesmayterminateemployment:在航次期间，船员的直系亲属被证实病危。Duringthecourseofavoyage,itisconfirmedthattheseafarer’snextofkinhasfallendangerouslyill.按照协议第11章规定，船舶即将驶往战区、疫区；Iftheshipisabouttosailintoawarlikeoperationsarea/InfectedAreas,inaccordancewithArticle11ofthisAgreement;如果船员受雇与特定船舶特定航次或航区，而后来航次或航区发生实质性改变；Iftheseafarerwasemployedforaspecifiedvoyageonaspecifiedship,andthevoyageissubsequentlyalteredsubstantially,eitherwithregardtodurationoftradingpattern;如果船舶提供的生活条件以及船岸提供的供给被证实与据国际公约相关条款不合规，并且连续30天不能改善；船舶没有根据适用的国内法律法规和国际公约取得证书，被视为不合规；iftheShipiscertifiedsubstandardinrelationtotheapplicableprovisionsoftheInternationalConventionandremainssoforaperiodof30consecutivedaysprovidedthatadequatelivingconditionsandprovisionsareprovidedonboardorashore.Inanyevent,aShipshallberegardedassubstandardifitisnotinpossessionofthecertificatesrequiredundereitherapplicablenationallawsandregulationsorinternationalinstruments;如果船舶被扣留且仍将被扣留30天；Iftheshiphasbeenarrestedandhasremainedunderarrestfor30days;船员和公司提前终止协议的最短通知期限不得少于7天，除非有值得同情的原因或其他紧急原因。Minimumnoticeperiodtobegivenbytheseafarersandcompanyfortheearlyterminationofagreementshallnotbelessthan7daysexceptforcompassionateorotherurgentreasons.未经同意，船长和干部船员在航次中，不得擅自辞职、离职或者终止职务。。Duringthevoyage,theMasterandofficersshallnotresign,leaveorsuspendtheirdutieswithoutpermission.如果协议期间，公司将船员以相同的职务、工资和其他条件转移到同一船东/管理人所属的或相关的另一艘船舶，并且第二艘船舶在同样或类似的航区，则不作为终止协议的依据。转船期间船员不应有任何收益或权益的损失，公司应当承担转移的所有成本和生活费用。Itshallnotbegroundsforterminationif,duringtheperiodoftheagreement,thecompanytransferstheseafarertoanothervesselbelongingorrelatedtothesameowner,onthesamerankandwagesandallotherterms,ifthesecondvesselisengagedonthesameorsimilarvoyagepatterns.Thereshallbenolossofearningsorentitlementsduringthetransferandthecompanyshallbeliableforallcostsandsubsistenceforandduringthetransfer.医疗及伤亡保赔MedicalCare,SickPay,Disability,LossofLife-DeathinServiceandInsuranceCover船员在船期间发生或者源于这期间工作而发生疾病或者受伤的，船东应当及时为船员安排治疗并承担全部费用，提供必要的药品和治疗设备，以及离家在外的差旅和膳宿。治疗期为：直至痊愈；确诊为永久性疾病或者永久性残疾；约定的治疗期届满（双方约定的治疗期不少于16周）。只要此种责任有公共当局承担，即可免除船东支付船上医疗费用、膳宿以及丧葬费用的责任。Theshipownershalldefraytheexpensesofmedicalcare,includingmedicaltreatmentandthesupplyofthenecessarymedicinesandtherapeuticappliances,andboardandlodgingawayfromhomeforthesickorinjuredseafarersservingonboarduntiltheyhavebeencured,oruntilthesicknessorincapacityhasbeendeclaredofapermanentcharacteroruntiltheappointedtermoflimitingtoaperiodwhichshallnotbelessthan16weeksfromthedayofthecommencementhascompleted.Theshipowner’sliabilitymaybeexemptedtodefraytheexpenseofmedicalcareandboardandlodgingandburialexpensesifanyinsofarassuchliabilityisassumedbythepublicauthorities.船员在船期间发生或者源于这期间工作而发生疾病或者受伤造成工作能力丧失，在船期间或获得遣返前，船东应当支付船员全额在船工资。Whenthesicknessresultsinincapacityforwork,thesickorinjuredseafarerremainsonboardoruntilhehasbeenrepatriated,theseafarershallbepaidfullcostofmedicalandfullwages.船员在船期间发生或者源于这期间工作而发生疾病或者受伤造成工作能力丧失，获得遣返或上岸休假后回家治疗，有权享受等同于基薪或根据国家法律规定的标准直至痊愈适合工作或由指定的评残机构评定其残疾等级为止，但这个期限应限制在从患病或受伤之日起不少于16周的期限内。为此，海员必须提供由指定的医疗机构出具的检查证明，除非他由于身体原因无法完成该项工作，在同期限内以书面形式通知船东也被认为等同证明。如果海员没有按照这一报告要求行事，将丧失享有上述补助的权利。对于船员因受伤导致丧失工作能力，无论是永久性或部分永久性或临时性丧失，船东的责任和赔偿限制在处理时要遵守雇主赔偿条例第282章。Whenthesicknessresultsinincapacityforworkortheinjuryresultsinincapacityeitherpermanentorpermanentpartialortemporaryincapacity,uponsign-offfromthevesselformedicaltreatment,theseafarerisentitledtosicknessallowanceequivalenttohisbasicwageorthestandardasprescribedbynationallawsorregulationsuntiltheyhavebeencured,oruntilthesicknessorincapacityhasbeendeclaredofapermanentcharacteroruntiltheappointedtermoflimitingtoaperiodwhichshallnotbelessthan16weeksfromthedayofthecommencementhascompleted.Theseafarershallsubmithimselfapost-employmentmedicalexaminationbyacompany-designatedphysician/hospitalintimeuponhisreturnexceptwhenheisphysicallyincapacitatedtodoso,inwhichcase,awrittennoticetotheshipownerwithinthesameperiodisdeemedascompliance.Failureoftheseafarertocomplywiththemandatoryreportingrequirementshallresultinhisforfeitureoftherighttoclaimtheabovebenefits.Wheretheinjuryresultsinincapacityeitherpermanentorpermanentpartialortemporaryincapacity,theliabilityandthecompensationlimitationoftheshipowneraretofollowtheEmployees’CompensationOrdinance,Chapter282aswell.船员在被雇佣期间，包括上船或者遣返途中，因意外事故死亡，船东应当按照有关法律法规的相关规定予以及时赔偿包括丧葬费用。船东除应当支付赔偿外，还需付清该船员所有应得的收入，返还遗物，妥善安置骨灰或遗体。Theseafarerwhodiesasaresultofanaccidentwhilstintheemploymentincludingaccidentsoccurringwhiletravellingtoorfromtheship,shallbeentitledtotimelycompensationincludingburialexpensesaccordingtotheprovisionsoftheLaborContractorrelatedlawsandregulations.Theshipownershallalsopaytheseafarer’sallremainingwages,bearthecostoftransportingtheashesandthedeceased’spersonaleffectsbacktohishomewhenaseafarerdies.船东应投保适当的保险以便完全覆盖本协议章节中所提及的可能发生的意外事故，确保对船员因工伤、疾病或危害而死亡或长期残疾的情况提供赔偿。出险后船东应当负责追索保险赔偿金，并及时、全额转交船员或者死亡船员的继承人。TheshipownershallconcludeappropriateinsurancetocoverthemselvesfullyagainstthepossiblecontingenciesarisingfromtheArticlesofthisAgreement,especiallytoassumecompensationintheeventofthedeathorlong-termdisabilityofseafarersduetoanoccupationalinjury,illnessorhazard.Theshipownershallberesponsibleforclaimingtheindemnityandforwardittotheseafarersorthedescendantsoftheseafarersfullyandintime.如果船员的伤、病、残、亡是缘于船员自身故意行为、犯罪行为、违返国际惯例行为或在船舶之外所造成的，船东将不负责所有赔偿。Nocompensationandbenefitsshallbepayableinrespectofanyinjury,incapacity,disabilityordeathoftheseafarerresultingfromhiswillfulorcriminalactorintentionalbreachofhisdutiesorinjuryoccurredotherwisethanintheserviceoftheship.海员故意隐瞒过往病史和以前的健康检查证明构成虚报、欺骗，将被终止协议并诉诸法律Theseafarerwhoconcealsanddoesnotdisclosepastmedicalcondition,disabilityandhistoryinthepre-employmentmedicalexaminationconstitutesfraudulentmisrepresentationandshalldisqualifyhimfromanycompensationandbenefits.Thismaybeavalidgroundforterminat
