ChapterFiveCollectionAfterissuingpaymentorder(draft)toimporter,exporterwouldentrustbankswithpaymentscollection.Bankshandlethebusinessonthebasisofexporter’sinstructionandisnotliablefortheconsequenceofthecollection,thoughwithendeavor.Thus,bankcollectionisclassifiedintocommercialcreditinsteadofbankcredit.Inbankcollection,exporteris,tosomedegree,inapositiveposition;notreleasingtransportationdocuments(titletogoods)toimporteruntilthelatterpaysoracceptthetimedraftissuedbyexporter,withoutwhichimportercouldnottakedeliveryfromcarrier.Exporterisalsoconfrontedwithmanyrisks,e.g.importermightnottakeuptransportationdocuments(givingupthedeal)andexporterhastoshipbacktheexports,thusentailingadditionalshippingandinsurancecosts.Or,afteracceptingandtakingholdofthedocuments,importerwouldrefusetopayatmaturity.Banksarenotresponsibleforthesebreaches.So,itiscommercialcredit,notbankcreditandisappliedonlywhenbothsidesknowwellaboutandhaveenoughfaithineachother.Itsadvantageisthatcollectionfeesearnedbybanksarerelativelylow.Article2DefinitionofCollection

a.“Collection”meansthehandlingbybanksofdocumentsinaccordancewithinstructionsreceivedinorderto:i.obtainpaymentand/oracceptance,orii.deliverdocumentsagainstpaymentand/oragainstacceptance,oriii.deliverdocumentsonothertermsandconditions.b.“Documents”meansfinancialdocumentsand/orcommercialdocuments:i.“Financialdocuments”meansbillsofexchange,promissorynotes,cheques,orothersimilarinstrumentsusedforobtainingthepaymentofmoney.ii.“Commercialdocuments”meansinvoices,transportdocumentsoftitleorothersimilarinstruments,oranyotherdocumentswhatsoever,notbeingfinancialdocuments.

c.“Cleancollection”meanscollectionoffinancialdocumentsnotaccompaniedbycommercialdocuments.d.“Documentarycollection”meanscollectionof:i.financialdocumentsaccompaniedbycommercialdocuments;ii.commercialdocumentsnotaccompaniedbyfinancialdocuments.
